HomeMy WebLinkAbout2012 03 26 Consent 204 Winter Springs Village Site Acceptance COMMISSION AGENDA     Informational Consent X ITEM204 Public Hearings Regular       March 26, 2012KSKL Regular MeetingCity ManagerDepartment         REQUEST: The Public Works Department Requesting the City Commission validate the Staff recommendation finding the Winter Springs Village Phase 1 sitework to be built in substantial accordance with the Final Engineering plans and to accept the public infrastructure for ownership and maintenance, subject to satisfactory completion of the remaining open punchlist items   SYNOPSIS: Sitework for Winter Springs Village Phase 1 is substantially complete and has been conditionally approved by the applicable City Departments.  This agenda item provides the site acceptance necessary before any certificates of occupancy can be issued by the building official. CONSIDERATIONS: APPLICABLE CODE:   Section 9-178.  Required Improvements to be completed prior to building on lots; exceptions.    (c)  Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished.   (d)  … Certificates of occupancy will not be issued until all improvements are accepted by Consent 204 PAGE 1 OF 3 - March 26, 2012 the city commission.   Winter Springs Village is a new 202 single-family unit subdivision by Meritage Homes located on a 40-acre site in the Winter Springs Town Center.  The site is located along the east side of Tuskawilla Road, south of St. Johns Landing.   Final Engineering and a Developer's Agreement for Winter Springs Village were conditionally approved by the City Commission on March 28, 2011.  The project consists of two phases, with 99 of the 202 units in Phase 1 and the remainder in Phase 2.  A plat for Phase 1 was approved by the City Commission on September 12, 2011 and recorded on October 4, 2011.    This agenda item is for the conditional site acceptance of the Phase 1 site improvements.  The Winter Springs Village Phase 1 sitework has been constructed in substantial accordance with the Final Engineering plans approved by the City Commission on March 28, 2011, except as noted on the attached punchlist, Exhibit A.  In addition, All Development Agreement requirements applicable to the sitework have been completed.   Meritage Homes has provided the required two-year maintenance letter of credit for the public infrastructure being turned over to the City for ownership and maintenance, in the amount of $197,623.31.  This public infrastructure includes:   a.Roadway infrastructure (asphalt pavement, base, curb, gutter, etc.) for all public roads including the segment of Michael Blake Boulevard from Tuskawilla Road to the Cross-Seminole Trail b.The onsite water distribution system including the mains, valves, and hydrants between the points of connection and the point of service (meters) at each lot. c.Public sidewalks along all public right-of-ways and public sidewalk easements d.Signage and striping in the right-of-way e.Sanitary sewer system including the lift station and force main from the lift station to the point of connection near S.R. 434 f.Stormwater infrastructure in the right-of-way, at the three retention ponds, and the drainage easement containing the pond outfall piping and structures g.Irrigation main lines and related appurtenances within the right-of-way   The Developer's Agreement includes provisions for City reimbursement to Meritage Homes of certain eligible infrastructure expenses after completion and acceptance by the City.  This agenda item is not requesting City Commission approval for any reimbursements.  This agenda item is only for the approval of the infrastructure.  A future agenda item requesting City Commission authorization for the reimbursements will be submitted after Meritage Homes has provided the necessary documentation supporting the requested reimbursements in accordance with the Developer's Agreement. FISCAL IMPACT: There is no fiscal impact associated with this site acceptance. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the Consent 204 PAGE 2 OF 3 - March 26, 2012 respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals.   RECOMMENDATION: Staff recommends that the City Commission validate the Staff recommendation finding the Winter Springs Village Phase 1 sitework to be built in substantial accordance with the approved Final Engineering plans, subject to completion of all open punchlist items as noted on Exhibit A prior to issuance of any Certificates of Occupancy, and to accept the public infrastructure for ownership and maintenance. Complete the installation of all common area landscaping that will not be impacted by future home construction, including the entire Tuskawilla Road frontage and the green courtyard space in front of lots 146 -150 and 129 -132. This must be completed and accepted prior to any Certificate's of Occupancy. 2. Completion and restoration of ponds 1, 2, and 3: a. Repair washouts and erosion b. Replace dead sod c. Regrade side slopes as needed to a uniform 5:1 or 2:1 d. Sod all bare areas (except 2:1 side slope area below the breakpoint elevation) e. Install littoral zone plantings and other landscaping per the plans f. Fill and sod over the exposed portions of the outfall pipe (Pond 2) g. Install PVC orifices in accordance with the typical detail on sheet 22 3. Install overlook at Pond 1. 4. Repair areas of asphalt unraveling at various locations; the City reserves the option within the two -year maintenance period to require any unacceptable asphalt areas to be removed and replaced. 5. Convert the temporary fire hydrant with the bag on it on Tuskawilla Road to a permanent hydrant. 6. Install a permanent (decorative) stop sign at the trail crossing on MBB southbound (it is understood that this is on order and the sign will be installed upon arrival). 7. Complete the backfilling and installation of erosion protection at the Pond 1/3 discharge bubble - up structure. 8. Install streetlights along the public streets in Phase 1. It is understood that this work is underway by Progress Energy.
