HomeMy WebLinkAbout2012 02 27 Consent 204 Winter Springs Village Phase 1 Replat COMMISSION AGENDA     Informational Consent X ITEM204 Public Hearings Regular       February 27, 2012KSKL Regular MeetingCity ManagerDepartment         REQUEST: The Public Works Department requests the City Commission approve the Winter Springs Village Phase 1 Replat and authorize the replat to be recorded, subject to satisfaction of all outstanding Staff review comments.   SYNOPSIS: Winter Springs Village Phase 1 consists of the first 99 of 202 total single-family lots in the new subdivision located on the east side of North Tuskawilla Road in the Winter Springs Town Center.  The Phase 1 Plat was approved and recorded in October 2011.  This agenda item is for a replat of lots 151 and 152.   CONSIDERATIONS: LAND USE & ZONING Zoning:                       Town Center Future Land Use:        Town Center   APPLICABLE REGULATIONS Chapter 177, Florida Statutes Chapter 197, Florida Statutes Chapter 9, City Code   Winter Springs Village is a 202-unit all single-family subdivision located on a 40-acre parcel on the east side of North Tuskawilla Road in the Winter Springs Town Center.   The Winter Springs Village Phase 1 Plat was approved by the City Commission on September 12, 2011 and it was recorded on October 4, 2011. Consent 204 PAGE 1 OF 3 - February 27, 2012   During the building layout for the model unit on Lot 151, Meritage Homes' construction surveyor incorrectly staked the location of the property line between lots 151 and 152, causing the new model unit at lot 151 to be constructed over the platted property line separating lots 151/152.   This replat is necessary to correct the property line between lots 151 and 152.  After the replat, lot 151 will be slightly larger in size and lot 152 will be slightly smaller.  After the replat, both lots 151 and 152 will remain in compliance with all applicable parts of the City's Code and Comprehensive Plan.        Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various sections) and Chapter 177, Florida Statutes.  Chapter 177, Florida Statutes require that the plat be fully executed by the owner(s) of record, by all mortgagees having an interest in the land to be subdivided, by the professional surveyor and mapper of record, and by the independent professional surveyor and mapper who reviews the plat for consistency with Chapter 177, Florida Statutes.   As of February 20, 2012, City Staff including the City’s independent surveyor, Southeastern Survey and Mapping Corporation, had several outstanding review comments that Meritage Homes was in the process of addressing.  These comments must be satisfied before the City signs off on the plat certifying its compliance with Chapter 177, Florida Statutes.  As such, this agenda item is requested for City Commission approval conditioned upon the satisfaction of all Staff review comments. FISCAL IMPACT: There is no fiscal impact associated with this agenda item.  The applicant is responsible for payment of all review and recording fees.  COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals.   RECOMMENDATION: Staff recommends the City Commission approve the Winter Springs Village Phase 1 Replat, subject to satisfaction of all Staff review comments, and authorize the City Manager and Consent 204 PAGE 2 OF 3 - February 27, 2012 City Attorney to prepare and execute any and all applicable documents.  ATTACHMENTS: 1.
