HomeMy WebLinkAbout2012 02 27 Public Hearing 500 Ordinance 2012-07 Second Reading Secondary Metal Recyclers COMMISSION AGENDA     Informational Consent ITEM500 Public Hearings X Regular       February 27, 2012KSRS Regular MeetingCity ManagerDepartment         REQUEST: Community Development Department requesting the City Commission adopt on Second Reading Ordinance 2012-07 establishing local regulations applicable to secondary metals recyclers and other similar non-hazardous recyclers.   SYNOPSIS:  The Florida Legislature is currently considering bills (SB 540 and HB 885) amending the regulations applicable to secondary metal recycling businesses. If passed and approved by the Governor, state law will expressly preempt local ordinances regulating secondary metal recyclers. However, local ordinances enacted prior to March 1, 2012 will be grandfathered in and will not be preempted by state regulation.  Both SB 540 and HB 885 include provisions that would limit the hours of operation for secondary metals recyclers. Ordinance 2012-07 establishes more flexible hours, than those proposed in the bills, of operation for purchase transactions for secondary metals recyclers - from 7:00 AM to 7:00 PM Monday through Sunday. CONSIDERATIONS: The Florida Legislature is currently considering two bills, Senate Bill 540 and House Bill 885, that amend the regulations applicable to secondary metal recycling businesses.  The economic downturn has seen the value of metals rise significantly, prompting an increase in metal theft crimes statewide.  SB 540 and HB 885, if passed, would enact more stringent regulations for both secondhand dealers and secondary metal recyclers.  Among the proposed regulations, the bills would: require that secondary metal recyclers maintain and daily transmit an electronic record of all the previous day's purchase transactions to the appropriate law enforcement official; revise the timeframe that secondary metal recyclers Public Hearings 500 PAGE 1 OF 3 - February 27, 2012 are required to maintain purchase transaction records; limit the liability of secondary metals recyclers for the conversion of motor vehicles to scrap metal; and modify the acceptable forms of payment.  In addition, both bills would establish restrictions on the hours of operation for purchase transactions of secondary metals.  The available hours for purchase transactions, as proposed by SB 540 and HB 885, would be from 7:00 AM to 6:00 PM Monday through Friday, limited hours on Saturday, and no hours of operation permitted on Sundays.   Many Winter Springs residents and businesses utilize the 419 Metal & Auto Recycling Center on Old Sanford-Oviedo Road for secondary metal purchase transactions.  In Staff's opinion, the proposed restricted hours would unfairly impact the Winter Springs residents and businesses who routinely make purchase transactions of secondary metals.  Many customers cannot make it to 419 Metal Recycling during normal weekday business hours, and having the additional time in the early evening or on weekends is beneficial.    Ordinance 2012-07 establishes the allowable hours of operation for purchase transactions at secondary metals recyclers from 7:00 AM to 7:00 PM Monday through Sunday.  The term "purchase of secondary metals" includes purchase transactions for regulated metals property, restricted regulated metals property, and ferrous metals.   SB 540 and HB 885, as currently written, propose to expressly preempt local ordinances regulating secondary metal recyclers unless the City enacts its own regulations prior to March 1, 2012.  Ordinance 2012-07 is scheduled for Second Reading on February 27, 2012 and would therefore not be preempted by the upcoming legislation.   In preparing this Ordinance, Staff consulted with the owner of 419 Metal & Auto Recycling Center.  The 419 Metal & Auto Recycling Center is not currently open for purchase transactions on Sundays; however, 419 Metals and other similar businesses in Winter Springs would potentially not have the option to execute purchase transactions with customers on Sundays and be limited in their hours for customer purchase transactions on Saturdays if SB 540 and HB 885 are passed, in the absence of local regulations.   The First Reading of Ordinance 2012-07 was approved by the City Commission at the February 13, 2012 Commission meeting under Public Hearing Agenda Item #501. FISCAL IMPACT: Ordinance 2012-07 has no direct fiscal impact on the City of Winter Springs.  The Ordinance establishes allowable hours of operation for purchase transactions at secondary metal recyclers that would be more flexible than the restricted hours currently proposed by the Florida Legislature.  The restricted hours as proposed by the Legislature could have a detrimental fiscal impact on the businesses that conduct secondary metal recycling and the residents that use these services. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Public Hearings 500 PAGE 2 OF 3 - February 27, 2012 Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals.   The legal advertisement for the Second Reading of Ordinance 2012-07 was posted in the Orlando Sentinel on February 16, 2012. RECOMMENDATION: Staff recommends the City Commission approve Ordinance 2012-07 on Second Reading. WHEREAS, the City is granted the authority, under § 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City desires to establish local operating regulations applicable to secondary metals recyclers and similar non - hazardous recyclers as set forth herein; and WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this ordinance to be in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by reference as legislative findings of the City Commission of Winter Springs. Section 2. Code Amendment. The City of Winter Springs Code of Ordinances, Chapter 20, Zoning, is hereby amended as follows (underlined type indicates additions and strikeout type indicates deletions, while asterisks (* * *) indicate a deletion from the Ordinance of text existing in Chapter 20. It is intended that the text in Chapter 20 denoted by the asterisks and set forth in this Ordinance shall remain unchanged from the language existing prior to adoption of this ordinance): CHAPTER 20. Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this Ordinance and the City Code may be freely made. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 6. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter.
