HomeMy WebLinkAbout2011 07 06 Public Hearings 500 Requesting Adoption of Ordinance 201-08 - Revised regulatory languagePLANNING & ZONING BOARD / LOCAL PLANNING AGENCY ITEM 500 July 6, 2011 Meeting Consent Information Public Hearing X Regular REQUEST: The Community Development Department — Planning Division requests that the Planning and Zoning Board hold a public hearing and make a recommendation of adoption for Ordinance 2011 -08, which revises the regulatory language for home occupations and home offices, in the City's Code of Ordinances. SYNOPSIS: Currently, the only regulating language related to home occupations is located in the definition section of the zoning chapter (Section 20 -1). This ordinance simplifies the definition in section 20 -1 and adds a new section of regulatory text (Section 20 -452) as well as specifically allowing home occupations as a permitted use in all residential zoning districts. Changes are primarily proposed to Chapter 20, with one minor change, in Chapter 9. The ordinance is not to be construed as reclassifying any business, profession or occupation or as revising the rate structure for business taxes as established under Ordinance 674, adopted August 25, 1997. CONSIDERATIONS: APPLICABLE LAW, PUBLIC POLICY, AND EVENTS Florida Statute 163.2511- 163.3246 : (Provides that land development regulations for municipal planning be consistent with the Comprehensive Plan). Florida Statute 166.041 Procedures for adoption of ordinances and resolutions. Winter Springs Charter Article IV. Governing Body. Section 4.06. General powers and duties. Section 4.15 Ordinances in General. Winter Springs Code of Ordinances, Chapter 20, Zoning Euclid v. Amber Realty Co., 272 U. S. 365 (1926) (upholding the constitutionality of the principles of zoning). City of Winter Springs Comprehensive Plan FINDINGS This ordinance revises regulatory language related to home occupations and home offices in the City of Winter Springs. The proposed change to the definition of "home occupation or home office" is followed by a new section of text in the Supplemental District Regulations of the chapter. Even though the language in July 6, 2011 P &Z/Local Planning Agency Public Hearing Agenda Item 500 Page 2 of 3 the new section of text is entirely new, it draws upon the existing language found in the definition section The new regulations revise and expand the existing language currently included within the definition section (section 20 -1), as follows: Broader Language: 1) Location- allowed not only in the home but also may be allowed in an accessory building 2) Area- from 20% to 30% of the conditioned area of the residence for home occupation use 3) Product & Type- restriction removed requiring goods to be made on site. 4) Employees- Does not restrict the number of immediate family members participating, as long as they reside on site. 5) Approval process- Location no longer subject to planning and zoning board approval. Research indicates that the last P &Z action regarding a home occupations was in 1995. More Restrictive Language: 1) Product & Type- Specific list of non - allowable uses has been expanded. 2) Signage- reduced from 2SF to 1 SF 3) Equipment- broadened the restriction from mechanical equipment to any equipment not associated with home use 4) Hazardous Materials- not previously mentioned, now specifically prohibited 5) Objectionable noise, fumes, odor, dust, or electronic interference- not previously mentioned, now specifically prohibited 6) City occupational licenses and business taxes- reiterated for clarity that the home occupation is subject to these requirements FISCAL IMPACT: None. I ORDINANCE NO. 2011 -08 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA; AMENDING THE CITY CODE REGARDING THE REGULATION OF HOME OCCUPATIONS OR HOME OFFICES, PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS, INCORPORATION INTO THE CODE, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority, under § 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission desires to amend the City Code related to home occupations and home offices, and; WHEREAS, the City Commission desires to permit home occupations and home offices in all residential zoning districts subject to certain conditions; and WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this ordinance to be in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by reference as legislative findings of the City Commission of Winter Springs. Section 2. Code Amendment. The City of Winter Springs Code of Ordinances, Chapter 9, Land Development and Chapter 20, Zoning, is hereby amended as follows ( underlined type indicates additions and str-ikeett type indicates deletions, while asterisks (* * *) indicate a deletion from the Ordinance of text existing in Chapters 9 or 20. It is intended that the text in Chapters 9 and 20 denoted by the asterisks and set forth in this Ordinance shall remain unchanged from the language existing prior to adoption of this ordinance): CHAPTER 20. A live -work unit is not a home occupation or home office ARTICLE III. ESTABLISHMENT OF DISTRICTS DIVISION 2. R -1AAA SINGLE - FAMILY DWELLING DISTRICTS Sec. 20 -122. Uses permitted. Within any R -lAAA Single - Family Dwelling District no building, structure, land or water shall be used except for the following use: (1) Single - family dwellings and their customary accessory uses. (2) Home occupations. City of Winter Springs Ordinance No. 2011 -08 Page 2 of 6 DIVISION 3. R -CI SINGLE - FAMILY DWELLING DISTRICT Sec. 20 -142. Uses permitted. Within any R -C1 Single - Family Dwelling Districts, no building, structure, land or water shall be used except for the following use: (1) Single - family dwellings and their customary accessory uses. (2) Horses and ponies, allowing three- fourths of an acre per animal not to exceed ten (10) animals per lot; provided however, horses and ponies can be permitted on less than three - fourths of an acre upon recommendation by the board of adjustment. (3) Home occupations. DIVISION 4. R -1AA AND R -1A ONE - FAMILY DWELLING DISTRICTS Sec. 20 -162. Uses permitted. Within any R -lAA and R -lA Single - Family Dwelling District, no building, structure, land or water shall be used except for the following use: (1) Single - family dwellings and their customary accessory uses. (2) Home occupations. ARTICLE V. SUPPLEMENTAL DISTRICT REGULATIONS DIVISON 4. REGULATION OF HOME OCCUPATIONS OR HOME OFFICES. Section 20 -452. Home occupations or home offices. (a) A home occupation or home office is permitted in all residential zoning categories provided that: 1. The use as a home occupation or home office shall be clearly incidental and subordinate to the use of the dwelling for residential purposes, with not over thirty percent 30 %) of the conditioned area used for the home occupation. The use as a home occupation or home office shall not negatively impact the residential character of the neighborhood in which it is located. 3. The occupation is conducted entirely within the residence or within a permitted accessory building. If the use is to be housed in a permitted accessory building, the accessory building must not have been permitted as an accessory dwelling unit. 4. Under no circumstance shall there be any visible evidence of the conduct of the home occupation or home office from the outside appearance of the building or premises, other than one sign, not exceeding one square foot in area, non - illuminated, mounted flat against the wall at the entrance of the building. 5. Additionally, there shall be no outdoor display of merchandise or products, no shall there be any indoor display visible from the outside of the building. 6. The following shall not be considered home occupations: a. Adult entertainment, b. Antique shops, c. Art studio for ,group instruction, d. Auto service and repair, e. Mechanical service and repair, f Barber and cosmetology services, g. Band or music instruction for ,groups; h. Bed and breakfast facilities, i. Churches, j. Clubs, private, k. Drive -in facilities: 1. Eating and drinking establishments, M. Escort services, n. Food processing and handling, commercial, o. Fortune tellers, p. Funeral homes, q. Group instruction for more than two people, r. Health spas, s. Hospitals and clinics, t. Hotels /motels, u. Kennels or overnight boarding of animals, V. Massage therapy, w. Photographic studios involving chemicals or client visitors, x. Retail commercial operations, y. Vehicle sales or rental, Z. Tattoo parlors, aa. Health care providers, or City of Winter Springs Ordinance No. 2011 -08 Page 4 of 6 bb. Any other use or activity similar in nature or purpose to those listed herein and any other use or activity inconsistent with the requirements of this subchapter or as expressed in the definition of home occupation in § 20 -1. 7. No person other than members of the family residing on the premises shall be engaged in the home occupation or home office, 8. No traffic /parking shall be generated by the home occupation or home office in greater volumes than would normally be expected in a residential neighborhood, and 9. No equipment or hazardous material shall be used or stored on the premises in connection with the home occupation or office, except such that is normally used for purely domestic or household purposes. Additionally, a home occupation shall be prohibited from creating objectionable noise, fumes, odor, dust, or electronic interference (b) A home occupation or home office is permitted in the Town Center subject to the provisions of § 20 -324 (7). (c) All home occupations and home offices as defined in § 20 -1 shall be required to obtain a business tax receipt as required by § 10 -26, prior to the start of such use. In addition to any other submittals required for a business tax receipt, the applicant shall also submit the following: 1. Address for the home occupation or home office, 2. The exact nature of the home occupation, 3. Zoning district where the home occupation or home office is located, 4. Total air conditioned floor area (square feet) of the residence, and 5. Area (square feet) to be utilized in conduct of the home occupation or home office. CHAPTER 9. LAND DEVELOPMENT Sec. 9- 291.2. Definitions. (c) Nonresidential: Includes all land uses not otherwise specified as residential or exempted as set forth in this division. This shall include, but is not limited to, day care facilities, residential care facilities, nursing homes, boarding houses heffie e e�s I educational facilities, libraries, cultural facilities, churches, all commercial uses, all City of Winter Springs Ordinance No. 2011 -08 Page 5 of 6 transient lodging and entertainment facilities except those which are temporary in nature, all automotive facilities and /or structures, all miscellaneous business uses and services and all industrial uses. Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this Ordinance and the City Code may be freely made. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 6. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter. ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular meeting assembled on the day of , 2011.
