HomeMy WebLinkAbout2018 12 10 Consent 300 Starbucks Site AcceptanceCOMMISSION AGENDA ITEM 300 December 10, 2018 Regular Meeting REQUEST: Informational Consent X Public Hearings Regular KS City Manager Department The Community Development Department requesting the City Commission validate the Staff recommendation finding the Starbucks sitework to be built in substantial accordance with the Final Engineering plans, subject to the standard land development checklist. SYNOPSIS: Sitework for the Starbucks project is substantially complete and has been conditionally approved by the applicable City Departments. This agenda item provides the site acceptance necessary before a final certificate of occupancy can be issued by the Building Official. CONSIDERATIONS: APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city commission. Consent 300 PAGE 1 OF 2 - December 10, 2018 SUMMARY: The Starbucks project consists of a 2,500 square foot two-story building (faux second story) on a 0.67 acre lot. The project is located on the corner of Eagle Edge Lane and SR 434 in the Town Center District. The Final Engineering Plans were approved by the City Commission at the March 23, 2018 City Commission Meeting. Sitework commenced in July 2018. The building is expected to be complete and in-service in January 2019. This agenda item is for the conditional acceptance of the site improvements. The sitework has been constructed in substantial compliance with the Final Engineering plans approved by the City Commission, subject to Staff review and approval of any open items on the standard land development checklist. All items on the standard checklist must be complete, subject to Staff approval, prior to issuance of the final certificate of occupancy. FISCAL IMPACT: There is no fiscal impact associated with this agenda item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at six (6) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission validate the Staff recommendation finding the Starbucks sitework to be built in substantial accordance with the Final Engineering plans, subject to Staff review and approval of any open items on the standard land development checklist.
