HomeMy WebLinkAbout2018 07 09 Consent 310 The Blake Apartments Site AcceptanceCOMMISSION AGENDA ITEM 310 July 09, 2018 Regular Meeting REQUEST: Informational Consent X Public Hearings Regular City Manager Department The Community Development Department requesting the City Commission validate the Staff recommendation finding The Blake Apartments (Catalyst Apartments) sitework to be built in substantial accordance with the Final Engineering plans, subject to the enclosed punchlist. SYNOPSIS: Sitework for The Blake Apartments project is substantially complete and has been conditionally approved by the applicable City Departments. This agenda item provides the site acceptance necessary before a final certificate of occupancy can be issued by the Building Official. CONSIDERATIONS: APPLICABLE CODE: Section 9-178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city commission. Consent 310 PAGE 1 OF 2 - July 09, 2018 SUMMARY: The Blake Apartments project consists of ten (10) three-story multifamily residential buildings, totaling 279 rental apartment units. The project is located on approximately 12.4 acres on the west side of Michael Blake Blvd and north of SR 434. The Final Engineering Plans were approved by the City Commission at the December 14, 2015 City Commission Meeting. Minor modifications to the Plans and Developer's Agreement were approved by the City Commission at the January 9, 2017 City Commission Meeting. Sitework commenced in March 2017. The first phase of this project (sitework and buildings) is expected to be complete by the end of July (see Exhibit B - Phasing Plan). The remaining sitework for the subsequent phases will be accepted at the staff level as they are completed, before any buildings in a phase is issued a certificate of occupancy. This agenda item is for the conditional acceptance of the site improvements. The sitework has been constructed in substantial compliance with the Final Engineering plans approved by the City Commission, except as noted on the attached punchlist, Exhibit A. All items on the punchlist must be complete, subject to staff approval, prior to issuance of the certificate of occupancy. FISCAL IMPACT: There is no fiscal impact associated with this agenda item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at six (6) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission validate the Staff recommendation finding The Blake Apartments sitework to be built in substantial accordance with the Final Engineering plans, subject to satisfactory completion of the remaining open punchlist items. Submit Engineer of Record's Certification Letter to the City 2. Submit a complete set of record drawings to the City (all civil sheets in one digital file in PDF format) 3. Complete all sitework and pass the final engineering inspection. Contact Bryant Smith, P.E. at 407-327-8979 to schedule a preliminary and/or final engineering inspection. The final inspection will occur after receipt of the record drawings from the engineer -of - record. 4. Submit a Bill of Sale for all infrastructure being turned over to the City for ownership and maintenance (streets, utilities, sidewalks, etc.). Use the City's standard Bill of Sale form. 5. Submit 2 -Year Maintenance Bond, Letter of Credit, or Cash Escrow Deposit (10% of the value of the improvements to be owned and maintained by the City, as listed on the Bill of Sale) 6. Obtain Approvals from all City Departments and Seminole County Fire Department 7. Submit FDOT Permit Certification and provide City copy of FDOT approval 8. Submit a copy of the Letter from the Engineer to SJRWMD Certifying Improvements (SJRWMD standard certification form) 9. Submit a copy of all FDEP Permit Approvals to the City. The Blake Roadway & Utility Phasing Plan Phase 1- includes MBB, and Eagle Edge Cove from MBB to Sea Hawk Way. Includes all utilities in this Phase including the lift station. Phase 2 - after completion of MBB, this indicated road phase will be completed along with all associated utilities. Includes Perimeter all the way to 434 along with the East section of Tree Swallow Dr. Phase 3 - after eagles leave their nest we will be able to finish Phase 3 roadway and utilities along Tree Swallow Drive and East side of Eagle Edge Cove from Sea Hawk Way up to Tree Swallow Dr. Building and Unit Certificate of Occupancies • Budding and Unit Turnovers will occur as construction completes the buildings. The pre- requisite for budding / unit certificate of occupancies is that the adjacent phased roadway & utilities have been inspected and accepted by the city.
