SUPPLEMENTAL DISTRICT REGULATIONS SPECIFIC
TO MEDICAL MARIJUANA TREATMENT CENTERS;
CLARIFYING THAT THE C-3 HIGHWAY 17-92
COMMERCIAL DISTRICT IS INTENDED FOR LANDS
ADJACENT TO HIGHWAY 17-92 ONLY; PROVIDING FOR
THE REPEAL OF PRIOR INCONSISTENT ORDINANCES
AND RESOLUTIONS, INCORPORATION INTO THE
CODE, SEVERABILITY, AND AN EFFECTIVE DATE.
WHEREAS,
the City is granted the authority, under 2(b), Art. VIII of the State
Constitution, to exercise any power for municipal purposes, except when expressly prohibited by
law; and
WHEREAS,
in 2014, the Florida Legislature passed the Compassionate Medical Cannabis
Act, codified at Section 381.986,

WHEREAS,
in 2015, the Florida Legislature passed the Right to Try Act, codified at
Section 499.0295, Florida Statutes, which amended the Compassionate Use Act and authorizes a
license
as defined by Section 381.986(1)(f), Florida Statutes, and derivative products for use by certain

WHEREAS,
to date, the Florida Department of Health has approved seven (7) dispensing
organizations throughout the State of Florida, which are authorized to cultivate, process, transport,
and dispense Medical Cannabis, Low-THC Cannabis, and derivative products; and
WHEREAS,
on November 8, 2016, Florida voters approved the Florida Right to Medical
Constitution to authorize
entity that acquires, cultivates,
possesses, processes (including development of related products such as food, tinctures, aerosols,

oils, or ointments), transfers, transports, sells, distributes, dispenses, or administers marijuana,
products containing marijuana, related supplies, or educational materials to qualifying patients or
their caregivers and is registered by the Department of Health; and
WHEREAS,
cannabis in Section 893.02(3), Fl-
in Section 381.986, Florida Statutes; and
WHEREAS,
numerous bills are currently pending in the Florida Legislature to implement
Amendment 2, which may direct the Department of Health to register each dispensing organization
previously approved under the Compassionate Use Act and the Right to Try Act and, in addition,
to increase the number of registered Medical Marijuana Treatment Centers if passed; and
WHEREAS,
the passage of Amendment 2 expanded the medical use of marijuana and
related products to patients suffering from
therein, which represents a broader population of patients than those eligible under the
Compassionate Use Act and the Right to Try Act; and
WHEREAS,
the Compassionate Use Act continues to direct following the passage of
Amendment 2 that the criteria for the number and location of, and other permitting requirements
that do not conflict with state law or department rule for, Medical Marijuana Treatment Centers
may be determined by local ordinance; and
WHEREAS,
potential adverse impacts on the health, safety, and welfare of residents and
businesses from secondary effects associated with the distribution of marijuana exist, potentially
including: offensive odors, trespassing, theft, fire hazards, increased crime in and about Medical
Marijuana Treatment Centers, robberies, negative impacts on nearby businesses, and nuisance
problems; and
WHEREAS,
certain of the above potential adverse impacts are heightened by the current
difficulties experienced by many Medical Marijuana Treatment Centers in obtaining banking
services, necessitating such businesses to operate on a cash basis; and
WHEREAS,
there exists the potential for misappropriation and diversion of marijuana to
non-medical uses; and
WHEREAS,
an overabundance of dispensing facilities of Medical Marijuana Treatment
Centers can affect the viability of such facilities, result in compliance issues and increased
regulatory costs, lead to the improper diversion of products, and accentuate threats to the public
health, safety, and welfare; and
WHEREAS,
currently available studies indicate that the optimal resident ratio is one

dispensary per 67,222 residents (1:67,222), based upon market experience in states with laws
similar to Amendment 2, and that the minimum ratio to support a profitable dispensary in Florida
is no more than one dispensary for each 50,000 residents; and
WHEREAS,
the City of Winter Springs projected population at build out is estimated to
reach only approximately 45,000 residents, according to the City of Winter Springs
Comprehensive Plan; and
WHEREAS,
there is a need to adopt health, safety, and welfare regulations to avoid
adverse impacts on the community which may arise from the distribution of marijuana;
WHEREAS,
it is not the purpose or intent of this section to restrict or deny access to
marijuana as permitted by Florida law, but instead to enact reasonable restrictions intended to
protect the public health, safety, and welfare; and
WHEREAS,
in anticipation of the passage of Amendment 2, the City of Winter Springs
placed a temporary moratorium on Medical Cannabis Activities, as defined in Ordinance 2016-08,
which will expire on July 7, 2017; and
WHEREAS,
the City Commission desires to enact regulations related to Medical
Marijuana Treatment Centers, which shall become effective upon the expiration of the temporary
moratorium; and
WHEREAS,
the City Commission of the City of Winter Springs, Florida, hereby finds
this ordinance to be in the best interests of the public health, safety, and welfare of the citizens of
Winter Springs.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER

ARTICLE III. ESTABLISHMENT OF DISTRICTS

DIVISION 15. C-3 HIGHWAY 17-92 COMMERCIAL DISTRICT
Sec. 20-346. - In general.
The lands of the "C-3 Highway 17-92 Commercial" District are particularly oriented to a
wide variety of commercial and professional office uses which may generate excessive traffic from
clientele or capture large volumes of traffic from adjacent thoroughfares. The purpose of this
district is to encourage and develop the normal operation of general commercial land uses listed
here, under such conditions of operation as will protect abutting residential and other
noncommercial uses, and promote aesthetic and architectural harmony, attractiveness, and
compatibility within the community, and abide by the performance and development standards of
the city, county, state and U.S. government. This district is intended for and limited to lands that
are adjacent and have ingress/egress to or easily serviced by collector and major arterial roads

Highway 17-92 and adaptable to higher traffic generating general commercial uses. Areas of the
city for which this zoning category may be appropriate are designated on the future land use map
as "commercial."

Sec. 20-346.3. - Conditional uses.
(1) Automotive/boat/manufactured home major service and major repair establishments
(including body repairs and painting and similar heavy type uses) provided that all activity
shall be conducted within a completely enclosed building and there is no outdoor storage
of any kind;
(2) Halfway houses, group homes, and similar uses;
(3) Light manufacturing, processing, assembly and/or wholesale distribution, provided that all
activity shall be conducted within a completely enclosed building (tenant space not to
exceed 10,000 sq. ft.) and there is no outdoor storage of any kind;
(4) Mortuary and funeral homes;
(5) Outside storage if screened from streets and adjacent properties by an eight-foot masonry
wall with any gates being opaque;
(6) Pawn shops;
(7) Retail commercial and commercial outlets exceeding fifty thousand (50,000) sq. ft.;
(8) Seasonal or temporary outdoor display and/or sales (such as Christmas tree lots, etc.);
(9) Daycare centers;
(10) Schools.
(11) A multiple-family residential use that was lawfully approved and permitted as a conditional
use by the City prior to the effective date of Ord. No. 2015-15 [January 25, 2016] shall be
considered a lawful, conforming use subject to all applicable conditions and requirements
imposed by the city when said use was previously permitted.
(12) Medical marijuana treatment centers, provided that all requirements of Sec. 20-423 are
satisfied, in addition to the following criteria:
(a) The maximum number of conditional use permits issued for medical marijuana
treatment centers shall not exceed one;
(b) No medical marijuana treatment center shall be located within:
1. Five (5) miles of another medical marijuana treatment center, measured in a
straight line from the nearest points of lot boundaries between any existing medical
marijuana treatment center, including those in any other jurisdiction, and the proposed
medical marijuana treatment center;
2. One-thousand (1,000) feet of any public or private elementary, middle, or

secondary school, licensed daycare facility, or park, measured in a straight line from the
nearest point of a lot boundary of any existing school, daycare facility, or park and the
nearest point of the exterior of the proposed medical marijuana treatment center building;
or
3. Three-hundred (300) feet from any residential property, measured in a straight
line from the nearest point of a residential property boundary to the nearest point of the
exterior of the proposed medical marijuana treatment center building.
4. A medical marijuana treatment center does not violate the distance requirements
herein and may not be forced to relocate if it meets the distance requirements herein and a
medical marijuana treatment center, school, licensed daycare facility, park, or residential
lot is subsequently established within the minimum distance of the business.
(c) No conditional use permit shall be issued for any proposed medical marijuana treatment
center until such time as the city commission determines, based on competent and
substantial evidence including, but not limited to, market data and study by a qualified
expert, that sufficient market demand exists to support the long term operation of a
proposed medical marijuana treatment center, taking into consideration the proximity of
medical marijuana treatment centers located in other jurisdictions and the demands of
medical marijuana treatment specifically for the total market consisting of persons residing
only within the jurisdictional limits of the City of Winter Springs.
(d) A conditional use issued under this subsection shall be subject to suspension or
revocation by the city commission, after written notice and hearing, if the medical
marijuana treatment center is found in violation of the conditions set forth in section 20-
423 on three or more occasions.

ARTICLE V. SUPPLEMENTAL DISTRICT REGULATIONS
DIVISION 1. GENERALLY
* * *
Sec. 20-423. Medical marijuana treatment centers.
Medical marijuana treatment centers present unique planning/zoning issues and challenges
for the city and surrounding land uses. Therefore, the medical marijuana treatment center must
satisfy all of the following requirements as a binding and continuous condition of any conditional
use permit issued by the City:

(1) The medical marijuana treatment center must maintain a fully operational alarm system
that secures all entry points and perimeter windows and is equipped with motion detectors,
pressure switches, and duress, panic and hold-up alarms. All windows must be secured by
exterior rolling security shutters during non-dispensing hours. In addition, the medical marijuana
treatment center must maintain a video surveillance system that:
(a) records continuously 24 hours a day;
(b) fixes cameras at entrances and exits to the premises, which shall record from both
indoor and outdoor or ingress and egress vantage points;
(c) fixes cameras where any monetary transactions shall occur; and
(d) retains video surveillance for a minimum of 45 days or longer upon law enforcement
request.
(2) The medical marijuana treatment center shall use a drop safe or cash management
device that provides minimum access to cash receipts;
(3) The medical marijuana treatment center shall store marijuana or its derivative products
in a sealed or locked container or cabinet during dispensing hours, except when being accessed by
employees for distribution and sale. Marijuana and its derivative products shall be stored in a vault
during non-dispensing hours. Customer access to marijuana or derivative products shall be
strictly prohibited, with the exception that customers shall be permitted to carry such products
from the business premises upon purchase.
(4) The preparation, wholesale storage or distribution, cultivation, or processing of any
form of marijuana or its derivative products is prohibited. There shall be no on-site storage of
any form of marijuana or its derivative products on the premises of the medical marijuana
treatment center, except as reasonably necessary for the conduct of the on-site business.
(5) No living marijuana plants are permitted on the site of a medical marijuana treatment
center.
(6) Each employee of the medical marijuana treatment center shall successfully pass a level
2 background screening prior to beginning work and shall be at least 21 years of age.
(7) The medical marijuana treatment center shall provide to the chief of police of the police
department the contact information of an owner or manager who will be available to respond to
problems during and after business hours.
(8) No other tobacco products may be sold on the medical marijuana treatment center
premises.
(9) No medical marijuana treatment center may allow any marijuana to be smoked,
ingested, or otherwise consumed on the premises.
(10) The medical marijuana treatment center shall ensure there is no queuing of vehicles
in the right-of-way. All on-site parking shall be located in front of or on the sides of the medical
marijuana treatment center building and be visible from the Highway 17-92 right-of-way. There
shall be no parking, entrance, or exit for public use at the rear of the building.
(11) The medical marijuana treatment center shall include a waiting area with sufficient
seating to accommodate qualifying patients and caregivers without requiring waiting outside the
building. There shall be no display of marijuana products in the waiting area. The dispensing of

marijuana and its derivative products shall occur in an area isolated from the waiting area, with
the exit doors separated from the entrance, so that the progression of service from the waiting area
to the dispensary and other services to the exit is apparent and does not create overlap into the
waiting area.
(12) The medical marijuana treatment center shall be no greater than 2,000 square feet in
size.
(13) Neither marijuana nor its derivative products shall be displayed or visible from outside
of the medical marijuana treatment center building.
(14) Refuse or waste products incident to the sale and distribution of marijuana for
individual use shall be destroyed, in a manner similar to medical waste, on-site at least once every
twenty-four (24) hours.
(15) The medical marijuana treatment center shall post at its entrance a sign with the
following language:
Only individuals with legally recognized qualifying patient or caregiver
from a medical marijuana treatment center.
In addition, the medical marijuana treatment center shall post signs on at least three sides of the
building that no loitering is allowed on the premises.
(16) Vehicles used for delivery of marijuana to individual qualifying patients or their
caregivers may not be marked in such a manner as to permit identification with the medical
marijuana treatment center.

Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions.
All prior
inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior
ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict.
Section 4. Incorporation Into Code.
This Ordinance shall be incorporated into the
Winter Springs City Code and any section or paragraph, number or letter, and any heading may be
changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and
like errors may be corrected and additions, alterations, and omissions, not affecting the
construction or meaning of this Ordinance and the City Code may be freely made.
Section 5. Severability.
If any section, subsection, sentence, clause, phrase, word or
provision of this ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall
be deemed a separate, distinct and independent provision, and such holding shall not affect the
validity of the remaining portions of this ordinance.

Section 6.Effective Date.
This Ordinance shall become effective immediately
upon the expiration of the moratorium enacted pursuant to Ordinance 2016-08.
