SYNOPSIS: Southern Oaks is a 54 -unit single - family residential subdivision by Taylor Morrison located north of SR 434 and west of the intersection of DeLeon Street and Cress Run. Sitework is currently under construction and Taylor Morrison is seeking City approval to record the plat. CONSIDERATIONS: LAND USE & ZONING Zoning: R -1 (One Family Dwelling District) Future Land Use: Low Density Residential APPLICABLE REGULATIONS Chapter 177, Florida Statutes Chapter 197, Florida Statutes Chapter 9, City Code Southern Oaks is a single - family residential development by Taylor Morrison that is partially in the City of Winter Springs and partially in the City of Oviedo. The portion of the development in Winter Springs consists of 54 homes on 33.30 acres, and is located north of SR 434 and west of the intersection of DeLeon Street and Cress Run. Consent 301 PAGE 1 OF 3 - April 24, 2017 At the June 22, 2015 City Commission meeting, the Commission approved the Final Engineering plans and a Developer's Agreement for Southern Oaks. A revised Developer's Agreement was approved by the City Commission at the May 9, 2016 City Commission meeting. Sitework construction on the Winter Springs portion of the subdivision began in October 2016 and is substantially complete. The Southern Oaks plat submitted herein includes only the 54 lots in the City of Winter Springs. The plat is titled "Southern Oaks Phase Three" because the first two phases consisted of the plats that have already been recorded for the City of Oviedo portions of the subdivision. Southern Oaks is a gated community that will have all private streets. The plat provides easements to the City at various locations for access, public safety, utilities, and other governmental services. Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various sections) and Chapter 177, Florida Statutes. Chapter 177, Florida Statutes require that the plat be fully executed by the owner(s) of record, by all mortgagees having an interest in the land to be subdivided, by the professional surveyor and mapper of record, and by the independent professional surveyor and mapper who reviews the plat for consistency with Chapter 177, Florida Statutes. City Staff, including the City's independent surveyor, Southeastern Surveying and Mapping Corporation, have reviewed the plat. The remaining open Staff and independent surveyor comments, attached as Exhibit B, are conditions of approval that must be addressed prior to recording the plat. Before the plat can be recorded, per Section 9 -76 of the City Code Taylor Morrison is required to provide a bond, letter of credit, or cash deposit in favor of the City in an amount equal to the construction cost of any site improvements that have not been completed. At this time, the following site infrastructure items are incomplete and will need to be covered by a bond, letter of credit, or cash deposit, if not complete and approved by the City at the time the plat is recorded. • Water and Wastewater FDEP Clearance • Lift Station Construction • Sidewalk Construction • Final Lift Of Asphalt • Striping • Site Fencing • Miscellaneous Stormwater Infrastructure Items • Wall at Lift Station and East Boundary • Masonry and Aluminum Fencing at North End FISCAL IMPACT: There is no fiscal impact associated with this agenda item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and Consent 301 PAGE 2 OF 3 - April 24, 2017 the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. RECOMMENDATION: Staff recommends the City Commission approve the Southern Oaks plat for recording, subject to the conditions noted, and authorize the City Manager and City Attorney to prepare and execute any and all applicable documents. For pond tracts B and C, provide a drainage easement to the city for emergency maintenance and inspection purposes 4. While there are no mortgages on the property, the easements in the title report should be shown on the plat. I don't see that the Florida Power easements are shown anywhere. 2. The utility easement dedication language on Page 1 needs to be amended because it only reflects a 10' utility easement, whereas many of the utility easements shown on the plat (map) itself are 15' wide. 3. There should be plat notes added that address how the tracts that are dedicated to the HOA are to be maintained — either be reference to an easement, CCRs, or the Development Agreement. I would also suggest another plat note stating the plat is subject to the Development Agreement located at Book 8726, Pages 1046 -1061.
