SYNOPSIS: One of the responsibilities of the City Clerk is to provide the Mayor and City Commission with a submittal of all Meeting Minutes, as soon after a City Commission meeting as possible; so, that it is a reminder to the Mayor and City Commission, as to what transpired at their most recent meeting, and also provides a record of the actions and directives of the City Commission, for the future, and which becomes the official record. If the City Commission is in agreement with what the City Clerk provides in these Minutes, then the City Commission would be asked to Approve the Minutes, as submitted. Should the Mayor and /or City Commission feel something is not appropriately documented in these Minutes, then a Motion would be appropriate to have the Minutes changed to reflect what the majority of the City Commission would prefer. CONSIDERATIONS: This Agenda Item includes the Unapproved Minutes from the Monday, April 10, 2017 City Commission Regular Meeting. Even though these Minutes are being submitted by the City Clerk, (with proofing by Office of the City Clerk Staff), no other party has required that changes be made to the Minutes before being submitted. Mayor Lacey asked the City Commission, "May we adopt the Agenda ?" Deputy Mayor Pam Carroll stated, "Yes." Mayor Lacey then said, "With no objections, it will stand as adopted." Community Development Department REQUEST: The Community Development Department is advising the City Commission of the status of current development projects within the City. FISCAL IMPACT: There is no fiscal impact associated with this agenda item. RECOMMENDATION: Staff recommends the City Commission receive and review the information provided. There was no discussion on this Agenda Item. PUBLIC INPUT Mayor Lacey opened "Public Input ". Ms. Juanita Blumberg, 141 Bear Springs Drive, Winter Springs, Florida: mentioned her property has been on the market for approximately eight (8) years, and recently she received potential interest from a developer for an upscale 55+ project and hoped the City Commission would "rethink" any objections to a 55+ project. Ms. Blumberg mentioned that her plan was to work with the Community Development Department to bring this property forward for potential consideration by the City Commission. Mayor Lacey closed "Public Input ". Mr. Brian Fields, P.E., Director, Community Development Department pointed out aspects of the Zoning related to the property being discussed, that a Multi - Family Residential Use can be considered for by Special Exception, and such a project could be brought to the Community Development Department, and Staff would review it and then it could possibly be brought to the City Commission for their consideration. Discussion followed on rental /ownership, previous discussions about similar projects, if this suggested kind of a project would work in the Town Center, that this potential project could be brought forth for the City Commission to review, Ms. Blumberg should work with the Community Development Department on this effort, the aging population wanting to continue to live in Winter Springs even after home ownership, that there are two (2) Assisted Living Facilities (ALF's) currently in process in Winter Springs, there may be concerns with over saturation, and what would happen if someone under fifty -five (55) lived with someone in a 55+ community. With further remarks, Ms. Blumberg was asked if her land would be subdivided, to which she said it would. 3 CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - APRIL 10, 2017 PAGE 4 OF 12 Mayor Lacey and Members of the City Commission then complimented Ms. Blumberg on the times she has assisted the City. Commissioner Kevin Cannon asked City Attorney Anthony A. Garganese for information related to 55- and -older communities, and if children and /or grandchildren did wind up living in such a community, what could be done to prevent any problems that might impact area schools. Attorney Garganese stated, «Okay". „n 9 CONSENT AGENDA r CONSENT 300. Information Services Department REQUEST: The Information Services Department requests authorization to dispose of surplus assets according to the attached disposition sheets. FISCAL IMPACT: There is no cost to dispose of these surplus assets. The City receives revenue generated from items sold at auction. RECOMMENDATION: Staff recommends that the City Commission approve the disposition of the attached list of surplus assets. No discussion. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - APRIL 10, 2017 PAGE 5 OF 12 CONSENT 301. Public Works Department REQUEST: Public Works Department requests the City Commission Approve the Land Exchange Agreement with the State which swaps the Phillips donated property along SR 419 with the trail right of way needed to construct Magnolia Park. Additionally, authorization is sought to allow the City Attorney to proceed with a Right of Way Use Agreement allowing the State to construct the Cross Seminole Trail in the unimproved City right of way from SR 419 to Old Sanford Oviedo Road. FISCAL IMPACT: The only fiscal impacts associated with this agenda item are the appraisal update for Parcel Two ($2,400). Closing costs for Parcel Two boundary survey, Parcel One title insurance, doc stamps, etc. are estimated at $12,000 which will be funded from the Magnolia Park project fund (301). Utility Department REQUEST: The Utility Department requesting approval to purchase three high service Ruhrpumpen pumps for Water Treatment Plant #1 from Environmental Equipment Services, LLC of Lakeland in the amount of $65,656.00 plus a 10% contingency. Garganese, Esquire Attorney Garganese mentioned that the next City Commission Agenda would include information about the Medical Marijuana Dispensary matter. REPORTS 601. Office Of The City Manager — Kevin L. Smith No Report. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - APRIL 10, 2017 PAGE 8 OF 12 REPORTS 602. Office Of The City Clerk — Andrea Lorenzo - Luaces, MMC City Clerk Andrea Lorenzo - Luaces asked for clarification about posted events that are currently shown on two (2) different City calendars, as well as posting events that the Mayor and City Commission may attend. Remarks continued about what the calendar was used for, the Sunshine Law, noticing meetings, past practices, and that meetings and events noted on a calendar was not protection from Sunshine Law concerns. Comments followed on simplicity, the Sunshine Law, and to maintain just one (1) calendar. Mayor Lacey summarized the comments, recommended one (1) calendar and suggested, "That you put on that calendar everything that is official City business, so Commission Meetings, official City Boards, anytime where you or your Staff are going to be there taking Minutes, and then the only optional area that I put is if you definitely know that there are Commissioners attending a given function, then put it on the calendar." Mayor Lacey continued, "I put that into something of an optional category. Use your judgment; if you can, you will, but there is no legal reliance upon you doing that one way or the other; so, if you miss an event, there is no harm, no foul." City Clerk Lorenzo - Luaces asked, "So, that would be Consensus of everybody ?" Deputy Mayor Carroll stated, "Yes." No objections were voiced. Deputy Mayor Carroll then spoke on the merits of the "SHINE" (Serving Health Insurance Needs of Elders) program which offers services for Seniors on the third Monday of most months at the Senior Center. Additionally, Commissioner Cade Resnick thought the "SHINE" (Serving Health Insurance Needs of Elders) program was a helpful program and the City should include it as well as anything else that may be of interest. City Manager Kevin L. Smith noted that the Senior Center Staff also provides a calendar of events. Commissioner Jean Hovey mentioned the importance of reminding Seniors about information that might be helpful. Commissioner Cannon also thought the "SHINE" (Serving Health Insurance Needs of Elders) program was a helpful resource and the City should include information about "SHINE" (Serving Health Insurance Needs of Elders) events on the calendar. Furthermore, Commissioner Cannon noted that he liked the calendar and how it was done. City Clerk Lorenzo - Luaces mentioned again that "The website calendar right now looks different but we will make them both the same." With further comments, City Clerk Lorenzo - Luaces added, "We will make sure that `SHINE' (Serving Health Insurance Needs of Elders) is on there." REPORTS 603. Office of Commissioner Seat One - The Honorable Jean Hovey Commissioner Hovey referenced the Police Department and Winter Springs High School's Art Opening event held last week and said that it was a great event. Continuing, Commissioner Hovey noted that she had found out that insurance information could be kept via an electronic means, as well as vehicle registrations. Chief of Police Kevin Brunelle, Police Department elaborated on allowed electronic information. r 11 11110 ;22=_ CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - APRIL 10, 2017 PAGE 9 OF 12 Commissioner Hovey also pointed out that if one were to find a Driver's License, one could drop it in the mail and the Postal Service would deliver it at no charge. Next, Commissioner Hovey remarked that the Florida League of Cities was offering registration opportunities for its' five (5) Policy Committees, and that she had served on the "Transportation & Intergovernmental Relations" Policy Committee and was willing to continue serving on this same Policy Committee, however she was open to letting someone else serve on the "Transportation & Intergovernmental Relations" Policy Committee. Mayor Lacey noted he has been serving on the "Finance, Taxation and Personnel" Policy Committee and would like to continue serving on that Policy Committee. Commissioner Resnick said he signed up for "Growth Management & Economic Affairs" Policy Committee. Attorney Garganese mentioned that some of his other cities agendaize this matter for action by the Elected Officials. Commissioner Cannon said that he would like to serve on one of the Policy Committees. Further comments followed. Then, Deputy Mayor Carroll mentioned serving on the "Urban Administration Policy Committee. Commissioner Resnick spoke about the hierarchy within the Florida League of Cities' Policy Committees. Comments continued. Commissioner Geoff Kendrick also spoke about the Policy Committees to which Commissioner Hovey said to Commissioner Kendrick, "If you wanted to do "Transportation [& Intergovernmental Relations]" Policy Committee, I would be willing not to put my name in for that." Commissioner Cannon said then that he would apply for the "Energy, Environment & Natural Resources" Policy Committee, and specified, "If there are no objections, I will do that one." Deputy Mayor Carroll stated, "Urban Administration" [Policy Committee], I want to stay with if possible." Further regarding the "Transportation & Intergovernmental Relations" Policy Committee, Commissioner Hovey said to Commissioner Kendrick, "That is the one I have been doing, and I have no problem giving it up." Commissioner Kendrick said to Commissioner Hovey, "I would be happy to." Next, Commissioner Hovey noted that Commissioner Resnick was the City's representative on the Oviedo - Winter Springs Regional Chamber of Commerce, and Mayor Lacey serves on Seminole County Public Schools' Public Services Facilities Planning Committee (PSFPC). Commissioner Hovey then asked Deputy Mayor Carroll about her serving on the Community Redevelopment Agency (CRA). Deputy Mayor Carroll spoke briefly about her service on this organization. Furthermore, Commissioner Hovey then asked if the Commission could call the Clerk if one of them was unable to attend a committee meeting to which they belonged, that they felt was important enough to warrant another Elected Official attending in their place. Mayor Lacey explained that in such situations where he was a committee representative and unable to attend a meeting, he has contacted the City Clerk and asked her to notify the Deputy Mayor or the next most senior Commissioner; however there is no specific protocol. Commissioner Hovey inquired about any other committees that our Elected Officials represented the City Commission on. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - APRIL 10, 2017 PAGE 10 OF 12 Deputy Mayor Carroll mentioned this would be her tenth year serving on the Oviedo - Winter Springs Regional Chamber of Commerce's "Winter Springs ARToberFEST" Committee. Discussion followed. Commissioner Hovey then noted, "As a whole, we are supposed to discuss things before any decisions are made." With additional remarks, Commissioner Hovey stated, "When we go to these things, if there is something that comes up that is a City Commission decision, is it brought back before us ? ". ;k With further remarks, Mayor Lace said "I think when we o to events we are going as a conduit of the f� Y Y g g g Commission, both ways. I mean the principle that you are talking about I think is extremely important,, is that none of us singularly have any weight behind our voice. We only have weight if they are on this dais, three (3) Votes passed — beyond that being a conduit, we are breaking the law." Commissioner Hovey added, "I just did not want there to be any misrepresentation or misunderstanding from groups outside of the City of Winter Springs..." Mayor Lacey remarked, "...I think we have to be careful about that because it is very easy for that impression." Deputy Mayor Carroll further commented on her service on the Community Redevelopment Agency (CRA). Mayor Lacey spoke briefly about his representation on MetroPlan Orlando's Municipal Advisory Committee. Remarks followed on the Tri- County League of Cities, and the South Seminole and the North Orange County Wastewater Transmission Authority (SSNOCWA). Regarding the South Seminole and North Orange County Wastewater Transmission Authority (SSNOCWTA), Mayor Lacey mentioned that a Staff member should be our Representative on that Committee and suggested, "It probably should come back to this Commission, maybe next Meeting to ratify an Appointment." REPORTS 604. Office of Commissioner Seat Two - The Honorable Kevin Cannon Commissioner Cannon also commented on the Police Department and Winter Springs High School's Art Opening event held last week and thought it was well done and hoped area publications, including the "Tuscawilla Today ", would showcase the event. Next, Commissioner Cannon mentioned that he recently attended a very nice WWII Veterans luncheon event. Lastly, Commissioner Cannon referenced Indian Trails Middle School and explained that they were applying for a Contract Proposal for ARISS (Amateur Radio on the International Space Station) and asked if the City could send a letter of support. Mayor Lacey suggested a Proclamation instead to which Commissioner Cannon thought that would be better. Mayor Lacey added that the City Clerk could put a Proclamation together for this cause. City Clerk Lorenzo - Luaces confirmed she would assist and stated, "Yes." Further comments. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - APRIL 10, 2017 PAGE I I OF 12 REPORTS 605. Office of Commissioner Seat Three/Deputy Mayor - The Honorable Pam Carroll Deputy Mayor Carroll noted that the "Explore Outdoors" event was "phenomenal" and offered "kudos" to Mr. Chris Caldwell, Director, Parks and Recreation Department Staff and also complimented Ms. Melissa Sileo, Recreation Coordinator, Parks and Recreation Department. The Police Department and Winter Springs High School Art Opening event held last week was also addressed by Deputy Mayor Carroll who thought it was a great event and said she would include this event in the "Tuscawilla Today" publication. Next, Deputy Mayor Carroll said she was a member of the Legal Aid Society's Board of Directors and they were introducing a new service which included providing low income Senior with assistance in legal directives. Deputy Mayor Carroll noted that this service would be available, beginning in May. REPORTS 606. Office of Commissioner Seat Four - The Honorable Cade Resnick Commissioner Resnick remarked that he recently attended a hospitality event at Winter Springs High School and that it was well done. It was then mentioned that Commissioner Hovey also attended. Secondly, Commissioner Resnick also commented on the current Legislative Session and hoped that citizens would reach out to their Legislators and try to help local governments keep Home Rule. Commissioner Resnick said that if any citizens were interested in finding out more about this, he was willing to send them information. REPORTS 607. Office of Commissioner Seat Five - The Honorable Geoff Kendrick Commissioner Kendrick complimented Mr. Caldwell on "another excellent job" in terms of the "Explore Outdoors" event and mentioned that businesses he spoke with there, said they needed more customers. Commissioner Kendrick hoped that residents would support local businesses. Continuing, Commissioner Kendrick also spoke of the importance of Home Rule. Related to Home Rule, Commissioner Cannon mentioned a piece he heard on the radio from a renowned community development author who said that local government was the best form of government. Commissioner Cannon hoped Florida legislators could have heard this story that he heard. Brief further remarks.
