SYNOPSIS: The City of Winter Springs Community Development Department has initiated the request for a Small Scale Plan Amendment and Rezoning for two (2) parcels totaling approximately 4.51 acres, generally located at the southeast corner of State Road 434 and State Road 417. Ordinance 2017 -06 proposes to change the Future Land Use Map designation from City of Winter Springs "Greeneway Interchange District (GID)" to City of Winter Springs "Commercial ". Ordinance 2017 -07 proposes to rezone the properties from City of Winter Springs "Greeneway Interchange District (GID)" to City of Winter Springs "General Commercial (C -2) ". At the request of the current property owner, the City has initiated the requested future land use map amendment for said property to City of Winter Springs "Commercial" in order to improve the property's future commercial development potential. On the Rodriguez property, there is a 1,538 square foot single - family residence that was built in 1968. Both properties will be sites for future commercial /office development. The surrounding area is generally characterized by the following land use and zoning categories: Background — The City of Winter Springs reviewed the zoning and land use categories for properties located both northeast and southeast of the intersection of State Road 417 and State Road 434. The area is primarily a mixed use (residential and commercial) corridor serving as an entry point to the City of Winter Springs. The subject properties are currently zoned Greeneway Interchange District (GID) with a Greeneway Interchange District Future Land Use designation. The area is primarily a mixed use (residential and commercial) corridor serving as an entry point to the City of Winter Springs. The subject properties are currently zoned Greeneway Interchange District (GID) with a Greeneway Interchange District Future Land Use designation. Initially, the City targeted the GID for high -tech industry Public Hearings 402 PAGE 3 OF 10 - March 27, 2017 employment centers complemented by ancillary commercial and retail establishments. This particular corridor presents existing development related challenges, such as connectivity to adjoining developable properties, buildable acreage, and existing GID development design parameters. The City has identified a potential opportunity to encourage economic growth within this corridor. As part of our initial efforts to explore this opportunity, city staff reached out to each of the current owner /property representative, in order to discuss potential land use and zoning options which could help incentivize future development activity within this particular area. Staff concluded that the administrative Small Scale Plan Amendment will better position the subject properties for future commercial and /or office development activity within this particular area. COMPREHENSIVE PLAN ANALYSIS Justification for Future Land Use Designation - Through Ordinance 2017 -06, the applicant is requesting the City of Winter Springs "Commercial" land use designation on the 4.51 acre parcel. The requested future land use map designation is designed to remove existing development related challenges and thereby encourage economic growth within the State Road 434 corridor east of State Road 417. In addition, the requested future land use map designation was determined by evaluating the prevailing character of the immediate area, as well as evaluating the land use and future goals and objectives of the City. CONSISTENCY WITH THE CITY'S CODE OF ORDINANCES: Section 15 -36 Review Criteria The recommendation of the staff shall be based on the following minimum factors, if applicable: (1) Whether the proposed amendment will have a favorable or unfavorable effect on the city's budget, or the economy of the city or the region; Converting the future land use designation from Greenway Interchange District to Commercial will have a favorable effect by increasing the chance fore economic growth in this area adding diversification to the tax base which is currently 88.55% residential and 11.45% commercial. (2) Whether the proposed amendment will diminish or negatively impact the level of service (LOS) of public facilities; Based on the information below, Staff does not feel that the LOS of public facilities will be negatively impacted. ROADS /TRAFFIC CIRCULATION. The portion of State Road 434 that abuts the subject property contains four (4) lanes at the State Road 417 interchange and tapers down to two (2) lanes on the east side of the interchange. Access to the subject property from State Road 434 may be difficult due to the proximity of the State Road 417/ State Road 434 interchange. Development of the property will require coordination with FDOT, the permitting agency for driveway connections to State Road 434. The segment of State Road 434 from State Road 417 to Hammock Lane is overcapacity, and this could impact the ability to develop these properties at the desired use and /or density. State Road 434 is planned by Seminole County to be widened from two to four lanes within the next six to eight years. GID typically allows for a higher Floor Area Ratio (FAR) than Commercial; therefore, the net traffic impact resulting from the zoning and land Public Hearings 402 PAGE 4 OF 10 - March 27, 2017 use change, at the time of development, is anticipated to be equal or lower. Availability o Access: Future commercial /office development will have direct access to State Road 434. Use of cross access between parcels may be necessary. Function Classification: State Road 434 is a principal arterial that runs north from Edgewater Drive near Orlando to Altamonte Springs, then east to Oviedo, and then south to East Colonial Drive. Within this portion of the City of Winter Springs, State Road 434 is a four -lane roadway tapering to two -lanes immediately east of the subject property. The current level of service (LOS) on this portion of State Road 434 is "F" and it is expected to remain "F" until the roadway is widened to four -lanes from SR 417 east to Hammock Lane. POTABLE WATER: The City has potable water facilities available to serve the subject property. The water service consists of an existing 12 -inch water main along the north side of State Road 434. WASTEWATER: The City has an existing 6 -inch force main along the south side of State Road 434. RECLAIMED WATER: Facilities serving the subject property: None currently. ELECTRIC SERVICE: Facilities serving the subject property: None currently. The City of Winter Springs is serviced by Duke Energy for electric service. A future land use change will not impact current electric rates. SOLID WASTE: Facilities serving the subject property: None currently. The City of Winter Springs currently has a franchise agreement and is serviced by Waste Pro of Florida, Inc., a private solid waste contractor who will provide service to this area. STORMWATER MANAGEMENT.• Facilities serving the parcels: None currently. Upon development, the site will be required to provide on -site stormwater management in accordance with all applicable St. John's River Water Management District (S)RWMD) and City of Winter Springs criteria. POLICE: The City of Winter Springs is responsible for police protection. The station closest in proximity to the subject property is located at 300 N. Moss Road. Response times are averaged monthly. It is not anticipated that the change in land use will affect the response times. FIRE: Seminole County is responsible for fire protection. City of Oviedo Fire Station 44, Public Hearings 402 PAGE 5 OF 10 - March 27, 2017 located at 42 Central Avenue South, Oviedo, Florida is the closest fire station. The response time is approximately two minutes. It is not anticipated that the change in land use will affect the response times. (3) Whether there will be a favorable or unfavorable impact on the environment or the natural or historical resources of the city or the region as a result of the proposed amendment; NUISANCE POTENTIAL OF PROPOSED USE TO SURROUNDING LAND USES: The change in designation from City of Winter Springs " Greenway Interchange District (GID) " to City of Winter Springs "General Commercial" with a "Conservation Overlay" will not result in any nuisance potential for the surrounding properties because future commercial development would be compatible with the "General Commercial" future land use designation, and the subject property is within a mixed use (residential and commercial) corridor. HISTORICAL RESOURCES: There are no historical resources believed to be located on the subject property. SOILS: According to the "Soil Survey of Seminole County, Florida" (published by the United States Department of Agriculture, Soil Conservation Service, in cooperation with the University of Florida, 1990), there is one (1) predominant soil type within the two properties: Aakka- EauGalhe Fine Sands - Nearly level, poorly drained soils that are sandy throughout or have a loamy subsoil at a depth of about 40 inches or more and areas of Urban land. FLOOD PRONE AREAS: The property is located entirely in Flood Zone "X, " which is outside of the 100 year floodplain, according to the FEMA Flood Insurance Rate Map. HISTORIC RESOURCES: No known historical resources are located on the subject property or within the vicinity of the subject property. (4) Whether the proposed amendment is consistent with the goals, objectives, and policies of the state comprehensive plan set forth in Chapter 187, Florida Statutes, and the East Central Florida Strategic Regional Policy Plan, as amended from time to time; Staff believes that the designation of this property to commercial is consistent Central Florida Strategic Regional Policy Plan which allows for infill development. Staff also feels that proposed amendment is consistent with the goals, objectives, and policies of the state comprehensive plan set forth specifically found in Chapter 187.201 (IS)LAND USE. (b)1. which promotes development and redevelopment activities which Public Hearings 402 PAGE 6 OF 10 - March 27, 2017 encourage efficient development and occur in areas which will have the capacity to service new population and commerce. (5) Whether the city is able to provide adequate service from public facilities to the affected property, if the proposed amendment is granted, and whether the proposed amendment will promote the cost /effective use of or unduly burden public facilities; It is the determination of Staff that the City is able to provide adequate service of public facilities to the subject property based on information stated in Criteria #2. (6) Whether the proposed amendment is compatible with surrounding neighborhoods and land use; The proposed amendment is compatible with the mixed uses located to the north, east, and west. There is commercial development located to the east and west, as well vacant property in the vicinity. Additionally it is a compatible use and common use to have in the proximity of an interchange, such as the SR 434 and SR 417. The Commercial land use has a lower FAR then the GID and therefore, could potentially be a less intensive use which would favor the compatibility to residential uses southeast of the subject site. Properties located to the north are vacant. (7)Whether approval of the proposed amendment will cause the comprehensive plan to be internally inconsistent; Based on the Policies noted below, Staff feels that the proposed amendment will not cause the comprehensive plan to be internally inconsistent. Per the Comprehensive Plan, the Commercial future land use category permits up to a maximum 0. S floor area ratio (FAR). This commercial category is used by a variety of commercial operations which serve the commercial needs of the community. This district is intended for lands adjacent to or easily serviced by collector and major arterial roads adaptable to higher traffic generating commercial uses. Policy 1.3.4 - requires the City to support proposed future land use map amendments with data and analysis demonstrating that adequate water supplies and associated public facilities will be available to meet the projected growth demands. Policy 1.6 4 - Encourages land uses that generate high traffic counts to locate adjacent to arterial roads and mass transit systems. (8)Whether the proposed amendment will promote or adversely affect the public health, safety, welfare, economic order, or aesthetics of the city or region; The proposed comprehensive amendment is not in conflict with state law and satisfies the provisions of the City Code, particularly the criteria set forth in Chapter IS, City Code. (9) The contents of any Evaluation and Appraisal Report (EAR) prepared pursuant to 163.3191, Florida Statutes; At this time the City is currently in the process of completing the Evaluation and Appraisal Report (EAR). Staff does not anticipate any conflicts. (10) Whether the proposed amendment is consistent and in compliance with law; Yes, the proposed amendment is consistent and in compliance with the state law. (11) Whether the proposed amendment is consistent, and not in conflict, with the Public Hearings 402 PAGE 7 OF 10 - March 27, 2017 legislative policy directives established by the city commission including, but not limited to, those set forth in the city's comprehensive plan and city code, adopted master plans, economic development goals and objectives, community redevelopment plans, and brownfield areas. Staff believes the proposed amendment is consistent with policy directives established by the City Commission. Being that the proposed amendment is changing the land use to commercial, this will generate City taxes, which will work towards diversifying the City's tax base. REZONING ANALYSIS SECTION 20 -31(D) The following summarizes the data and issues which Staff analyzed in reviewing this application as required by the Code of Ordinances, Section 20 -31: (1) The proposed rezoning change is in compliance with all procedural requirements established by City Code and law. The proposed administrative rezoning is in compliance with all procedural requirements established by the City Code and law. Requirements for advertising the land use action have been met. (2) The proposed rezoning change is consistent with the City's Comprehensive Plan including, but not limited to, the Future Land Use Map and the proposed change would not have an adverse effect on the Comprehensive Plan. The proposed administrative rezoning change is consistent with the City's Comprehensive Plan amendment as detailed in Ordinance 2017 -06 and the proposed change will not have an adverse effect on the proposed Comprehensive Plan Amendment. (3) The proposed rezoning change is consistent with any master plan applicable to the property. The subject property is presently undeveloped adjacent to State Road 417 while there is an existing 1, 538 square foot house located on the Rodriquez parcel that was built in 1968. However, both parcels are proposed for future commercial /office development. (4) The proposed rezoning is not contrary to the land use pattern established by the City's Comprehensive Plan. The proposed rezoning from City of Winter Springs "Greenaway Interchange District (GID) " to Winter Springs "General Commercial (C -2) " is appropriate and compatible with the land use pattern established by the City's Comprehensive Plan. Surrounding properties to the north have both the City of Winter Springs Future Land Use and Zoning "Greenaway Interchange District" designation and are simultaneously being administratively rezoned to "General Commercial" as defined within agenda items 402 and 403 respectfully. In addition, surrounding residential properties to the south are within Seminole County. The vacant property, east of the subject property is presently within the City of Oviedo. (5) The proposed rezoning change would not create a spot zone prohibited by law. The adjoining properties are being rezoned for both commercial development. The proposed zoning designation is compatible with the surrounding area. (6) The proposed rezoning change would not materially alter the population density pattern in a manner that would overtax the load on public facilities and services such as schools, utilities, streets, and other municipal services and infrastructure. The proposed administrative rezoning does not alter the existing developed population density pattern and therefore will not overtax the load on public facilities and services (utilities, streets, and other municipal services and infrastructure). Public Hearings 402 PAGE 8 OF 10 - March 27, 2017 (7) The proposed rezoning would not result in existing zoning district boundaries that are illogically drawn in relation to existing conditions on the property and the surrounding area and the land use pattern established by the City's Comprehensive Plan. The proposed administrative rezoning does not result in existing zoning district boundaries that are illogically drawn due to the proximity of the SR 434 and SR 417 corridors, and because, the boundaries are following property lines and ar in relation to the existing conditions on the property and the surrounding area and the land use pattern established by the City's Comprehensive Plan. (8) Changed or changing conditions make the proposed rezoning necessary. The proposed zoning designation of "General Commercial (C -2) " is compatible with the proposed "Commercial" Future Land Use Map classification that is proposed via Ordinance 2017 -06 (9) The proposed rezoning change will not seriously reduce light or air to adjacent areas. The proposed administrative rezoning will not seriously reduce light or air to adjacent areas. (10) Should the city be presented with competent substantial evidence indicating that property values will be adversely affected by the proposed rezoning, the applicant must demonstrate that the proposed rezoning change will not adversely affect property values in the surrounding area. The proposed zoning designation has been determined by evaluating the prevailing character of the area around the subject property. (11) The proposed rezoning will not be a substantial detriment to the future improvement or development of vacant adjacent property. The intent in the zoning of the property is to apply a zoning classification for the subject property that is consistent and compatible with the surrounding land uses. (12) The proposed rezoning will not constitute a grant of special privilege to an individual owner as contrasted with the public welfare. The proposed administrative rezoning does not constitute a grant of special privilege to an individual owner as contrasted with the public welfare. (13) The proposed rezoning change is not out of scale or incompatible with the needs of the neighborhood or the City. The proposed administrative rezoning change is compatible with the surrounding neighborhood and meets the needs of the City by encouraging economic growth. Commercial properties are located to the east and west. Additionally it is a compatible use and common use to have in the proximity of an interchange, such as the SR 434 and SR 417. The Commercial land use has a lower FAR then the GID and therefore, could potentially be a less intensive use which would favor the compatibility to residential uses east of the subject site. Properties located north are vacant. (14) The proposed rezoning does not violate any applicable land use regulation adopted by the City. The proposed rezoning does not violate any applicable land use regulations adopted by the City. Letters/Phone Calls In Favor Or Opposition To date, the City has not received any letters or phone calls in opposition to this proposal. Staff has received a phone call from an agent with the property owner of parcel 1 and the owner from parcel 2 in favor of this proposal. Public Hearings 402 PAGE 9 OF 10 - March 27, 2017 FISCAL IMPACT: The proposed Small -Scale future land use amendment, which re- designates the property from City of Winter Springs "Greeneway Interchange District (GID)" with a "Conservation Overlay" to Winter Springs "Commercial" with a "Conservation Overlay," will increase the potential for additional taxable value to the City. The administrative Small Scale Plan Amendment is expected to increase the probability of future commercial and /or office development activity within this particular area. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at six (6) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. Property owners have been notified by US mail, and a sign noting the date and time of the public hearing has been erected on the property. The proposed Ordinances were advertised in the Orlando Sentinel on Thursday, January 26, 2017. This Ordinance is adopted in compliance with, and pursuant to, the Community Planning Act, formerly known as the Local Government Comprehensive Planning and Land Development Regulations Act. Section 3. Purpose and Intent. It is hereby declared to be the purpose and intent of this Ordinance to clarify, expand, correct, update, modify and otherwise further the provisions of the City of Winter Springs Comprehensive Plan. Section 4. Adoption of Amendment to the Future Land Use Map. The City of Winter Springs Comprehensive Plan, Future Land Use Map, is hereby amended by changing the designation of the real property legally described and depicted on Exhibit "A" from "Greeneway Interchange District" Future Land Use to "General Commercial" Future Land Use. Section 7. Incorporation into Comprehensive Plan. Upon the effective date of the Comprehensive Plan Amendment adopted by this Ordinance, said Amendment shall be incorporated into the City of Winter Springs Comprehensive Plan and any section or paragraph number or letter and any heading may be changed or modified as necessary to effectuate the foregoing. Section 8. Effective Date and Legal Status of the Plan Amendment. The effective date of this Ordinance shall take effect thirty -one (3 1) days after adoption, in accordance with Section 163.3187(5)(c), Florida Statutes, unless challenged within thirty (30) days after adoption of this Ordinance, in which case this Ordinance shall become effective at such time as the state land planning agency or the Administrative Commission issues a final order determining that the adopted small scale development amendment is in compliance. Ms. Amanda Webb, Planner, Community Development Department gave an overview of the Agenda Items and related properties. Discussion followed on the number of developable wetlands, buildable acreage, what could be built, going through the process of changing the Zoning from GreeneWay Interchange District (GID) to Commercial, that a storage facility could not be built on these lots, how Commissioner Cannon would like to see restaurants built in this part of the City, if a church was built on these properties, there was concern that no taxes would be generated and there might be possible traffic issues, traffic generation, and could the Land Use changes be done later when requested by an actual Applicant. Discussion. Attorney Garganese mentioned some legislative history pertinent to these properties and the GreeneWay Interchange District (GID) designation. Further remarks followed. Deputy Mayor Carroll suggested that if this initiative were to be approved, that it be marketed with targeted economic development efforts.
