SYNOPSIS: RaceTrac Petroleum, Inc. is requesting approval of the Final Engineering Plans and Aesthetic Review for a RaceTrac convenience store and gas station. The subject property is 2.39 acres in size and is located on the southeast corner of the intersection of US 17 -92 and SR 419. The Final Engineering Plans propose the construction of a 5,411 square foot convenience store and gas station with twenty (20) fuel pumps under a canopy. CONSIDERATIONS: FUTURE LAND USE AND ZONING DESIGNATION FLU: Commercial Zoning: C -2 (General Commercial) APPLICABLE LAW &, PUBLIC POLICY Home Rule Powers Florida Statutes City of Winter Springs Comprehensive Plan City of Winter Springs Code of Ordinances, Chapter 20, Article III, Division 8 C City of Winter Springs Code of Ordinances, Chapter 9, Article XII. Minimum Community Appearance and Aesthetic Review Standards. Public Hearings 400 PAGE 1 OF 5 - March 13, 2017 CHRONOLOGY • March 11, 2013 — City Commission approval of Annexation, Annexation Agreement, Small -Scale Future Land Use Map Amendment, and Rezoning • May 5, 2013 — City Commission approved the Final Engineering Plans and Aesthetic Review • May 5, 2015 — Final Engineering Plans expired Final Engineering Plans On May 5, 2013, the City Commission approved the Final Engineering Plans and Aesthetic Review for the RaceTrac convenience store and associated gas station. Due to the widening of US 17 -92, RaceTrac decided to place the project on hold until the roadway widening project was closer to completion. The previous approvals of the Final Engineering and Aesthetic Review have since expired. The applicant has re- submitted the Final Engineering Plans and Aesthetic Review. The Final Engineering Plans are consistent with the previously approved plans, consisting of the construction of a 5,411 square foot convenience store and gas station with approximately twenty (20) fuel pumps under a canopy. The convenience store is slightly smaller than the store shown on the previously approved plans. Currently, the northern portion of the site is an abandoned Hess gasoline station. The Final Engineering Plans propose the demolition of the existing Hess station, including removal of all existing above ground and underground improvements. In addition to the demolition of the Hess station, several single -story structures and existing signs are proposed for demolition on the southern portion of the site. On March 11, 2013, the City Commission approved an Annexation Agreement for the proposed development. Per the agreement, the existing billboard on the southern portion of the site will remain in its current location, but will be raised to a higher height to permit it to be visible over the fuel -pump canopy that is proposed adjacent to US 17 -92. A total of 37 parking spaces are proposed onsite to accommodate the convenience store portion of the development. A stormwater retention pond is proposed at the northeastern corner of the site, adjacent to the US 17 -92 /SR 419 intersection. The widening of US 17- 92 in this area from four to six lanes is currently under construction by FDOT. A sidewalk will be provided along the US 17 -92 frontage in conjunction with the road widening. Per the City's Code of Ordinances, a sidewalk is required along the SR 419 frontage. FDOT requested this sidewalk end on the south side of the SR 419 access point as this is a "logical terminus" point for the sidewalk. Vehicular access to the site will be via two access points, with one on US 17 -92 and the other on SR 419. Water and sewer service is provided by Seminole County. Aesthetic Review The attached Aesthetic Review package meets all of the submittal requirements for aesthetic reviews as set forth in Section 9 -600 through 9 -607 and includes the following: (a) a site plan; (b) elevations illustrating all sides of structures facing public streets or spaces; (c) illustrations of all walls, fences, and other accessory structures and the indication of height and their associated materials; (d) elevation of proposed exterior permanent signs or other constructed elements other than habitable space, if any; (e) illustrations of materials, texture, and colors to be used on all buildings, accessory structures, exterior signs; and (f) Public Hearings 400 PAGE 2 OF 5 - March 13, 2017 other architectural and engineering data as may be required. The procedures for review and approval are set forth in Section 9 -603. The City Commission may approve, approve with conditions, or disapprove the application only after consideration of whether the following criteria have been satisfied: (1) The plans and specifications of the proposed project indicate that the setting, landscaping, proportions, materials, colors, textures, scale, unity, balance, rhythm, contrast, and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. The project is located on the southeast corner of the intersection of US 17 -92 and SR 419 on the site of a former Hess gas station. The proposed building includes architectural design elements such as stone veneer, awnings, wood slats, stucco, and roof elements with metal shingles. A water table is provided around the perimeter of the proposed building to help break up blank expanses on the fagade. The applicant worked with Staff in providing distinctive design details such as faux windows with awnings on the portions of the building fronting SR 419, and a slight "pop -out" of the front facade of the building at the entry doors to allow architectural variation which adds to the quality of the proposed building. Staff feels that this project incorporates numerous quality design elements that are promoted citywide. Additionally, the architecture is consistent with what was previously approved by City Commission in 2013. (2) The plans for the proposed project are in harmony with any future development which has been formally approved by the City within the surrounding area. The design of the proposed building is an upgrade to the surrounding area and exhibits architecture that exceeds a typical gas station and convenience store. (3) The plans for the proposed project are not excessively similar or dissimilar to any other building, structure or sign which is either fully constructed, permitted but not fully constructed, or included on the same permit application, and facing upon the same or intersecting street within five hundred (500) feet of the proposed site, with respect to one or more of the following features of exterior design and appearance: A. Front or side elevations, B. Size and arrangement of elevation facing the street, including reverse arrangement, C. Other significant features of design such as, but not limited to: materials, roof line, hardscape improvements, and height or design elements. The proposed building is elegantly designed and is a significant upgrade to the site, and to the surrounding area. This project represents a positive addition to the City of Winter Springs. Significant design features include a stone veneer, awnings, fiber cement siding, stucco, an water table. (4) The plans for the proposed project are in harmony with, or significantly enhance, the established character of other buildings, structures or signs in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community. The proposed project enhances the character and overall aesthetics of the surrounding Public Hearings 400 PAGE 3 OF 5 - March 13, 2017 area. The local community is comprised of different architectural styles and, therefore, the proposed project represents a positive addition to this area. (5) The proposed project is consistent and compatible with the intent and purpose of this Article, the Comprehensive Plan for Winter Springs, design criteria adopted by the city (e.g. Town Center guidelines, SR 434 design specifications) and other applicable federal state or local laws. The proposed project is consistent and compatible with the Comprehensive Plan and the Annexation Agreement which was approved by the City Commission on March 11, 2013. The final architectural plans will be reviewed for compliance with all building code criteria. (6) The proposed project has incorporated significant architectural enhancements such as concrete masonry units with stucco, marble, termite - resistant wood, wrought iron, brick, columns and piers, porches, arches, fountains, planting areas, display windows, and other distinctive design detailing and promoting the character of the community. The project has incorporated a number of features such as a stone veneer, awnings, fiber cement siding, stucco, water table, and new site landscaping. The applicant worked with Staff in providing distinctive design details such as faux windows with awnings on the portions of the building fronting SR 419, and a slight "pop -out" of the front facade of the building at the entry doors to allow architectural variation which adds to the quality of the proposed building. FINDINGS: 1. The proposed elevations are consistent with the Aesthetic Review requirements prescribed in the City Code of Ordinances. 2. The elevations include detailing and attention adding to their appearance and the quality of the development. 3. The proposed development utilizes colors and materials that complement the adjacent developments in the surrounding area. 4. The proposed development is located within the City of Winter Springs: it has a Commercial Future Land Use designation and is located within the C -2 (General Commercial) zoning district. FISCAL IMPACT: The redevelopment of the subject property into the RaceTrac gas station is anticipated to increase commercial tax revenue for the City.
