Orange Avenue, Suite 2000 Orlando, Fl 32802 (407) 425-9566 CITY OF WINTER SPRINGS FIRST MODIFICATION OF (PUD ZONING ORDINANCE NO. 2015-08) THIS FIRST MODIFICATION OF First Modification) is made and entered into this ____day of January, 2017, by and WS Property Holdings, LLC between City of Winter Springs , a municipal corporation existing under the laws of the State of RECITALS: A.OWNER and CITY previously entered into that certain PUD Developers Agreement, dated January 25, 2016, which was adopted pursuant to City Ordinance No. 2015-08. Said Ordinance and Developers Agreement are recorded in Official Record Book 827, Pages 950-980, of the Public Records of Seminole County, Florida. B.In accordance with Section 2(i)(i) of the Developers Agreement, Owner is required to construct two right-turn lanes providing access into the Project from SR 434 during the first phase of the Project. C.OWNER and CITY desire to make a technical revision to the construction time schedule of one of the two right-turn lanes pursuant to the terms and conditions of this First Modification NOW THEREFORE , in consideration of the terms and conditions set forth in this First Modification, the CITY and OWNER agree as follows: 1.INCORPORATION OF RECITALS. The foregoing recitals are true and correct and are fully incorporated herein by reference as a material part of this Agreement. 1 2.AMENDMENT TO CONSTRUCTION SCHEDULE FOR RIGHT-TURN LANE. Section 2(i)(i) of the Agreement is hereby amended to provide that the right-turn lane, depicted on the Master Plan and providing access into the public street along the eastern boundary of the Project from SR 434, shall be constructed and completed in conjunction with the second phase of the Project. 3. OTHER TERMS. All other terms and conditions in the Developers Agreement not modified by this First Modification shall remain in full force and effect.
