HomeMy WebLinkAbout2016 09 12 Public Hearing 400 Resolution 2016-15 Tentative Millage RateCOMMISSION AGENDA ITEM 400 September 12, 2016 Regular Meeting REQUEST: Informational Consent Public Hearings X Regular KS City Manager m Department The City Manager is requesting that the City Commission hold a Public Hearing relative to the approval of Resolution No. 2016 -15, which establishes the Tentative Operating Millage Rate for Fiscal Year 2017 for the City of Winter Springs at 2.4300 mills which is 4.20% more than the rolled -back rate of 2.3320 mills and the Tentative Voted Debt Service Millage Rate for Fiscal Year 2017 for the City of Winter Springs at 0.0700 mills. SYNOPSIS: The purpose of this agenda item is to have the Commission approve Resolution No. 2016- 15, otherwise known as the Tentative Millage Rates for Fiscal Year 2017 and related advertising. CONSIDERATIONS: • The operating millage for the current fiscal year 2016 is 2.4300 mills. The voted debt service millage for the current fiscal year 2016 is 0.1100 mills. • The fiscal year 2017 Proposed Budget incorporated an operating millage rate of 2.4300 mills and a voted debt service rate of 0.1100 mills. • On July 25, 2016, the Commission established the 2017 proposed operating millage rate (millage cap) at 2.4300 mills and the proposed voted debt service millage rate at 0.1100 mills. • The proposed operating millage rate of 2.4300 mills as submitted on the DR -420 is 4.20% more than the rolled -back rate of 2.3320 mills. Resolution No. 2016 -15 will establish the Fiscal Year 2017 tentative millage rates. It is recommended that the tentative operating millage rate not vary from the proposed operating millage rate of 2.4300 mills and that the voted debt millage rate be decreased 36% to 0.0700 mills. Public Hearings 400 PAGE 1 OF 3 - September 12, 2016 Any subsequent revisions by the City Commission to the tentative millage rates and /or the tentative budget will be reflected in the Final Millage and Final Budget Hearings scheduled for September 26, 2016 at 5:15 p.m. However, the tentative operating millage rate that is established tonight cannot be exceeded at the final hearing. As such, it is recommended that the Commission set the tentative operating millage rate equivalent to the proposed operating millage cap of 2.4300 mills. The Commission may reduce the operating millage rate at the final hearing. FISCAL IMPACT: The decision to levy an operating millage rate of 2.4300 mills as opposed to the rolled -back rate of 2.3320 mills will result in additional ad valorem General Fund revenue of approximately $185,000 (net of statutory discount). COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at six (6) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. In August, each property owner was notified of this public hearing via the TRIM (Truth in Millage) notice as distributed by the Seminole County Property Appraiser. Upon approval and adoption of Resolution No. 2016 -15, the appropriate advertising will run in the Orlando Sentinel on September 22, 2016 which will reflect the tentative millage rates for Fiscal Year 2017 and announce the final Public Hearing for September 26, 2016 at 5:15 p.m. RECOMMENDATION: It is recommended that the Commission adopt Resolution No. 2016 -15 establishing the tentative operating millage rate at 2.4300 mills and tentative voted debt service millage rate at 0.0700 mills for Fiscal Year 2017 and authorize the City to advertise in a newspaper of general circulation the City's intent to hold public hearings to adopt final millage rates and final budget in compliance with Florida Statute 200.065. Sample Motion: I move to approve Resolution 2016 -IS establishing the tentative Fiscal Year 2017 operating millage rate for the City of Winter Springs at 2.4300 mills and the voted debt service millage rate at 0.0700 mills and authorize advertisement of the City's intent to hold public hearings to adopt the final millage rates and budget. The operating millage rate of 2.4300 mills is 4.20% greater than the rolled -back rate of 2.3320 mills. Public Hearings 400 PAGE 2 OF 3 - September 12, 2016 ATTACHMENTS: Resolution No. 2016 -15 Public Hearings 400 PAGE 3 OF 3 - September 12, 2016 RESOLUTION NO. 2016 -15 A RESOLUTION OF THE CITY COMMISSION OF WINTER SPRINGS, FLORIDA, ADOPTING THE TENTATIVE OPERATING MILLAGE RATE FOR THE CITY OF WINTER SPRINGS FOR THE FISCAL YEAR COMMENCING ON OCTOBER 1, 2016 AND ENDING ON SEPTEMBER 30, 2017; ANNOUNCING THE PERCENTAGE BY WHICH THE TENTATIVE OPERATING MILLAGE RATE IS MORE THAN THE ROLLED -BACK RATE; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs has held a public hearing on the tentative millage rates pursuant to Florida Statute 200.065, Subparagraph (c); WHEREAS, the City Commission of Winter Springs desires to adopt the tentative operating millage rate and publicly announce the percentage change by which the tentative proposed operating millage rate is more than the rolled -back rate, and adopt the tentative voted debt service rate; and WHEREAS, the City Commission of the City of Winter Springs deems that this Resolution is in the best interest of the public health, safety, and welfare of the citizens of Winter Springs. WHEREAS, the gross taxable value for operating purposes not exempt from taxation within Winter Springs has been certified by the Seminole County Property Appraiser to the City of Winter Springs as $1,966,345,152. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated by this reference. Section 2. The City Commission adopts its tentative operating millage rate of 2.4300 mills and its tentative voted debt service millage rate of 0.0700 mills for the fiscal year commencing October 1, 2016 and ending September 30, 2017. Section 3. The tentative operating millage rate of 2.4300 mills is more than the computed rolled -back rate of 2.3320 by 4.20 %. Section 4. Within fifteen (15) days of the date of this Resolution, the Finance and Administrative Services Department shall advertise in a newspaper of general circulation its City of Winter Springs, Florida Resolution 2016 -15 Page 1 of 2 intent to finally adopt the millage rates and budget and shall hold a public hearing to adopt the millage rates and finalize the budget not less than two (2) days or more than five (5) days after the date the advertisement is first published. Section 5. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 6. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 7. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
