SYNOPSIS: One of the responsibilities of the City Clerk is to provide the Mayor and City Commission with a submittal of all Meeting Minutes, as soon after a City Commission meeting as possible; so, that it is a reminder to the Mayor and City Commission, as to what transpired at their most recent meeting, and also provides a record of the actions and directives of the City Commission, for the future, and which becomes the official record. If the City Commission is in agreement with what the City Clerk provides in these Minutes, then the City Commission would be asked to Approve the Minutes, as submitted. Should the Mayor and /or City Commission feel something is not appropriately documented in these Minutes, then a Motion would be appropriate to have the Minutes changed to reflect what the majority of the City Commission would prefer. CONSIDERATIONS: This Agenda Item includes the Unapproved Minutes from the Monday, January 25, 2016 City Commission Regular Meeting. Even though these Minutes are being submitted by the City Clerk, (with proofing by Office of the City Clerk Staff), no other party has required that changes be made to the Minutes before being submitted. These Minutes are being submitted by the City Clerk for the Approval by the City Commission. INFORMATIONAL INFORMATIONAL 200. Utility Department REQUEST: The Utility Department wishes to inform the City Commission of the potable and reclaimed water use for 2015. FISCAL IMPACT: Potable and reclaimed water rates were increased by the CPI index of 0.1% in 2015. This Agenda Item was not discussed. PUBLIC INPUT Mayor Lacey opened "Public Input". Ms. Phyllis Kent, 869 Leopard Trail, Winter Springs, Florida: mentioned that on her Facebook page, many people had written comments noting their preference that the Holiday Parade be moved to the west side of town, as many residents thought the Holiday Parade had been special to the west side of the City. Mayor Lacey closed "Public Input ". CONSENT CONSENT 300. Utility/Public Works Departments REQUEST: The Public Works Department is requesting authorization to decrease the reimbursement rate from $13.72 to $13.34 per light for communities with decorative streetlights. The Tuscawilla Lighting and Beautification District (TLBD) will have a reimbursement rate of $13.18 per light, pursuant to a revised rate schedule from Duke Energy, effective January 1st, 2016. FISCAL IMPACT: As a result of the January 2016 Duke Energy rate decrease, the City will pay approximately $6,998.64 less for streetlight reimbursement for 2016 as compared to 2015. The reduction will save the City an additional $8,975.40 for all public streetlights, if no additional changes are made to the rate structure. Community Development Department - Planning Division REQUEST: The Community Development Department — Planning Division requests that the City Commission hold a Public Hearing for the second reading and adoption of Ordinance 2015 -14 which proposes to remove Policy 1.1.10 from the Housing Element of the City's Comprehensive Plan related to multi - family housing R0 in commercially zoned areas of the City. FISCAL IMPACT: g! The proposed Comprehensive Plan amendment is not expected to pose any negative fiscal impacts. To the contrary, staff feels that this revision will assist in diversifying the City's tax base. The removal of multi- family residential development from the list of Conditional Uses in the City's commercial zoning districts is anticipated to preserve these areas for commercial development, which generates higher ad valorem taxes and furthers the City's goal of diversifying the tax base, which is predominately residential. Community Development Department - Planning Division REQUEST: The Community Development Department — Planning Division requests the City Commission consider second and final reading of Ordinance 2015 -15, which proposes to amend the list of permitted, conditional and prohibited uses in the C -1 (Neighborhood Commercial), C -2 (General Commercial), and C -3 (Highway 17 -92 Commercial) zoning districts by removing multi -family residential uses as a Conditional Use in these zoning districts. FISCAL IMPACT: There is no indirect fiscal impact associated with this agenda item. However, the removal of multi -family residential development from the list Conditional Uses in the City's commercial zoning districts is anticipated to preserve these areas for commercial development, which generates higher ad valorem taxes when said properties are developed and furthers the City's goal of diversifying the tax base. Multi - family Residential Uses however that were lawfully approved and Permitted prior to the adoption of this Ordinance would be considered a lawful and Conforming Use subject to applicable conditions and requirements imposed by the City when previously permitted." Commissioner Kevin Cannon asked Attorney Garganese about the Transects. Mr. Bobby Howell, AICP, Senior Planner, Community Development Department addressed Commissioner Cannon's inquiry and stated for the Record, "In furtherance of the items discussed at the City Commission Workshop held on March 30th, 2015, Staff will be presenting an Ordinance to the Planning and Zoning Board/Local Planning Agency in the immediate future. The purpose of this Ordinance is to provide the Use matrix in the Town Center section of the City's Code of Ordinances to remove multi - family development from the list of Permitted and Special Exceptions in the T3 (Suburban Zone) of the Town Center Code. In addition, the Ordinance will make multi - family development a Special Exception Use in the T4 (General Urban Zone) and the T5 (Urban Center Zone) of the Town Center Code. Additional changes to the Use matrix may also be part of that proposed Ordinance." Mayor Lacey opened the "Public Input " portion of the Agenda Item. No one spoke. Community Development Department - Planning Division REQUEST: The Community Development Department — Planning Division requests City Commission consider second reading and adoption of: 1) Ordinance 2015 -08, which proposes the rezoning of a 39.81 acre property from GID (Greeneway Interchange District) to PUD (Planned Unit Development), 2) Development Agreement, and 3) Master Plan for the 39.81 acre property located on the north side of SR 434, across from the Creeks Run subdivision. FISCAL IMPACT: Development of the property will provide an increase in taxable value to the City. A fiscal analysis report is attached. The applicant held public information meetings on May 19, 2015 and November 17, 2015 with members of the public. This item was advertised in the Orlando Sentinel on November 22, 2015, December 31, 2015, and January 14, 2016. Additionally, a large yellow sign was posted on the property noting the date and time of the meeting. RECOMMENDATION: At the December 2, 2015 Planning & Zoning Board meeting, the Planning & Zoning Board unanimously recommended denial of Ordinance 2015 -08, the Development Agreement, and Master Plan for the subject property. Please see attached minutes from the Planning & Zoning Board meeting for details regarding this vote. Staff recommends approval of second reading and adoption of: 1) Ordinance 2015 -08, which proposes the rezoning of a 39.81 acre property from GID (Greeneway Interchange District) to PUD (Planned Unit Development), 2) Development Agreement, and 3) Master Plan for the 39.81 acre property located on the north side of SR 434, north of the Creeks Run subdivision as the request is in compliance with all applicable policies of the Comprehensive Plan, and Chapter 20, Article IV - Planned Unit Development chapter of the City Code of Ordinances. Attorney Garganese read Ordinance 2015 -08 by "Title" only and mentioned "One (1) minor modification to this document with respect to the Developer's Agreement. Based on the previous Public Hearing on this matter, some language changed with the Developer who will be constructing the public streets north/southbound on the property in Phase 1, along the eastern boundary and then the main entrance to the roundabout. Those roads would be constructed as part of Phase 1; and that's consistent with what was decided at the last Hearing. So, this is a continuation of the Hearing regarding this Rezoning matter." Mayor Lacey then said to Mr. Howell, "I assume since the Staff is recommending approval of this, that you have specifically looked at the five (5) criteria for a Zoning change and that Staff's Recommendation or conclusion is that the Applicant has satisfied those five (5) criteria ?" Mr. Howell responded, "That is correct." Discussion followed on criteria and obligations of the City Commission. Mayor Lacey opened the "Public Input "portion of the Agenda Item. Ms. Jennifer Cardenas, 1031 Winding Waters Circle, Winter Springs, Florida: asked if there was a chance that the City Commission could postpone the action on this matter to see if the Developer could offer a lower density in consideration of other approved apartments. Mayor Lacey closed the "Public Input" portion of the Agenda Item. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING — JANUARY 25, 2016 PAGE 10 OF 22 Mayor Lacey said to Ms. Tara L. Tedrow (Esquire, Lowndes Drosdick Doster Kantor & Reed, P.A., 215 North Eola Drive, Orlando, Florida), "Did you have anything that the Applicant wanted to say at this point ?" No response. Commissioner Pam Carroll mentioned for the Record that the Zoning does not match the Land Use, property rights, and noted her concern with infrastructure and entitlements in relation to schools. Discussion ensued on school capacity criteria, contacting Officials with Seminole County Public Schools, the Interlocal Agreement, criteria related to this Agenda Item, school requirement data, property rights, and legal and judicial matters. Commissioner Cannon commented further about criteria in the Agenda Item, existing infrastructure, and noted for the Record, his concern with thirty -four (34) children possibly being bused out of Winter Springs to other schools. Tape 1 /Side B Discussion continued. Further remarks ensued on school capacity, the Ordinance and this Agenda Item, concern with not busing elementary school children out of the City, some of the key merits of Winter Springs, property values, the respective Interlocal Agreement, and how the Seminole County Public Schools School Board will handle children from the new apartment complexes under consideration. Commissioner Carroll commented on the Record that schools have to accommodate the children from any new apartment projects, the local schools, school capacity changes, the need for rooftops, and that she wanted to see a detailed market analysis. "MOTION TO APPROVE ORDINANCE 2015 -08." MOTION BY COMMISSIONER KREBS. SECONDED BY COMMISSIONER RESNICK. DISCUSSION. MAYOR LACEY NOTED THE MOTION WAS "TO APPROVE THE SECOND READING OF ORDINANCE 2015 -08, WHICH WOULD INCLUDE THE DEVELOPMENT AGREEMENT AND THE MASTER PLAN THAT GO WITH ITEM `402'." CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - JANUARY 25, 2016 PAGE 13 OF 22 Mayor Lacey opened the "Public Input" portion of the Agenda Item. Ms. Sandra Cox, 1200 George Street, Winter Springs, Florida: spoke of living in their current home for many years, commented on many trees being cut down and hearing gunshots near their property as well as other very loud noises. Mr. Kevin Lathrop, 1230 George Street, Winter Springs, Florida: commented on the warehouses near his property, issues with a lot of traffic in this area, people who don't live in the area adding to the traffic on their roads, and that he was strongly against this proposed project. Ms. Judy Bohnstadt, 1170 Talmo Street, Winter Springs, Florida: mentioned she lived next to the warehouses, referenced some photographs of water related problems, noted excessive traffic and speeding, and that she was also against the proposed project. Mr. Damien Madsen, 1570 Bryan Avenue, Winter Park, Florida: thought that this proposed warehouse project with a nice buffer against the residential area would enhance property values and eliminate possible crime.' Brief comments. Mr. Fernando Alejandre, Jr., 1171 Ridge Street, Winter Springs, Florida: spoke of many vehicles parked near the warehouses which impedes traffic near the homes, that traffic issues would increase with additional warehouses, that the open space is nice for residents to use, and concerns with potential crime. Mr. Andrew Chipchak, 1221 George Street, Winter Springs, Florida: noted the previous park project, that he did not want to have drive by more warehouses, that the projects seem to take a long time to build, problems with flooding, and that he was against the proposed project. Ms. Crystal Richard, 1220 George Street, Winter Springs, Florida: said she lives behind the proposed project, mentioned problems with flooding due to the grading and recent hard rains, bones are being thrown across to her property from the workers, that she has smelled drugs, and her concerns with where trucks are parked. Mayor Lacey closed the "Public Input" portion of the Agenda Item. Mr. Brian Reece, 721 Virginia Drive, Winter Park, Florida: stated, "Yes, I am the property owner. There are way too many questions, I couldn't write them down fast enough so if you all remember some of them and I can remember them." Continuing, Mr. Reece referenced the previous comment related to hearing gunfire and said, "I think as I'm the property owner I would have been notified by the Police if there was an actual report of gunfire. It could have been firecrackers. I've never heard of gunfire going off out there, it's a very safe park." Further, Mr. Reece noted, "As to the retention pond, it has been a very big challenge. The rains this year duped us pretty good. We aren't finished with it; we've actually had a very big washout. We've already submitted to Brian Fields (P.E., City Engineer, Public Works Department) and the group a new flume to be installed which is going to cost me tens of thousands of dollars to take that dirt back up to the size of the retention pond. The retention pond meets and exceeds everything for the civil engineering for the City of Winter Springs. It's actually a larger pond then what we had before or as large as and should hold plenty of water. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING — JANUARY 25, 2016 PAGE 14 OF 22 The water backing up the street, we were challenged to be able to drain the water from the retention pond, to build the new retention pond, and we just fought ourselves and fought ourselves and fought ourselves with these rains this year. Something that I didn't realize is how bad the drainage is going down Nursery Road and as it turns and goes to the direction that it's supposed to go. Today, Nursery Road is now draining into my pond which I haven't addressed with Brian but I need to get with them and see what the resolution is going to be there. Once again, we only have one (1) 2,000 square foot space. The reason that you may see not a lot of cars in the back building is one (1) tenant that has one (1) or two (2) employees, named C &C Resale has 9,000 square feet and all they do is bring in big large equipment and ship them out. They don't work on them there, the doors are always closed. Next to that is a 6,000 square foot that's occupied by David Ray." With further comments on some of the tenants, Mr. Reece then pointed to some photographs and stated, "There's the park. Okay, what I'd like to point out here is, this what the Nursery Road used to look like before we bought the property and redeveloped it. At the top of the screen as you can see, we had all the mechanics in there and they're double parking cars. Cars without engines, cars without wheels, the front of the building was nothing but a metal building. I went in and spent a quarter of a million dollars and put a fagade on the front, with storefronts in it. I asked the tenants to move out who are undesirable and I moved in reputable companies and I've done that in this whole entire park. If you all may remember, Hub Cap Daddy up on (U.S. Highway) 17/92, we moved them out, tore the building down and built a brand new commercial building up on (U.S. Highway) 17/92. So, from my perspective I've increased and enhanced the value of this neighborhood. I can't say much about the body shop next door but that's not my business. I can't control him and I have nothing to do with them." Referring to other photographs, Mr. Reece pointed out, "That's the front building — which we re -did all of that. Next one, that's just the side of the building against Nursery Road, all clean, block wall. Next, go next, that's the corner of the building on Nursery Road - that's the actual building that had all the mechanics in it. They were double parked and it was nothing but an old metal building." Continuing, Mr. Reece remarked, "In regard to the retention pond, once again, like I said we've had a big washout that we're having to redesign, engineer a new flume to come out of the existing - oh another one, the water backing up on the properties behind us will not continue once we put the driveway in, put the curb system in. All that water retention will come into the Stormwater Management and go into the pond. So, what's backing up on our property today is not going to happen once we finish with the construction. That's about all I've got right now. Oh, the other thing, we didn't get annexed in the City of Winter Springs because whatever the reason he said was, it was because we didn't want the town, that top building, the front building was Hub Cap Daddy, the top building and beyond were all run down duplexes. And they were occupied by undesirables, I can tell you that. When we finally moved them out, we put a lift station on the property and on our dime, went four (4) streets down to tap into the City of Winter Springs' wastewater treatment plant." Tape 2 /Side A Commissioner Joanne M. Krebs said to Mr. Reece, "So, I understand that you, and you do too, your property is draining on some of the neighbors..." Mr. Reece noted, "...Well yes, I mean I wasn't aware of it until she told me that today. I thought it was being handled." Commissioner Krebs mentioned, "And the reason I ask is because I mean, that is just unacceptable..." Mr. Reece stated, "...No, I didn't know that until she just brought it up..." Commissioner Krebs remarked, "...Yes, and even though you are going to fix it, to me it is still unacceptable. I do not think anybody should have to do that. I mean, she has got animals, maybe kids, grandchildren, I do not know, playing in the backyard. You never know. So, she has got bones in her backyard too, but that is a whole other issue. I think you should really do something about that and if I were her, I would be looking for some relief." CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - JANUARY 25, 2016 PAGE 15 OF 22 Continuing, Commissioner Krebs asked Mr. Reece to explain about the park property and the related donation. Mr. Reece commented, "My recollection, it was a concession to have the property zoned commercial, to where we could tear the duplexes down and build a nice industrial commercial facility. As far as I know, that's what the City wanted." Commissioner Krebs remarked, "And you are right. And Commissioners, that is a history lesson. That is exactly what I understood, as well, is that that was one of your conditions." Mr. Reece stated, "Right, and of course when it was conveyed back to us and deeded back to us, it was under our understanding that it was still C -2. So, I did not know that we would even have to go through this kind of a process, when all the paperwork came in and it might have been an oversight on my part." Commissioner Krebs commented, "I wanted the Commissioners to understand what had happened and why that property was donated, then it came back because it was never used - really wasn't a place to have a park, supposedly. So, you requested that property back if I am not mistaken..." Mr. Reece interjected, "...Yes..." Commissioner Krebs continued, "...If we were not going to use it. So the Commission at that time decided, yes, that probably should not have happened in the first place." 24 Next, Commissioner Krebs addressed Captain Chris Deisler, Police Department about local jurisdictions handling calls for assistance in the proximity of this property in question and asked, "Do you recall any kind of gun shots or anything like that over there ?" Captain Deisler responded, "I'll start with your second question. The answer is `No, I don't'. I don't personally have any recollection of it. For the first part of your question, the way the Police services are dispatched throughout the entire County, really falls on that Mutual Aid - that agreement that we have. Any calls for immediate assistance, gun shots especially, are turned out and dispatched to the closest unit that the County can find because more than likely, that call is going to be routed through them. If the residents in that area are calling from a landline or a mobile phone, they're going to the County and then the County is going to push out the first unit they can. So, that's how those would be routed. And then to coin a phrase, we'll sort out the details when we get there but to get units there first. Sometimes we are the first ones there, sometimes Longwood is, sometimes the County might be, but I don't have any personal recollection of any shots fired calls there." With further remarks as to whether there had been a lot of calls there over the years, Captain Deisler said he could not recall any, and added, "It was actually very quiet. I can't say that they haven't responded, and I'd be happy to look that up for you folks, but right now I can't speak to any for sure." Commissioner Cannon said to Mr. Reece, "I shared the same concern that Commissioner Krebs did, which was the water coming off of your property. If you graded your property higher than the surrounding property owners, it is foreseeable that runoff can occur. So, I would encourage you as expeditiously as possible to remedy that and I do not think necessarily as you mentioned earlier, waiting until you put in a driveway and curbs is going to be fast enough." Next, Commissioner Cannon stated, "We have not had a Site Plan proposal or anything have we yet on this Randy (Stevenson)? I do have a concern that you have got a warehouse literally that is going to back right up against homes with doors that may or may not face the homes. And I mean it is close; I mean it is right against the property line. I know it is not a final Site Plan, but..." Mr. Reece stated, "...We have a rendering..." Commissioner Cannon added, "What was your idea of how you are going to mitigate the sound and the noise that is kind of inherent in that kind of a warehouse ?" Mr. Reece explained, "Right, there will be only two (2) pedestrian doors on the back of the building and aesthetics, we actually added the eyebrows and the entrances and the roll -up doors are going to be on the east and west side - no doors facing Nursery -just two (2) main doors will be facing north and south." CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - JANUARY 25, 2016 PAGE 16 OF 22 Commissioner Cannon noted, "That would be facing Ridge (Street) and Talmo (Street)..." Mr. Reece responded, "...Yes, and we also once again, I think Amanda (Webb) mentioned it, we will be agreeable to the Developer's Agreement, where we won't be putting any loud businesses in. That's why the gentleman doesn't think that the warehouses are full is because we have leased them to companies that are very low usage. Very quiet, very good upstanding people." Further, Commissioner Cannon said, "Those were my concerns - is the immediate water runoff..." Mr. Reece responded, "Yes, like I said, this is the first I've heard of any water running off. We have all the control= structures in place and all of them going into the pond. So, what little bit of water, might have been - we got a lot of water the other day, you know that was a fluke. But anyways, this is the first I've heard of it, I didn't hear of it over the summer. But right now, it's just the grade actually is the floor elevation is very close to the same core elevation of the existing buildings and between the two (2) buildings, we are going back now to Phase III across the street, not on this project. But the grade is flowing into the structures and goes around the building and into the retention pond. Then it should not be flooding anybody's property..." With additional remarks about drainage coming off of Nursery Road, Commissioner Cannon said, "I would ask you to expedite that as quickly as possible, for the benefit of the neighbors." Mr. Reece replied, "Okay." Commissioner Cade Resnick addressed Mr. Reece and remarked, "As far as one lady said that she had been smelling pot and things like that with the development possibly on that side. Now you and I have met before and we have spoken..." Mr. Reece said, "...Yes we have..." Commissioner Resnick continued, "...So, maybe just check on whoever is doing that as much as possible." Mr. Reece then stated, "I am pretty sure that it's not coming from anybody that's working on my job. We just, I have installed cameras. I've got more cameras being installed. As a matter of fact, Thursday, there's more cameras being installed on the property and I will look into that. I can tell you that when we did the grubbing, the site work, I can tell you that there were more parties going on in those woods. You couldn't believe the stuff that we had to clean up and the people we had to run off." Commissioner Resnick suggested, "My preference in just talking to you, in this open forum is that as you mentioned putting up walls for protection, if we do go through with this, I would rather see stone walls going up so that would protect a lot more..." Mr. Reece responded, "...Yes, we could do split block face. That's what we've done elsewhere up and down Land Street. That would be fine..." Commissioner Resnick noted, "...Make it look more professional as far as that is concerned." Next, addressing Captain Deisler, Commissioner Resnick noted, "As was mentioned, vehicles all over the street. I know we have had that conversation with other properties if you will, as we drive by, do we look at that? Are you driving by ?" Captain Deisler explained, "So, this area is rather unique layout. Most of the roadways along this area do not fall in our jurisdiction. The adjoining businesses and their parking lots do. So when you're talking about the east - west roadway, we don't share any of that pavement. So, if you had a parking issue on the paved portions of that roadway, that would in turn be routed to the County..." Commissioner Resnick clarified, "...On Nursery Road..." Captain Deisler then said, "...Correct. If you had a derelict vehicle situation, or a parking lot situation on one of the buildings parking lots, then that would fall into our jurisdiction. So, it does get a bit dicey, but it's actually kind of interesting. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - JANUARY 25, 2016 PAGE 17 OF 22 I've spoken to one (1) or two (2) of the residents who live along this area, specifically in the area where the ditch runs behind the apartment complex. And I have spoken to a couple of folks out there to try to help them get some relief on that high grass and weeds that were growing in that ditch that's not ours, but a quick phone call to some of the counterparts I have at the County kind of got them pointed in the right direction. Now, whether or not they were able to do anything with it or not is simply out of my hands - I know I have spoken to a couple of people back there, but the roadway is a unique situation because it simply isn't in our jurisdiction." Commissioner Resnick asked, "George (Street) - Talmo (Street)..." Captain Deisler remarked, "...None of them are." Commissioner Resnick added, "And the same for Ridge (Street)." Captain Deisler said, "Correct." Next, Commissioner Resnick inquired about our relationship with Seminole County on these matters and whether Seminole County could be more helpful. Captain Deisler commented, "It certainly is something that we can do. I mean, if you'd like me to reach out to someone who has some degree over the parking in that area, I can certainly do that. I've already spoken to some of my colleagues on the Code Enforcement side who are the operators on the street for that very area. So, I know I've passed on some stuff to them for that area. I'll be happy to reach out to whoever you think is appropriate but just understand that as it relates to our jurisdiction, certainly we have Officers in and out of this area at all times of the day, patrolling at night, even the neighborhoods and businesses and so forth. So, we do get through there and as you know, if you wind your way back through the neighborhood, you can also now get to Seven Oaks, the Kia Dealership, and what not, so that does fall into our area." Comments continued. Commissioner Carroll addressed Mr. Reece and remarked, "I have to echo my counterparts on water concerns but I also know the County stormwater issues in that basic area - I am wondering what are the hours of operation of your current warehouses and what would you propose for these ?" Mr. Reece responded by saying, "I don't have a copy of the Developer's Agreement but know there are working hours and there are restrictions on what kind of business can go in. You can't have anybody in there with pneumatic tools, no body shops, there's a list. There's an actual Developer's Agreement, I can't recite it but I know what not to put in there." Commissioner Carroll inquired as to what are the earliest work hours for deliveries or picking up items. Mr. Reece responded, "I'd just be speculating at this moment, probably, I don't know. Office Of The City Clerk — Andrea Lorenzo - Luaces, MMC City Clerk Andrea Lorenzo - Luaces asked the Mayor and City Commission if there was interest in a 2016 Board and Committee Appreciation Dinner and if so, she could bring an Agenda Item back possibly within the next two (2) meetings. Mayor Lacey said to City Clerk Lorenzo - Luaces, "On your schedule." REPORTS 603. Office of Commissioner Seat Five - The Honorable Joanne M. Krebs Commissioner Krebs offered her congratulations to Mayor Lacey as the new President of the Tri- County League of Cities. Mayor Lacey stated, "Thank you everyone for being there." Next, Commissioner Krebs spoke on the Quasi - Judicial matter discussed earlier during this meeting and also mentioned that the same Quasi - Judicial issue went before the Planning and Zoning Board/Local Planning Agency and based on their Vote against the proposed project, Commissioner Krebs asked if the Planning and Zoning Board/Local Planning Agency understood the ramifications of their Voting against the proposed project. Much discussion between Members of the City Commission, Mayor Lacey, and Attorney Garganese followed on Quasi - Judicial proceedings, whether additional training was needed for both the City Commission and the Planning and Zoning Board/Local Planning Agency on such matters, what Attorney Garganese thought might have happened at a recent Planning and Zoning Board/Local Planning Agency meeting, comments made by Planning and Zoning Board/Local Planning Agency members, as well as other thoughts and opinions. Office of the Mayor - The Honorable Charles Lacey Mayor Lacey Regarding the recent Scottish Highland Games event held in Winter Springs, Mayor Lacey stated, "Chris (Caldwell, Director, Parks and Recreation Department), job well done out there!" Mayor Lacey continued with his Report and mentioned that he was asked to appear before a recent Tourist Development Council meeting and gave a brief overview on how the recent Scottish Highland Games event in Winter Springs went. Lastly, Mayor Lacey thanked Commissioner Krebs for her comments, and everyone who attended the January Tri- County League of Cities meeting, and also thanked City Clerk Lorenzo - Luaces, and Antonia Della Donna, Assistant to the City Clerk, Office of the City Clerk, as well as Attorney Garganese for his contributions. Further, Commissioner Cannon offered thanks to Mr. Lee Stender, Network Administrator, Information Services Department and added, "Lee did a great job of helping. I also appreciate Randy coming out and meeting with me on some of the Land Use matters." REPORTS 607. Office of Commissioner Seat Three - The Honorable Pam Carroll Commissioner Carroll also offered her compliments on the Scottish Highland Games event held in Winter Springs. Continuing, Commissioner Carroll referenced Mayor Lacey being installed as the incoming Tri- County League of Cities President, and noted that additionally, Mayor Lacey gave a very professional presentation at the recent Oviedo - Winter Springs Regional Chamber of Commerce's "State of the Cities" luncheon meeting. Further, Commissioner Carroll offered her appreciation to Attorney Garganese on his presentation speech at the January Tri- County League of Cities meeting and noted, "Excellent information on Home Rule." Lastly, Commissioner Carroll mentioned an issue related to a malfunction with.a flag being flown on Winter Springs Boulevard at Seneca Boulevard and thanked Mr. Kip Lockcuff, P.E., Director, Public Works/Utility Departments as well as Mr. Donald Gilmore who remedied the situation. REPORTS 608. Office of Commissioner Seat Four - The Honorable Cade Resnick Commissioner Resnick offered his thanks to Mr. Caldwell and Captain Deisler's Staff for their assistance with the recent Scottish Highland Games to which Commissioner Resnick said were enjoyed by many. Secondly, in reference to Mayor Lacey being sworn in as the President of the Tri- County League of Cities, Commissioner Resnick said to Mayor Lacey, "Congratulations again." Thirdly, Commissioner Resnick mentioned the comments by Ms. Phyllis Walker Kent from earlier this evening about the Holiday Parade and asked if this matter was going to be brought back to the City Commission? Manager Smith remarked, "Previously the Commission had consensus to bring it back at a future date but there was not a date certain placed on that. So, we intend to bring it back at some date..." Mayor Lacey noted, "...Before a final decision is made..." Manager Smith stated, "...Yes..." Commissioner Carroll added, "...With cost estimates — that was the main reason for this change." Lastly, Commissioner Resnick spoke of a learning curve that not only Elected Officials but other key Staff and residents have to deal with and suggested to the City Manager and the City Commission, "Consider two (2) opportunities a year — where we now have a way to get people to come to City Hall through these Facebook or other social media options and focus on the two (2) areas of concern, finance and property, and how it is going to develop." 9 CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING — JANUARY 25, 2016 PAGE 22 OF 22 Further, Commissioner Resnick thought that in March, "Before Budget season, we could do this, and one time around October where we could — educate everybody as to what is going on, how it is happening, where we are in processes. Some people will still be surprised but I think there will be more people coming in here because of these ways to access people, maybe something to try — and then we also should be going to more classes whenever they become available." Commissioner Resnick added, "That would be my request for the evening, if at all possible." Further comments. Lastly, Commissioner Cannon thanked Mr. Lockcuff and Mr. Fields and /or anyone else for their assistance with the logistics of this evening's meeting. PUBLIC INPUT Mayor Lacey opened "Public Input". Mr. Harold Thompson, 931 Ginnie Way, Winter Springs, Florida: mentioned that this past weekend there were a lot of cars parked on Tuskawilla Road, in Winter Springs Village, and qn Michael Blake Boulevard and thought the cars were probably from people attending the Scottish Highland Games event, and remarked about his concern that some people who live in Winter Springs Village may have had problems with visitors to their homes in Winter Springs Village as there were so many cars parked in the areas noted.
