HomeMy WebLinkAbout2015 12 14 Public Hearing 503 WTP1 Facilities Plan and SRF Funding , Resolutions 2015-30 and 2015-31COMMISSION AGENDA ITEM 503 Informational Consent Public Hearings X Regular December 14, 2015 KS KL Regular Meeting City Manager Department REQUEST: The Utility Department requests approval of Resolutions 2015 -30 and 2015 -31, adopting the Water Treatment Plant #1 Facilities Plan and Authorizing the State Revolving Loan Fund Application, respectively. SYNOPSIS: Preparation and adoption of a Water Facilities Plan is a requirement of the State Revolving Loan Fund Application process. Resolution 2015 -30 adopts the Water Treatment Plant #1 Water Facilities Plan. Resolution 2015 -31 authorizes the execution and submission of the State Revolving Fund Loan Application needed to obtain a low interest loan to fund the improvements identified in the Water Facilities Plan. CONSIDERATIONS: This agenda item is needed to fulfill the criteria set forth in applying for a low interest loan from State Drinking Water Revolving Loan Fund (SRF). The SRF loan is the most economical option to fund the water quality improvements to be constructed at WTP #1 by April 2017 to meet the TTHM violation Consent Order issued by the State. Resolution 2015 -30 provides for the adoption of the WTP1 Water Facilities Plan. The scope of the Water Facilities Plan includes; • Identify the proposed project and documented health risk component for WTP1 • Establish design needs of the project • Identify and evaluate various alternatives to satisfy the needs of the project • Recommend the most cost effective, environmentally sound facilities to meet the Public Hearings 503 PAGE 1 OF 3 - December 14, 2015 needs of the project • Describe the recommended facilities and costs • Present a schedule of implementation of the recommended facilities • Identify adverse environmental impacts and propose mitigation measures • Identify a source of financing and estimate the cost per household The Water Facilities Plan Executive Summary is attached. The link is; ham: / /www.wintersprin s fl.org/EN/ web / find /codes/DocsFormsPubs /43915 /maps.htm On October 25, 2015, a Notice of Public Meeting was advertised in the Orlando Sentinel to advise the public that the WTP1 project will be discussed at this December 14, 2015 City Commission meeting and the public will have an opportunity to provide any comments. Prior to considering Resolution 2015 -30, the Commission meeting needs to be opened up to the public for comments. Copies of the public notice, agenda item and meeting minutes are required to be included in the SRF application. FISCAL IMPACT: The SRF loan amount is projected at $6,000,000 to cover the construction costs. The current SRF rate is 2.26% less additional reductions available for Davis/Bacon and Buy American compliance which brings the current rate projection the to the 1.2% range. The potable water rate increase needed to cover the debt on the SRF loan is tentatively projected at $2.50 per month for residential customers. CPH submitted a Request for Inclusion in the SRF Loan program and it was approved on October 8, 2015. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. Public Meeting Notice Proof of Publication (1 page) Public Hearings 503 PAGE 3 OF 3 - December 14, 2015 and Attachment No. 1 RESOLUTION NUMBER 2015 -30 A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA; APPROVING THE WINTER SPRINGS WTP 1 WATER FACILITIES PLAN RELATING TO THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION (FDEP) STATE REVOLVING FUND LOAN PROGRAM; PROVIDING FOR THE IMPLEMENTATION OF AN ANIONIC ION EXCHANGE SYSTEM PROJECT; REPEALING RESOLUTIONS IN CONFLICT HEREWITH; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Winter Springs, Florida, has made the following determinations; WHEREAS, local government agencies are allowed, under the general laws of Florida to apply for public loans through the State of Florida in order to finance the construction of water facilities; and WHEREAS, the administrative regulations of the Florida Department of Environmental Protection (FDEP), the state agency that oversees the State Revolving Fund Loan Program, require the City Commission, as the local governing body of the City of Winter Springs, to formally adopt the WTP 1 Water Facilities Plan (Including Business Plan, Environmental Documentation, and Permitting) describing the necessary water treatment alternatives to achieve the water quality goals of the City; describing the selected alternative - Anionic Ion Exchange System water project; in order to comply with the funding requirements of the State of Florida; and WHEREAS, formal approval of the WTP 1 Water Facilities Plan (including Business Plan, Environmental Documentation, and Permitting) is required in order for the City of Winter Springs to participate in the State Revolving Loan Fund Program; and WHEREAS, the City Commission concurs with the findings and summary of necessary improvements that are described in the Plan for the purpose of improving water quality. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - The foregoing recitals are incorporated herein by reference. SECTION II - The City Commission of the City of Winter Springs, Florida, is authorized to approve, and does hereby approve, the WTP 1 Water Facilities Plan (Plan). The said Plan is approved pursuant to the State Revolving Fund Loan Program for the purpose of making improvements to the City's water facilities, including an Anionic Ion Exchange System. A copy of the City's Plan shall be maintained by the City Clerk. SECTION III - The Mayor is hereby authorized and directed to execute the said Plan, including any and all papers and documents necessary and incidental thereto. SECTION IV - The City Manager is designated to be the City's representative who is authorized to provide the assurance and commitments that will be required by the said Plan; and to represent the City in carrying out the City's responsibilities under the Plan, including the authority to delegate responsibility to appropriate City staff to carry out the various technical, financial and administrative activities associated with implementing the Plan. SECTION V - That all Resolutions made in conflict with this Resolution are hereby repealed. SECTION VI - That this Resolution shall become effective immediately upon its adoption. GARGANESE, City Attorney City of Winter Springs, Florida Resolution 2015 -30 Page 3 of 3 Attachment No. 2 RESOLUTION NUMBER 2015 -31 A RESOLUTION OF CITY OF WINTER SPRINGS, FLORIDA, RELATING TO THE STATE REVOLVING FUND LOAN PROGRAM; MAKING FINDINGS; AUTHORIZING THE LOAN APPLICATION; AUTHORIZING THE LOAN AGREEMENT; ESTABLISHING PLEDGED REVENUES; DESIGNATING AUTHORIZED REPRESENTATIVES; PROVIDING ASSURANCES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, Florida Statutes provide for loans to local government agencies to finance the construction of drinking water treatment facilities; and WHEREAS, Florida Administrative Code rules require authorization to apply for loans, to establish pledged revenues, to designate an authorized representative; to provide assurances of compliance with loan program requirements; and to enter into a loan agreement; and WHEREAS, the State Revolving Fund loan priority list designates Project No. DW59061, an ion - exchange system project for Water Plant No. 1, as eligible for available funding; and WHEREAS, the City of Winter Springs, Florida, intends to enter into a loan agreement with the Department of Environmental Protection under the State Revolving Fund for project financing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - The foregoing findings are incorporated herein by reference and made a part hereof. SECTION II - The City of Winter Springs, Florida, is authorized to apply for a loan to finance the Project. SECTION III - The revenues pledged for the repayment of the loan are net water and sewer system revenues after payment of debt service on the SunTrust Bank loan; the two BB &T Bank Loans; the SRF loan; and the two US Bank loans as identified in the Business Plan. SECTION IV - Kevin Smith, City Manager, is hereby designated as the authorized representative to provide the assurances and commitments required by the loan application. SECTION V - Charles Lacey, Mayor, is hereby designated as the authorized representative to execute the loan agreement which will become a binding obligation in accordance with its terms when signed by both parties. Kevin Smith, City Manager, is authorized to represent the City in carrying out the City's responsibilities under the loan agreement. Kevin Smith, City Manager, is authorized to delegate responsibility to appropriate City staff to carry out technical, financial, and administrative activities associated with the loan agreement. SECTION VI - All resolutions or part of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION VII - If any section or portion of a section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other section or part of this Resolution. SECTION VIII - This Resolution shall become effective immediately upon its passage and adoption.
