REQUEST:
Staff is requesting that the Mayor and Members of the City Commission make remaining
Appointments to the seven (7) member Districting Commission pursuant to Section 4.02 of
the Charter of the City of Winter Springs. The referenced Section of the Charter states that
these appointments must be made by the first day of February, 2016.
Staff is also requesting that the Mayor and Members of the City Commission (depending on
the applicable Board /Committees) make Appointment(s)/Reappointment(s) related to other
current and upcoming Board /Committee vacancies as well.
SYNOPSIS:
From time to time, Agenda Items are brought forward to the Mayor and City Commission
related to Board and Committee vacancies, for the purpose of making any required
Appointment(s) and /or Reappointment(s).
This Agenda Item is being submitted pursuant to current and upcoming Seat vacancies on
some of the City's Boards and Committees to include the Districting Commission, the
Bicycle and Pedestrian Advisory Committee, the Board of Trustees, the Code Enforcement
Board, and the Oak Forest Wall and Beautification District Advisory Committee.
CONSIDERATIONS:
Districting Commission:
Applicable Regulations: Section 4.02, City Charter

Section 4.02 of the City Charter requires the Mayor and Commissioners to appoint seven
(7) city electors determined from the registration of the last regular election: one (1) to be
appointed by each City Commissioner from his /her respective commission district and two
(2) appointed by the Mayor from the City at large, who shall comprise the Districting
Commission. The Districting Commission is charged with filing a recommended plan for
adjusting the City Commission boundaries consistent with the requirements set forth in
Section 4.02 of the City Charter. The City Commission shall then consider the Districting
Commission's report (and any proposal to revise the City Commission District Map) and
adopt an Ordinance to enact the revised districting map.
The City Commission shall adopt the redistricting Ordinance at least one hundred twenty
(120) days before the next city election. If the City Commission fails to either accept or
reject the redistricting Ordinance, the report of the districting commission shall go into
effect and have the same effect of an Ordinance. The proposed redistricting Ordinance may
not be rejected for any reason except for failure to comply with the specifications listed in
Section 4.02 of the City Charter or failure to comply with other local, state, or federal law.
This redistricting effort is undertaken every three (3) years and was last completed by the
City of Winter Springs in 2013.
Once the members of the Districting Commission are appointed, Staff will work with
the Districting Commission to provide technical data and support staff as well as facilitate a
time and place for meetings of the Districting Commission. If and when any district
boundary changes are finalized by the Districting Commission, Staff will facilitate those
changes to the Districting Map and this map will be included with the
Districting Commission's final report to the City Commission. This report will contain a
recommended plan for adjustment of the City Commission district boundaries, if any.
Regular meetings will be held as determined.
At the October 26, 2015 City Commission Regular Meeting, Commissioner Jean Hovey and
Commissioner Pam Carroll each made an Appointment to the Districting Commission.

Bicycle and Pedestrian Advisory Committee:
The Bicycle and Pedestrian Advisory Committee is a five (5) Member Advisory Committee
appointed by the City Commission for a Term of four (4) years.
"The purpose of the Committee is to promote trail, pedestrian and bicycle circulation
systems and encourage increased use of non - motorized transportation in the City. The
Committee shall perform the following duties:
(1) Serve as an advocate for the adoption of a Trail and Bicycle System Master Plan for the
City.

(2) Promote pedestrian and bicycle travel as a viable transportation choice to connect
neighborhoods with parks, schools, commercial areas, and other destinations in the City and
surrounding area.
(3) Assist with identifying funding sources and implementation strategies which further the
development of an interconnected network of trails, sidewalks and bikeways within the
City.
(4) Recommend to the City Commission establishment, development, planning, funding and
maintenance of specific trail, sidewalk and bicycle projects.
(5) Consider all matters submitted to it by the City Commission or Staff and shall offer
suggestions or recommendations on its own initiative. It shall receive petitions and
suggestions from the citizens of the City, and shall cooperate with civic groups,
governmental agencies, and other organizations regarding trail, sidewalk and bicycle system
planning and implementation."
Regular meetings are held Quarterly on the third Wednesday of March, June, September,
and December at 5:30 p.m.

Board of Trustees:
The Board of Trustees is a five (5) Member Advisory Board that serves as Trustee and
Retirement Committee of the Defined Benefit Plan and Trust, and the Board of Trustees is
authorized to execute the Defined Benefit Plan. The Board of Trustees shall administer the
Defined Benefit Plan pursuant to the provisions contained therein.
Regular Meetings are held Quarterly on the second Tuesday of February, May, August, and
November at 5:30 p.m. The Term of Service for this Board is four (4) years.

Code Enforcement Board.
The Code Enforcement Board is a seven (7) Member Board, which meets monthly, on the
fourth Tuesday, beginning at 5:30 p.m.

In accordance with Florida Statutes, the Term of Service for this Board is three (3) years.
The Code Enforcement Board has specific criteria related to its membership, as noted below:
Florida Statutes: 162.05 Local government code enforcement boards; organization.
"(1) The local governing body may appoint one or more code enforcement boards and legal
counsel for the enforcement boards. The local governing body of a county or a municipality
that has a population of less than 5,000 persons may appoint five- member or seven - member
code enforcement boards. The local governing body of a county or a municipality that has a
population equal to or greater than 5,000 persons must appoint seven - member code
enforcement boards. The local governing body may appoint up to two alternate members for
each code enforcement board to serve on the board in the absence of board members.
(2) Members of the enforcement boards shall be residents of the municipality, in the case
of municipal enforcement boards, or residents of the county, in the case of county
enforcement boards. Appointments shall be made in accordance with applicable law and
ordinances on the basis of experience or interest in the subject matter jurisdiction of the
respective code enforcement board, in the sole discretion of the local governing body. The
membership of each enforcement board shall, whenever possible, include an architect, a
businessperson, an engineer, a general contractor, a subcontractor, and a realtor."
The following is an excerpt from the City's Code of Ordinances: Sec. 2 -57. Membership;
appointment; qualifications. "The code enforcement board shall consist of seven (7)
members to be appointed by the city commission to seats numbered one (1), two (2), three
(3), four (4), five (5), six (6) and seven (7) in accordance with section 2- 42(d).
Appointments to the board shall be on the basis of experience or interest in the fields of
zoning and building control. The membership of the code enforcement board shall,
whenever possible, include an architect, a businessperson, an engineer, a general contractor,
a subcontractor and a realtor or as otherwise provided by law."

Oak Forest Wall And Beautification District Advisory Committee:
The Oak Forest Wall and Beautification District Advisory Committee: is a five (5) Member
Advisory Committee who serve a Term of four (4) years. An annual Regular meeting is
usually held on the second Thursday of May, beginning at 5:30 p.m.
The City Commission may establish, by Resolution, an Advisory Committee for any
Assessment Area within which Assessments are imposed. Each Advisory Committee shall
consist of at least five members appointed by the City Commission. Members of the
Advisory Committee may be residents or persons with a vocational or investment interest in
the assessed area.
Each Advisory Committee, for its respective assessed area, and in conjunction with City
staff personnel, shall timely provide input and recommendations to City staff or City
consulting professionals assigned the task of providing technical assistance in the following
activities: (1) development of a budget for the desired local improvement or related
services, (2) imposition of assessments to fund the local improvement or related services,
(3) issuance of the Obligations when required, and (4) maintenance of the local
improvement or the provision of related services. The Advisory Committee shall review and
discuss issues related to the foregoing and other directly related matters of interest to the
owners of property within the respective assessed areas and make such recommendations
thereon as the advisory committee deems appropriate.
This Advisory Committee will review and discuss issues related to the foregoing and other
directly related matters of interest to the owners of property within the Oak Forest
community. To serve on this Advisory Committee, you need to reside within the Oak Forest
Wall and Beautification Assessment District.
The Term of Service for this Committee is four (4) years.

Server; has been sent to applicable City Staff, Media/Press Representatives who have
