HomeMy WebLinkAbout2015 09 28 Consent 308 Resolution 2015-25, FDOT Surplus LandsCOMMISSION AGENDA ITEM 308 Informational Consent X Public Hearings Regular September 28, 2015 KL KL Regular Meeting City Manager Department REQUEST: The Public Works Department requesting City Commission approval of Resolution 2015- 25, which authorizes the acquisition of surplus lands from the Florida Department of Transportation in the vicinity of S.R. 434 and Gardena Avenue. SYNOPSIS: The realignment of S.R. 434 in the vicinity of Gardena Avenue created surplus FDOT right - of -way. Resolution 2015 -25 authorizes the acquisition of 2.5 acres of FDOT surplus lands to be used for public purposes. CONSIDERATIONS: The realignment of S.R. 434 in the vicinity of Gardena Avenue (construction in approximately 1998) created 2.5 acres of surplus Florida Department of Transportation (FDOT) right -of -way consisting of a portion of "Old S.R. 434" and a portion of Gardena Avenue from Old S.R. 434 to the current S.R. 434 (see Attachment 1). Standard Pacific Homes owns the surrounding lands in the vicinity of S.R. 434 and Gardena Avenue. Standard Pacific intends to develop the property primarily as a single - family subdivision, and they recently contacted FDOT and the City about the surplus FDOT right - of -way that was created when FDOT realigned S.R. 434. FDOT will donate the surplus lands to the City at no cost as long as the surplus lands are used for a public purpose. The 2.5 -acres of surplus lands would be used for public roadway, stormwater, and utility infrastructure that would be developed in conjunction with the Standard Pacific project. Attachment 2 is Resolution 2015 -25, which includes a sketch and legal description of the surplus lands. The Resolution declares the City's intent to use the surplus lands for a public purpose and it authorizes the City Manager to enter into an agreement to acquire the surplus Consent 308 PAGE 1 OF 2 - September 28, 2015 lands from FDOT. FISCAL IMPACT: No funding is required for the acquisition of the surplus FDOT lands to be used for a public purpose. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends the City Commission approve Resolution 2015 -25 authorizing the acquisition of surplus lands from the Florida Department of Transportation in the vicinity of S.R. 434 and Gardena Avenue. WHEREAS, the realignment of State Road 434 in the vicinity of Gardena Avenue created surplus Florida Department of Transportation right -of -way as described in Exhibit A, and WHEREAS, the City of Winter Springs intends to utilize said right of way for the public purpose of roadway, stormwater, and utility infrastructure, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I — The City Commission of the City of Winter Springs hereby authorizes the City Manager to enter into an agreement to acquire the surplus right -of- way from the Florida Department of Transportation.
