SYNOPSIS: Meritage Homes is requesting approval of an Easement Encroachment Agreement for a planned development (PD) boundary setback encroachment for the side yard only on Lot 138 in the Seven Oaks Subdivision located at 697 Seven Oaks Blvd. The property contains a 20 -foot wide PD boundary setback along the side and rear of the lot. On July 20, 2015 the applicant submitted a building permit application for a single - family residence that would encroach approximately 6.7 feet into the PD boundary setback for the side yard. The PD boundary setback is a setback that is not required by the City Code, but was noted on the approved Seven Oaks Subdivision Plat. The plat requires a 10 foot side yard setback for a corner lot. The proposed single - family residence will comply with the side yard setback, as approved on the subdivision plat. CONSIDERATIONS: APPLICANT AND PROPERTY INFORMATION: . City Liens (if any): No known liens APPLICABLE LAW, PUBLIC POLICY, AND EVENTS Seven Oaks PUD Master Plan DISCUSSION: The PUD (Planned Unit Development) Master Plan for the Seven Oaks subdivision was approved by the City Commission on May 13, 2013 and the Final Plat on November 18, 2013. The approved Master Plan and Final Plat depict a PD Boundary setback of 20 -feet. This setback was imposed by the developers at the time. There is no record of the City imposing this boundary. In discussions with the City Attorney's office, it was determined that this item should be brought back to the City Commission in the form of an easement encroachment agreement because the final engineering plans that were approved by the Commission contained the 20 -foot PD Boundary requirement. This same setback was also shown on the master plan and the plat for the Seven Oaks subdivision. Staff has determined that Lot 138 is the only lot within the Seven Oaks subdivision that would be impacted by the 20 -foot PD Boundary. Meritage Homes is requesting approval of an Easement Encroachment Agreement to construct a single - family residence approximately 6.7 feet into the PD Boundary Setback for the side yard. Approval of this request would not negatively impact any other lots in the subdivision. FISCAL IMPACT: There is no fiscal impact associated with granting the Easement Encroachment Agreement. Completion of construction of the single - family residence will add taxable value to the City's tax rolls. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, Consent 304 PAGE 2 OF 3 - September 28, 2015 City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. State Road 434, Winter Springs, Florida 32708, and MERITAGE HOMES OF FLORIDA, INC., located at 5337 Millennia Lakes Blvd., Unit 410, Orlando, Florida 32839, (hereinafter referred to as "Owner ") whose address is WHEREAS, Owner presently owns that certain property generally located at 697 Seven Oaks Blvd., Parcel Identification Number 28- 20- 30 -5TK- 0000 -1380, more particularly described and depicted on Exhibit "A" attached hereto ( "Property "), which Property contains a 20 -foot wide planned development boundary setback ( "Boundary Setback "); and WHEREAS, the Property Owner desires to build a single — family residence that encroaches approximately seven (7) feet into the Boundary Setback as depicted in Exhibit "A "; and WHEREAS, the parties hereto wish to enter into this Agreement to allow such improvements to encroach into the Boundary Setback, subject to the conditions of this Agreement. The Owner agrees that the Owner will not encroach any more than the depicted encroachments. In no event shall such encroachment exceed seven (7) feet into Boundary Setback. This Agreement shall inure to the benefit of and be binding upon the respective heirs, personal representatives, successors and assigns of the parties hereto.
