SYNOPSIS: One of the responsibilities of the City Clerk is to provide the Mayor and City Commission with a submittal of all Meeting Minutes, as soon after a City Commission meeting as possible; so, that it is a reminder to the Mayor and City Commission, as to what transpired at their most recent meeting, and also provides a record of the actions and directives of the City Commission, for the future, and which becomes the official record. If the City Commission is in agreement with what the City Clerk provides in these Minutes, then the City Commission would be asked to Approve the Minutes, as submitted. Should the Mayor and /or City Commission feel something is not appropriately documented in these Minutes, then a Motion would be appropriate to have the Minutes changed to reflect what the majority of the City Commission would prefer. CONSIDERATIONS: This Agenda Item includes the Minutes from the Monday, August 24, 2015 City Commission Regular Meeting. Even though these Minutes are being submitted by the City Clerk, (with proofing by Office of the City Clerk Staff), no other party has required that changes be made to the Minutes before being submitted. These Minutes are being submitted by the City Clerk Consent 304 PAGE 1 OF 2 - September 14, 2015 for the Approval by the City Commission. FISCAL IMPACT: There is no fiscal impact related to this Agenda Item. Mr. Fred Kit ing , Jr., 4ssociate Vice President for University Relations, Director of State and Local Government nment Af air•,s, University of Central Florida, Post Office Box 160040, Orlando, lorida • addressed the Mayor and City Commission and spoke of the partnership between Winter i p g n s and the Incubator program. Mr*. Gordon Hogan, Director, UCF Business Incubation Program, 12201 Research Parkway, Suite 206, Orlando, Flo ida: referencing some Po erPoint slides, Mr. Hogan commented on this "community partnership ", that there are currently twenty -five 2 companies in the Incubator, and that the Incubator is eighty- six percent 6% full. Mr. Hogan then gave an update on some of the Incubator companies. INFORMATIONAL AGENDA INFORMATIONAL 200. Police Department R Q ST: The Police Department wishes to update the City Commission on our new community relations and crime prevention initiative called SHIELD 360. Utility Department REQUEST: The Utility Department is requesting authors ation to enter into a contract agreement with Rocha Controls of Tampa for the East water Reclamation Plant Control System Modifications and Programming at a cost of $61,337 plus a 20% contingency. FISCAL IMPACT: The project cost is $61,337 which is budgeted in the Utility Enterprise Fund (line code 3600 - 62100). C's estimated cost for shop drawing review and project oversight is $8,610. Community Development department - Planning Division REQUEST: The Community Development Department -- Planning Division requests the City Commission consider first reading of Ordinance 2015-15, which proposes to amend the list of permitted, conditional and prohibited uses in the C -1 (Neighborhood Commercial), C- (General Commercial), and C -3 (Highway 17- 2 Commercial ) zoning districts by reproving multi-family residential uses as a Conditional Use in these zoning districts. FISCAL IMPACT: There is no indirect fiscal impact associated with this agenda item. Office of the City Attorney REQUEST: On behalf of the Police Chief and the City Manager, the City Attorney requests that the City Commission consider and pass, on First Reading, Ordinance No. 2015 -17 which comprehensively modifies the City's code enforcement procedures and requirements including, but not limited to, establishing a special magistrate system of enforcing City Codes and amending the manner in which applications for code enforcement lien reductions and satisfactions are considered by the City. FISCAL IMPACT: There is no direct fiscal impact related to the adoption of this Ordinance other than staff and attorney time to prepare the Ordinance and Agenda Item. However, the City will be responsible for fees required to retain a special magistrate. The fees will depend on the future negotiated rate and the case load handled by the special magistrate. Special magistrate fees are not recoverable against the code violator as "costs" under Chapter 162, Florida Statutes. See Op. tt'y Gen. Fla, 1 - (2014) . 162,07(2), Fla. Stat. does not allow a city to recover against a code violator the fees paid to a special magistrate or to the special magistrate's assistant).
