SYNOPSIS: The Tuscany Place plat consists of 45 townhome lots developed by Intrasugar Investments. Tuscany Place is located on the north side of Northern Way and east of Trotwood Boulevard. Tuscany Place was originally constructed as a condominium project in the 1980's. The new developer has proposed to construct the remaining units as townhome lots, to be sold as fee simple units. CONSIDERATIONS: LAND USE & ZONING Zoning: Planned Unit Development (PUD) Future Land Use: High Density Residential APPLICABLE REGULATIONS Chapter 177, Florida Statutes Chapter 197, Florida Statutes Chapter 9, City Code Tuscany Place consists of 45 townhome lots developed by Intrasugar Investments. Tuscany Place is located north of Northern Way and east of Trotwood Boulevard. Tuscany Place was originally constructed as a condominium project in the 1980's. The new developer has proposed to construct the remaining units as townhome units. Approval of this agenda item Consent 306 PAGE 1 OF 2 - June 22, 2015 will allow for the completion of Tuscany Place. The reason for platting the existing units is to allow for the new properties to be sold as fee simple units. Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various sections) and Chapter 177, Florida Statutes. Chapter 177, Florida Statutes require that the plat be fully executed by the owner(s) of record, by all mortgagees having an interest in the land to be subdivided, by the professional surveyor and mapper of record, and by the independent professional surveyor and mapper who reviews the plat for consistency with Chapter 177, Florida Statutes. City Staff including the City's independent surveyor, Southeastern Surveying and Mapping Corporation, have reviewed the plat and have no outstanding review comments. FISCAL IMPACT: There is no immediate fiscal impact associated with this agenda item. The addition of 45 townhouse units will contribute to the City's ad valorem tax value once built and added to the tax roles. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends the City Commission approve the Tuscany Place plat and authorize the City Manager and City Attorney to prepare and execute any and all applicable documents.
