SYNOPSIS: The applicant is requesting approval of a Final Engineering Plan and Aesthetic Review for Southern Oaks, a single- family development that is proposed to be constructed partially in the City of Winter Springs and partially in the City of Oviedo. The portion of the development that is proposed in Winter Springs consists of 54 units on 33.30 acres, and is located north of SR 434 and west of the intersection of DeLeon Street and Cress Run. The Preliminary Subdivision Plan and associated waiver requests were approved by the City Commission in 2013. DISCUSSION: Final Engineering Plan Southern Oaks is proposed as a single- family residential subdivision that is to be constructed partially in the City of Winter Springs and partially in the City of Oviedo. Of the units that are proposed, 54 will be constructed in the City of Winter Springs on 3 3.3 0 gross acres. Of the 3 3.3 0 gross acres, 24.35 are net acres, or developable land. The subj ect property is zoned R- I (One - family dwelling district). The applicant is proposing a minimum lot size of 8,000 square feet for the portion of the development that is located within the City of Winter Springs in accordance with the requirements of the R -IA zoning June 10, 2015 Planning & Zoning Board, Item 500 Page 3 of 5 district. A 6 -foot high brick wall will be installed in an easement along the rear portions of all lots along the northeastern portion of the development. The adjacent property is zoned R -C 1 (Single- family dwelling district). The Code does not require a wall between residential uses. On March 10, 2014, the City Commission approved a request by the developer to construct a dry retention pond to be located on City owned property located to the north of the development (Solary Canal Regional Stormwater Treatment Area). All terms and conditions of the proposed usage of the City property will be incorporated into a Developer's Agreement to be considered for City Commission approval at a future meeting in conjunction with the final engineering plans. Additionally, the developer agreed to pay the City $125,000 prior to any site clearing or construction within the basin draining to the proposed pond. Further, the location of the original retention pond that was proposed on the Preliminary Subdivision Plan will remain in the southeastern quadrant of the site. Vehicular access to the site will be via an access road located off of DeLeon Street. The access road is proposed through the portion of the development that is located within the City of Oviedo and ultimately ending in a loop and proposed cul -de -sac in the City of Winter Springs. The subdivision is proposed to be gated with private streets. Internal streets will consist of 50 -foot of rights -of -way with 24 -feet pavement width. Five foot wide sidewalks will be installed on both sides of the street. Aesthetic Review The attached Aesthetic Review package includes all of the submittal requirements for aesthetic review as set forth in Section 9 -600 through 9 -607 and include the following: (a) a site plan; (b) elevations illustrating all sides of structures facing public streets or spaces; (c) illustrations of all walls, fences, and other accessory structures and the indication of height and their associated materials; (d) elevation of proposed exterior permanent signs or other constructed elements other than habitable space, if any; (e) illustrations of materials, texture, and colors to be used on all buildings, accessory structures, exterior signs; and (f) other architectural and engineering data as may be required. The procedures for review and approval are set forth in Section 9 -603. The City Commission may approve, approve with conditions, or disapprove the application only after consideration of whether the following criteria have been satisfied: (1) The plans and specifications of the proposed project indicate that the setting, landscaping, proportions, materials, colors, textures, scale, unity, balance, rhythm, contrast, and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. The project is located north of SR 434 and west of the intersection of DeLeon Street and Cress Run. The design of the proposed units includes architectural design elements such as stone veneer, stucco, and architectural embellishments such as balconies, columns, and arches over the entryways. Expression lines are provided around the perimeter of several of the proposed units to help break up blank expanses on the facades. Staff feels that this project incorporates certain quality design elements that are promoted Citywide. The architecture is complementary to the diverse styles of architecture that have been provided in the City. June 10, 2015 Planning & Zoning Board, Item 500 Page 4 of 5 (2) The plans for the proposed project are in harmony with any future development which has been formally approved by the City within the surrounding area. The design of the proposed units are characteristic of the architecture that is provided citywide and is in harmony with the surrounding residential developments in the area. (3) The plans for the proposed project are not excessively similar or dissimilar to any other building, structure or sign which is either fully constructed, permitted but not fully constructed, or included on the same permit application, and facing upon the same or intersecting street within five hundred (500) feet of the proposed site, with respect to one or more of the following features of exterior design and appearance: (A) Front or side elevations, (B) Size and arrangement of elevation facing the street, including reverse arrangement, (C) Other significant features of design such as, but not limited to: materials, roof line, hardscape improvements, and height or design elements. The proposed units are designed to contribute to the quality architectural styles that are typical of the surrounding area. This project represents a positive addition to the City of Winter Springs. Significant design features includes architectural design elements such as stone veneer, stucco, and architectural embellishments such as balconies, columns, and arches over the entryways. Expression lines are provided around the perimeter of several of the proposed units to help break up blank expanses on the fagades. (4) The plans for the proposed project are in harmony with, or significantly enhance, the established character of other buildings, structures or signs in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community. The proposed project enhances the character and overall aesthetics of the surrounding area. The City of Winter Springs is comprised of diverse architectural styles and, therefore, the proposed project represents a positive addition to this area of the City. (5) The proposed project is consistent and compatible with the intent and purpose of this Article, the Comprehensive Plan for Winter Springs, design criteria adopted by the city (e.g. Town Center guidelines, SR 434 design specifications) and other applicable federal state or local laws. The proposed project is consistent and compatible with the Comprehensive Plan and the design specifications and architectural styles that are characteristic to the City of Winter Springs. The final architectural plans will be reviewed for compliance with all building code criteria. June 10, 2015 Planning & Zoning Board, Item 500 Page 5 of 5 (6) The proposed project has incorporated significant architectural enhancements such as concrete masonry units with stucco, marble, termite - resistant wood, wrought iron, brick, columns and piers, porches, arches, fountains, planting areas, display windows, and other distinctive design detailing and promoting the character of the community. The project has incorporated a number of features such as stone veneer, stucco, and architectural embellishments such as balconies, columns, and arches over the entryways. Expression lines are provided around the perimeter of several of the proposed units to help break up blank expanses on the facades. The project provides distinctive design details that promote the character of the City of Winter Springs. FISCAL IMPACT: Approval of the Final Engineering Plan and Aesthetic Review allows the subject property to be developed into a single - family residential subdivision. Development of the subject property is anticipated to provide an increase to the City's taxable value. The potential tax revenue of the proposed project is as follows: • Fee Simple Single Family Residential Units - 54 units • Units - 54 assessed at $200,000 = $10,800,000 assessed tax value o $10,800,000/1000 = 10,800 o $10,800.00 x(2.4300) = $26,244 o $26,244 (less the 4% statutory discount) = $25,194.24 tax revenue COMMUNICATION EFFORTS: The Meeting Agenda and this Agenda Item have been forwarded to the Planning and Zoning Board members and are available on the City's Website, LaserFiche, and the City's Server. The Agenda has been forwarded to the Mayor and City Commission; City Manager; and City Attorney /Staff. Additionally, the Meeting Agenda has been sent to media /press representatives, all Homeowner's Associations on file with the City, all individuals who have requested Agenda information, Department Directors; and also posted outside City Hall; posted inside City Hall with additional copies available for the general public. RECOMMENDATION: Staff recommends that the Planning & Zoning Board forward a recommendation of approval to the City Commission for the approval of: 1) Final Engineering Plan, and 2) Aesthetic Review for Southern Oaks.
