SYNOPSIS: The Trotwood Park Improvement project consists of paving of the existing parking lot and drive lanes, new sidewalks, storm water collection system to pond, conduit for future walkway lighting, and design considerations for future pavilion. CONSIDERATIONS: • To improve safe and efficient access of vehicles and pedestrians. • To improve vehicular access and connectivity within Trotwood Park. • Provide additional parking spaces and safe pedestrian movements between activity areas of the park. • Improved storm water collection system into existing pond. • Additional safe lighting along sidewalks. • Design will allow for future addition of large pavilion overlooking pond. FISCAL IMPACT: The design and permitting cost is $31,500.00 funded by Parks Impact Fees. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, Consent 301 PAGE 1 OF 2-June 08,2015 City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends the City Commission authorize the execution of a task order with CPH, Inc. in the amount of$31,500.00 for the design of Trotwood Park Improvements, funded by Parks Impact Fees. ATTACHMENTS: Attachment A- CPH Task Order#1 to Agreement Dated February 19, 2015 Consent 301 PAGE 2 OF 2-June 08,2015 TASK ORDER 1 TO AGREEMENT DATED February 19, 2015 CONSULTING ENGINEERING SERVICES FOR TROTWOOD PARK EXPANSION BETWEEN THE CITY OF WINTER SPRINGS AND CPH, INC. This Task Order dated May 4 , 2015 by and between the City of Winter Springs (hereinafter called the OWNER) and CPH , Inc. (hereinafter called the Engineer), is mutually agreed upon and declared an authorized Task Order based on Agreement for Engineering Services dated February 19, 2015. The appropriate provisions of the Agreement apply as fully as if repeated herin . 1.1 SECTION 1 GENERAL The purpose of this Task Order is to provide for Engineering Services, more specifically itemized herein, in the preparation of Plans and Specifications and other Engineering Services for the Trotwood Park Expansion . SECTION 2 BASIC SERVICES OF THE ENGINEER 2.1 GENERAL 2.1.1 The ENGINEER agrees to perform professional services in connection with the project as hereinafter stated. 2 .1.2 The ENGINEER will serve as the OWNER's professional engineering representative in those phases of the project to which this Task Order applies , and will give consultation and advice to the OWNER during the performance of his services . The ENGINEER will perform the services for the City Commission under the general supervision of the City Manager and Parks and Recreation Director and will submit interim plans to them for their review, input, decision, etc. as appropriate. 3.1 SECTION 3 SCOPE OF SERVICES GENERAL The OWNER hereby authorizes the ENGINEER to proceed with the preparation of plans and specifications for park improvements as listed below. 3.1.1 The project includes the following : a. Paving of the existing stabilized parking lot and drive Janes located between the existing hard courts and the children's play area . b. Construction of sidewalks along the edge of a portion of the proposed pavement and at handicap spaces . c. Storm water collection system to existing pond d. Conduit for future Walkway lighting . e. Design considerations for future pavilion along south edge of existing storm pond . At 50% plan submittal, the final scope of the project shall have been reviewed, defined and approved by the OWNER. Any modifications to stay within the budget shall be made at the 50% submittal. 3.2 ENGINEERING SERVICES 3.2.1 ENGINEER will retain the services of a Geotechnical Consultant to provide data on groundwater table , soil permeability, and existing soils conditions/type . As part of the geotechnical work, the consultant will also provide recommendations on proposed pavement sections for the parking area and future pavilion . A previous geotechnical study was performed for the park . However, the date of the geotech report is from November 2006 . For that report, there were no borings taken in the proposed storm water pond area . Two other borings were taken on site , but do not appear to fall within the proposed pavement area for the new project. We recommend new borings for the project to update the water table data . A copy of the scope for the services is included as an attachment. 3.2.2 The Engineer has a previous , as -built survey of the park. However, this "as -built" survey does not reflect all of the current conditions of the existing park in the proposed project area . New survey work is required to properly design the proposed facilities . ENGINEER will retain the services of a Licensed Professional Surveyor to provide an updated survey of the work area including all above ground features , locations of existing trees, topographic elevations of existing parking area and a portion of the existing storm water pond . Perform the Survey as per Rule Chapter 5J -17 of the Florida Administrative Code in compliance with the minimum technical standards of surveying and mapping of the State of Florida . This scope of services does not include : Boundary Survey , ALTA/ACSM Land Title Survey , Sketch and Description, Construction Layout, Location/Designation of Underground Utilities , Platting , Wetland Location/Delineation , Determination of Ordinary High Water Lines or Control Survey. A copy of the scope for the services is included as an attachment. 3.2.3 CPH previously prepared plans for the splash pad and associated park improvements to the park, dated January 2008. A portion of the original plans shall be reviewed and incorporated in the design set of plans . Original plans to be reviewed, revised and incorporated shall include the general notes, general details, paving details and storm water details . The previous plans have a different configuration for the drive lane and parking that do not match the proposed alignment and therefore cannot be used . The previous plans also included significant work for demolition of the existing tennis courts and layout for new tennis courts which are not part of the proposed site work. Finally, the previous plans did not include the pedestrian and vehicle connectivity requested for the proposed site work . 3.2.4 ENGINEER shall prepare 50%, 90% and 100% plans and specifications for review and comment by the City staff. All submissions shall be "electronic." See attached manpower schedule for drawing details (Attachment 1 ). 3.2 .5 ENGINEER shall meet with the City staff at the 50% and 90% submittals to verify the project is meeting the intent and needs of the City . 3.2.6 ENGINEER shall perform field checks of completed Plans and Specifications, as necessary, with the OWNER's representative. 3.2.7 ENGINEER shall prepare estimates of probable construction cost based upon final plans and Specifications . 3.3 PERMITS 3.3.1 Assist the OWNER in the preparation of a storm water permit modification as required by the St. Johns River Water Management District (SJRWMD). Attend a pre -application meeting with the SJRMWD to discuss the project and determine the criteria for storm water collection, including the potential use of the existing storm water pond as the outfall for the proposed improvements and application fee. The submittal package and storm water design will be based on meetings with the SJRWMD and the District criteria. ENGINEER will prepare documentation and assist the OWNER in application for either a new permit for the proposed improvements or a modification to and existing SJRWMD permit, as necessary. 3.3 .2 Respond to reasonable requests for additional information from the SJRWMD agency . 3.3.3 FDEP permits for water and sewer are not anticipated and are not included in this Task Order. The ENGINEER shall request the OWNER for extras if a FDEP permit is required . 3.3.4 OWNER will pay the SJRWMD application fee. 3.3.5 OWNER is responsible for all other permit application fees . 3.4 CONSTRUCTION ADMINISTRATION SERVICES 3.4.1 ENGINEER shall not provide Construction Administration services for the project. SECTION 4 SUPPLEMENTARY SERVICES OF THE ENGINEER 4 .1 If authorized in writing by the OWNER prior to the rendering of such services, the ENGINEER will furnish or obtain under subcontracts , supplementary services which will be paid for by the OWNER. 4 .1.1 Additional services due to significant changes in the scope of the project or its design including, but not limited to, changes in size, complexity, character of construction or due to time delays in initiating or completion of the work as described herein . 4 .1.2 Additional services in connection with the project including services normally furnished by the OWNER as described in Section 5 herein and services not otherwise provided for in this Task Order. 4.1 .3 Preparing to serve and serving as an expert witness for the OWNER in any protest, litigation , or other proceeding involving the project. 4 .1.4 Additional engineering services required by revisions to regulations (after the date of this Task Order) as applicable to the Florida Department of Environmental Protection, the St. Johns River Water Management District, or other regulatory agency requirements. 4 .1.5 Provide, through a subconsultant , additional surveying services if required or requested by the OWNER. 4 .2.6 Provide, through a subconsultant, soils investigation services if required or requested by the OWNER. SECTION 5 THE OWNER'S RESPONSIBILITIES 5.1 The OWNER will : 5.1.1 Advise the ENGINEER of his requirements for the project and designate a person to act as the OWNER's representative with respect to the work to be performed under this Task Order, and such person shall have complete authority to transmit instructions, receive information, interpret and define the OWNER's policies and decisions pertinent to the work covered by this Task Order. 5.1 .2 Guarantee access to and make all provision for the ENGINEER to enter upon public and private lands as required for the ENGINEER to perform his work under this Task Order. 5.1.3 Provide data requested that is reasonably available on the existing utility systems, population and projections, land use and planning information . 5.1.4 Provide personnel to locate facilities and mow, trim, or otherwise make them accessible for inspection . 5.1 .5 Examine all studies, reports, sketches, and other documents presented by the ENGINEER and render decisions pertaining thereto within a reasonable time so as not to delay the work of the ENGINEER. 5.1 .6 Obtain approval of all governmental authorities having jurisdiction over the project , and such approvals and consents from such other individuals or bodies as may be necessary for completion of the Project. 5.1. 7 Furnish , or direct the ENGINEER in writing to provide at the OWNER's expense , additional soils investigations if advised in writing by the ENGINEER that they are necessary or advisable . 5.1.8 5 .1.9 5.1 .10 6 .1 Furnish, or direct the ENGINEER in writing to provide at the OWNER's expense, necessary additional services as stipulated in Section 4 of this Task Order, or other services as required. Provide such legal, accounting , and insurance counseling services as may be required for the project and such auditing services as the OWNER may require . Give prompt written notice to the ENGINEER whenever the OWNER observes or otherwise becomes aware of any defect in the Project. SECTION 6 PAYMENT PAYMENT Payments for services and expenses of the ENGINEER to be as set forth below : 6 .1.1 The fee for the scope of services described herein will be provided as a lump sum fee of Thirty-one thousand, five hundred dollars ($31 ,500.00}, which includes miscellaneous expenses as necessary. The fees are broken down as follows : Engineering A. Design and Permitting B. Expenses Surveying Geotechnical TOTAL FEE: $26,450 .00 $ 750.00 $ 2 ,200 .00 $ 2.100 .00 $31l500.00 6 .1.2 The OWNER will make prompt monthly payments in response to ENGINEER's monthly statements without retention for all categories · of services rendered under this Task Order and for reimbursable expenses incurred . 6 .1.3 Charges for the services rendered by principals and employees as witnesses in any litigation , hearing or proceeding in accordance with Paragraph 4.1.4 will be computed at a rate of $650.00 per day or any portion thereof (but compensation for time spent in preparing to appear in any such litigation, hearing or proceeding will be computed in accordance with the funding levels as set forth in Paragraph 6 .1.1 and 6 .2.1 herein). 6 .1.4 If this Task Order is terminated during prosecution of the services prior to completion of the services of Section 3, payments to be made in accordance with Paragraph 6.1.1 and 6 .2 .1 on account of that and all prior work under this Task Order shall be due and payable , and shall constitute total payment for services rendered . In addition, upon termination, the ENGINEER shall be paid for any Additional Services authorized and rendered under Section 4. 6.1 .5 The ENGINEER shall promptly begin work on the services authorized by this Task Order upon receipt of notice to proceed from the OWNER. 7 .1 7.2 SECTION 7 GENERAL CONDITIONS Since the ENGINEER has no control over the cost of labor, materials , or equipment, or over any construction contractor's method of determining prices , any opinions of probable construction cost which may be provided in the services of this Task Order are made on the basis of his experience and qualifications and represent his best judgment as a design professional familiar with the construction industry, but the ENGINEER cannot and does not guarantee that bids or the construction cost will not vary from opinions of probable cost prepared by him . The OWNER and the ENGINEER each binds himself and his partners, successors, executors, administrators and assigns to the other party of this Task Order and to partners, successors, executors, administrators, and assigns of such other party in respect to all covenants of this Task Order. Nothing herein shall be construed as creating any personal liability on the part of any officer or agency of any public body which may be a party hereto, nor shall it be construed as giving any rights or benefits hereunder to anyone other than the OWNER and the ENGINEER. 8 .1 SECTION 8 EXECUTION OF PROJECT The ENGINEER agrees to prosecute the work in a timely manner until the Project is completed . The exploration will be supervised by a qualified Geotechnical Engineer registered in the State of Florida, and the results of the exploration will be presented in a geotechnical engineering report. The report will address the following items: • Existing site conditions. • Exploration, testing and sampling methods. • Subsurface soil conditions encountered and soil classification. • Depth to groundwater at the time of the exploration and estimated seasonal high groundwater levels. • A discussion of general site preparation techniques, fill compaction, fill suitability, etc. • Geotechnical design parameters to assist with foundation design of the pavilion. • General recommendations for pavements. C. GEOTECHNICAL PROJECT SCHEDULE Based on our present schedule, we are prepared to mobilize to begin the field operations on this project within about one (1) week of your authorization to proceed. We anticipate the field portion of the study to be completed in approximately one (1) day. Engineering analysis, necessary laboratory work, and report preparation should be completed within approximately two (2) weeks after the completion of field work. In computing this budget figure, we have assumed the site is accessible to our field crew, that we have right of entry to the site, and that we will not experience excessive delays due to rubble at borehole locations or for other reasons beyond our control. If such conditions are encountered that could cause the cost of the exploration to exceed the budget figure, we will notify the client and obtain approval for the additional work before we proceed.
