SYNOPSIS: The owner of property located at 155 Cherry Creek Circle, Scott and Denise Ritchey, submitted a building permit application for a 6-foot tall privacy wall located on the rear of the property. Upon review of the building permit application, it was determined by the Public Works Department that the proposed construction of the wall would be over a platted 10-foot drainage easement and a portion of a 5-foot utility easement. In order for the applicant to be able to receive a permit to construct the proposed privacy wall, vacation of the easement would be required. The applicant would need to petition the City Commission in order to seek this vacation. Resolution 2015-11 proposes vacation of a platted 10-foot drainage, and a portion of a 5-foot utility easement in order to permit construction of the privacy wall on the property. City Liens (if any): No known liens The plat for The Reserve at Tuscawilla, Phase I was approved by the City Commission in 1994. Note 3 on the cover of the plat reserves a 5-foot utility easement along all side lot lines. The applicant is the owner of lot 35. According to the plat and a survey that has been provided by the applicant, there is a 10-foot drainage easement along the northeastern property line and a 5-foot utility easement along the eastern property line. The applicant applied for a building permit to construct a 6-foot high privacy wall over these easement areas. During the review of the building permit application, it was conveyed to the applicant that they would have to petition the City Commission to vacate these easements to permit construction of the privacy wall over them. There will be no additional impacts to the easement area as a result of the vacation of this portion of the easement. The applicant has obtained letters of approval from applicable utility providers including Bright House Networks, Duke Energy, and the St. John's River Water Management District. Additionally, the City of Winter Springs Public Works Department has no obj ection to the proposed easement vacation. Vacation of the 10-foot drainage easement and the 5-foot utility easement to permit construction of the privacy wall does not impact any necessary facilities or require the removal of any trees. FISCAL IMPACT: There is no fiscal impact associated with this agenda item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. WHEREAS, the owner of real property generally located at 155 Cherry Creek Circle in the City of Winter Springs, more particularly described herein, has requested the vacation of a portion of a platted 10-foot drainage easement and 5-foot utility easement for the construction of a 72-inch high landscape wall; and, WHEREAS, the City of Winter Springs is not currently using, nor has any plans to use, the subj ect easements; and WHEREAS, each provider of utilities within the City of Winter Springs has indicated in writing, copies of which are on file with the Community Development Department, that it has no obj ection to the vacation of the subj ect easements; and WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this resolution to be in the best interest of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF WINTER SPRINGS,FLORIDA,AS FOLLOWS: Section 1. Recitals. The following recitals are true and correct and hereby fully incorporated herein by this reference as part of this Resolution. Section 2. Easement Vacation. The City Commission of the City of Winter Springs hereby vacates a portion of a 10-foot drainage easement and 5-foot utility easement on Lot 35, The Reserve at Tuskawilla, Phase I, as recorded in Plat Book 48, Pages 31 through 40, Public Records in and for Seminole County, Florida, as such easements are more particularly described and depicted on Exhibit A, attached hereto and incorporated herein by this reference. Section 3. Recording. Following adoption of this resolution by the City Commission, the City Clerk shall record same in the Official Land Records for Seminole County, Florida. Section 4. Repeal of Prior Inconsistent Resolutions. All prior inconsistent resolutions adopted by the City Commission, or parts of resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this resolution. Section 6. Effective Date. This Resolution shall take effect immediately upon adoption by the City Commission.
