SYNOPSIS: The City of Winter Springs Community Development Department has received an application for a Small-Scale Future Land Use Map Amendment and Rezoning, which if approved, would change the Future Land Use Map and zoning designation for one (1) parcel totaling 1.871 acres in size generally located southeast of the intersection of State Road 434 and Tuskawilla Road (see Attachment A - Location Map). Ordinance 2015-10 proposes to change the Future Land Use Map designation from Seminole County "Industrial" to City of Winter Springs "Town Center" (see Attachment B - Ordinance 2015-10). Ordinance 2015-11 proposes to rezone the property from Seminole County "Agriculture (A-1)" to City of Winter Springs "Town Center (TS)" (see Attachment C - Ordinance 2015-11). The request is based upon the applicants desire to add the voluntary annexed property with eight (8) adjacent acres, within the City, for a proposed senior housing development. The $15,000,000 retirement residence would be a 144-suite facility consisting of 110,000 square feet, and providing 18-24 full time positions of employment for the local community. The subject property is surrounded by vacant Town Center T4 and TS zoned property. The subject property is scheduled to be rezoned to Transect TS (Urban Center Zone) which comprises the core of the Town Center and consists of a higher intensity mix of uses such as retail, offices, and residential. First Reading of the annexation for the subject property described via Ordinance 2015-09 was presently considered by the City of Winter Springs City Commission under Item 503. REZONING ANALYSIS: The following summarizes the data and issues which Staff analyzed in reviewing this application as required by the Code of Ordinances, Section 20-31: (1) Compliance with Procedural Requirements- The proposed rezoning is in compliance with all procedural requirements established by the City Code and law. Requirements for advertising the land use action have been met. (2) Consistent with the Comprehensive Plan- The proposed rezoning change is consistent with the City's Comprehensive Plan and the proposed change will not have an adverse effect on the Comprehensive Plan. (3) Consistent with any Master Plan for the �ro�ertv- The request is based upon the applicants desire to voluntarily annex the subj ect property and add it to eight (8) acres of adjacent property, presently within the City, for a proposed 110,000 square foot senior housing development. (4) Not Contrary to the Land Use Pattern Established by the Comprehensive Plan- The proposed rezoning from Seminole County "Agriculture (A-1)" to Winter Springs "Town Center (TS)" is appropriate and compatible with the land use pattern established by the City's Comprehensive Plan. The surrounding properties have an "Town Center" future land use and zoning designation. Public Hearings 501 PAGE 3 OF 11-April 13,2015 (5) Does Not Create Spot Zonin�- The proposed rezoning does not create a spot zone, which is prohibited by law. The adjoining properties are zoned for town center development. The site is situated between the Plante Property to the south and State Road 434 to the north. The Plante Property was recently annexed and made part of the City's Town Center in 2012. The proposed zoning designation, "Town Center (TS)", is compatible with the surrounding area. (6) Does Not Materially Alter the Population Densitv Pattern- The proposed rezoning does not alter the existing developed population density pattern and therefore will not overtax the load on public facilities and services (utilities, streets, and other municipal services and infrastructure). (7) Does Not Create Illo�ically Drawn Zonin� District Boundaries- The proposed rezoning does not result in existing zoning district boundaries that are illogically drawn in relation to the existing conditions on the property and the surrounding area and the land use pattern established by the City's Comprehensive Plan. (8) Chan�ed Conditions Make the Proposed Rezonin� Necessar� The proposed zoning designation of "Town Center (TS)" is compatible with the proposed "Town Center" Future Land Use Map classification that is proposed via Ordinance 2015-10. (9) No Serious Reduction in Li�ht or Air to Adjacent Areas- The proposed rezoning will not seriously reduce light or air to adjacent areas. (10) Adverse Impact on Surroundin� Property Values- The proposed zoning designation has been determined by evaluating the prevailing character of the area around the subject property. The City of Winter Springs "Town Center (TS)" zoning designation comprises the core of the Town Center and is synonymous with the City's Urban Central Business District. It shall consist of a higher intensity mix of uses that include retail, offices, and residential. TS areas typically have fairly small blocks with wide sidewalks, regularly- spaced tree planting, and buildings set close to the street. (11) Not Detrimental to Future Improvement of Adjacent Vacant Property- The intent in the zoning of the property is to apply a zoning classification for the subj ect property that is consistent and compatible with the existing welding business and surrounding land uses. (12) Does Not Constitute a S�ecial Privile�e- The proposed rezoning does not constitute a grant of special privilege to an individual owner as contrasted with the public welfare. (13) Not out of Scale- The proposed rezoning change is not out of scale or incompatible with the needs of the neighborhood or the City. (14) Does Not Violate any Citv Land Use Re�ulations- The proposed rezoning does not violate any applicable land use regulations adopted by the City. Letters/Phone Calls In Favor Or O�osition — To date, the City has not received any letters or phone calls in favor of or in opposition to this proposal. COMPREHENSIVE PLAN AMENDMENT ANALYSIS: The following summarizes the data and issues which staff analyzed in reviewing this application: Justification for Future Land Use Designation - Through Ordinance 2015-10, the applicant is requesting the City of Winter Springs "Town Center" land use designation on Public Hearings 501 PAGE 4 OF 11-April 13,2015 the 1.871 acre parcel. The applicant has applied for the future land use amendment and rezoning in order to add the subject property to eight (8) adjacent acres for a proposed retirement residence which shall front directly onto State Road 434. The proposed development is compatible with the surrounding area, as it generally characterized by town center development patterns. Public Facilities: ROAD S/TRAFFIC CIRCULATION: The subject property is part of the old rail right-of-way which has since been abandoned. Availabilitv of Access: The proposed retirement residence will front directly onto the four (4) laned State Road 434. Function Classification: The subject property is part of the old rail right-of-way which has since been abandoned. POTABLE WATER: The City has an existing 12-inch City water main in Tuskawilla Road, located approximately 500-feet west of the subj ect parcel. A utility easement from the adj acent property owner(s) west of the subject parcel is required in order to provide direct access to the existing City water main. WASTEWATER The City has an existing 8-inch City force main located at the south side of SR 434, just west of the trail bridge. A lift station will be required as part of the retirement proj ect. RECLAIMED WATER: Facilities serving the subject property: None currently. ELECTRIC SERVICE: Facilities serving the subject property: None currently. The City of Winter Springs is serviced by Duke Energy for electric service. A future land use change will not impact current electric rates. SOLID WASTE: Facilities serving the subject property: None currently. The City of Winter Springs currently has a franchise agreement and is serviced by Waste Pro of Florida, Inc., a private solid waste contractor who will provide service to this area. STORMWATER MANAGEMENT: Facilities serving the parcels: None currently. POLICE: The City of Winter Springs is responsible for police protection. The station closest in proximity to the subject property is located at 300 N. Moss Road. Response times are averaged monthly. Public Hearings 501 PAGE 5 OF 11-April 13,2015 FIRE: Seminole County is responsible for fire protection. Station 26, located at 850 Northern Way, Winter Springs, Florida is the closest fire station. The response time is approximately two minutes. NUISANCE POTENTIAL OF PROPOSED USE TO SURROUNDING LAND USES: The change in designation from Seminole County "Industrial" to City of Winter Springs "Town Center" will not result in any nuisance potential for the surrounding properties because proposed uses are compatible with the "Town Center" future land use designation, and the subject property is surrounded primarily by industrial development. NATURAL RESOURCES COMPATIBILITY: There are no conservation overlays on the subject property. SOILS The subject property consists of Tavares-Millhopper fine sands, 0 to 5 percent slopes. The Millhopper series consists of soils that are moderately well drained (see Attachment E - Soils Map). FLOOD PRONE AREAS The property is located entirely in Flood Zone "X", which is outside of the 100-year floodplain, according to the FEMA Flood Insurance Rate Map (see Attachment F - Flood Zone Map). HISTORIC RESOURCES No known historical resources are located on the subject property or within the vicinity of the subj ect property. WILDLIFE: There is no evidence of wildlife currently occupying the subject parcels. An environmental assessment will be required to be submitted and approved by the City during the review of the Final Engineering Plans. CONSISTENCY WITH THE COMPREHENSIVE PLAN Future Land Use Element The Town Center is generally centered around the intersection of State Road 434 and Tuskawilla Road. Per the Comprehensive Plan, the Town Center encourages higher intensity development in the Town Center subj ect to the Town Center District Code. The TS (Urban Center Zone) comprises the core of the Town Center and is synonymous with the City's Urban Central Business District. It shall consist of a higher intensity mix of uses that include retail, office, group homes, and residential. The proposed future land use amendment is consistent with the Comprehensive Plan. The proposed future land use amendment is consistent with the following objectives and policies from the Future Land Use Element of the Comprehensive Plan: 1. Policy 1.3.4 - Requires the City to support proposed future land use map amendments with data and analysis demonstrating that adequate water supplies and associated public Public Hearings 501 PAGE 6 OF 11-April 13,2015 facilities will be available to meet the proj ected growth demands. Response: Adequate water supplies and associated public facilities are available to meet the projected growth demands. City water and sewer service is available to serve this property and the City has sufficient capacity to serve the proposed retirement project. For water, the closest point of connection is an existing 12-inch City water main in Tuskawilla Road, located approximately 500-feet west of the subject parcel. A utility easement from the adj acent property owner(s) west of the subj ect parcel is required in order to provide direct access to the existing City water main. For sewer service, the closest point of connection is an existing 8-inch City force main located at the south side of SR 434, just west of the trail bridge. A lift station will be required as part of the retirement proj ect. 2. Policy 1.4.2: Higher Density Infill. Encourage the efficient use of land with compatible infill and higher density and intensity development within the Town Center and the U.S. 17- 92 CRA Corridor. Higher density development shall be directed to the CRA to promote revitalization of underutilized property through redevelopment and reinvestment with access to the existing fixed transit route, which provides critical connection with SunRail. Minimize adverse impacts to adjacent established residential neighborhoods through site layout, orientation of buildings, and a transition of densities. (Cross Reference: See Housing Element, Policy 1.1.8) (Ord. 2010-18; 10-25-10) Response: The requested Small Scale Plan Amendment establishes basic entitlements for a proposed 144-suite senior retirement residence. 3. Policy 1.7.1 - requires the City to consider existing and proposed land uses in adjacent jurisdictions when reviewing proposed land use amendments. Response: The subject site, as it currently exists, is an enclave surrounded by the City of Winter Springs. 4. Policy 1.8.2 - requires the City to annex all enclaves, where feasable, in order to reduce land use conflicts and provide public service. Response: The subject, site as it currently exists, is an enclave surrounded by the City of Winter Springs. 5. Policy 2.2.2: T�ariety of Places. Promote and permit a variety of places to gather, shop, relax, recreate and enj oy the natural beauty of the Town Center. Choose sites for public spaces because of their uniqueness or existing physical features. Response: The request seeks to establish a "Town Center" land use designation for property set aside for the City's first retirement residence. 6. Policy 2.2.4: Mixed Uses. Permit a variety of mixed uses consistent, compatible, and in harmony with the Town Center Goal and the Town Center District Code, including single family residential, multiple family residential, commercial retail and services, public services and buildings, parks, and schools, through the enactment of creative and flexible land development regulations. (Ord. 2012-OS) Public Hearings 501 PAGE 7 OF 11-April 13,2015 Response: The request seeks to establish a "Town Center" land use designation for property set aside for the City's first retirement residence. 7. Policy 2.2.8: Intensity. Encourage higher intensity development in the Town Center subj ect to the Town Center District Code. (Ord. 2012-OS) Response: The request seeks to establish a "Town Center" land use designation for property set aside for the first retirement residence within the City. The proposed retirement residence is a 144-suite facility that is projected to be four (4) stories in height. The plans will further complement the town center vision by continuing the constrained roadway concept in which buildings are placed up to the street with associated parking to the rear. 8. Policy 2.3.3: Fiscal Impacts of Development. Ensure that City policies, regulations, and decision making processes not only consider Town Center design planning impacts, but also consider whether proposed new development will have a positive and acceptable economic and fiscal impact on the City. In furtherance of this policy, the City Commission shall require (unless otherwise exempted by land development regulation), as a condition of considering the approval or denial of a development proj ect, that developers provide a written economic and fiscal impact report, prepared by a duly qualified expert, that details the associated economic and fiscal impacts of any proposed new development project on the City and the School District. Although the City recognizes that some projects will have a regional economic and fiscal impact as well, said report shall predominantly address the economic and fiscal impacts on the Town Center and the City of Winter Springs as its own economic system. The economic impact analysis portion of the report shall address the impacts of the proposed project on jobs, economic output, and wages. The fiscal impact analysis portion shall pertain to the net fiscal impact of the project over a period of years which is the sum of those revenues (such as ad valorem taxes, public service taxes, sales taxes, and charges for service) directly received by the City minus the sum of expenditures incurred by the City (such as general government expenses, law enforcement, roads, and parks and recreation). (Ord. 2012-OS) Response: A Fiscal Impact Report will be provided as part of the development application. 9. Policy 2.3.4: Compatibility and Optimization of Tax Base. For purpose of determining whether a project has a positive and acceptable economic and fiscal impact on the City pursuant to Policy 2.3.3, the developer shall be required to demonstrate through its written economic and fiscal impact report that the projectis in compliance with the following obj ective criteria: (1) The proposed project and associated land use is not only a permitted use within the applicable zoning transect, but is also compatible under existing conditions (existing, permitted, or master-planned development) at the proposed location with other adj acent or nearby land uses within the Town Center and any established surrounding neighborhoods. (2) The market demand for the proposed project is at least minimally feasible based on current market data including, but not limited to, data set forth in any economic development study conducted by the City. (3) Provided said project is first deemed compatible from a land use perspective under criteria (1) and market demand is deemed minimally feasible under criteria(2), the proposed project optimally increases and diversifies the City's tax base and economic well- being. With respect to the phrase "optimally increases," the proposed project's economic and fiscal impact shall be required to be the best result obtainable for the City under current Public Hearings 501 PAGE 8 OF 11-April 13,2015 economic and land use conditions. In furtherance of determining consistency with this provision, the developer's written economic and fiscal impact report shall analyze and compare the proposed proj ect to either the City's preferred proj ect or proj ects for the subj ect location as may be expressly set forth in the City's Town Center Master Plan or economic development study conducted pursuant to Policy 2.3.2, or if the plan or study does not so expressly provide, to a reasonable array of other potential alternative compatible proj ects authorized in the applicable zoning transect for the subj ect proj ect location. Furthermore, the term "diversifies" means the extent that the proposed proj ect reduces the City's reliance upon a residential tax base to fund the City's fiscal budget. Additionally, if the proposed proj ect is a commercial proj ect, the extent that the proposed proj ect also provides different and needed services and jobs to the Town Center and the City. Response: A Fiscal Impact Report will be provided as part of the development application. 10. Policy 2.3.7: Quality of Life. Strive to improve the quality of life of Winter Springs" residents by encouraging an increased number and variety of thriving commercial businesses that are supported and complimented by high-end residential projects located in the Town Center. Response: The proposed 144-suite retirement residence will support and compliment existing town center development. In addition, this facility will provide an option for City residents who want to "age in place". 11. Policy 1.1.4: Encourage the development/redevelopment of property that will integrate diverse choices of housing. Response: The proposed retirement residence will be the first of its kind within the City and thereby integrate diverse housing choices therein. 12. Housing Element: Household Characteristics: The City`s need for elderly housing, including assisted living facilities, is expected to generally increase based upon Shimberg projections. There are a number of programs and approaches the City may encourage or implement to achieve the goal of providing housing options to support the aging population. Options may include: Assisted Living - a term used to reference the housing arrangement for people who are able to continue to live on their own and do not require full time medical care but need assistance in taking care of daily activities such as, personal care, cooking, and/or assistance with housekeeping, etc. ALFs are residential communities that are equipped with supportive, personal and health care services (nonmedical) and encompass a variety of living arrangements such as continuing care, group homes or in one`s own home. Types of ALFs include: . Adult Family Care Homes - single family homes in which room and board, supervision and personal care services are provided to no more than five adult residents at a time. . Continuing Care Retirement Communities - private home communities that offer active seniors a variety of resources in which to socialize and enjoy their golden years. This option allows elders the opportunity to purchase services, amenities and future medical care, at the same time that their home in the community is purchased. Senior Apartment Complexes - private apartment communities, which provide limited communal services, such as activity programs, transportation services and evening meals to its residents. Owners of these housing complexes usually only rent to individuals that are 55 years old or older, often targeting the younger, independent and more active seniors. . Nursing Homes - long-term care facilities that provide 24-hour medical and personal care, housekeeping services and rehabilitative services to seniors who are suffering from chronic illnesses, recovering after major surgery or who are physically weak and unable to live on their own. Response: The Winter Springs Retirement Residence is a 144-suite facility for seniors. The senior housing concept is designed for those who are still ambulatory, but in need of some support. Private rooms afford the advantages of independent living while the services included provide support, security, and friendship. The private suites include studios, one and two bedroom versions. Each is similar to a conventional dwelling unit except a kitchen is not included. The square footage of suites varies from a minimum of 350 square feet for smaller studios to over 1000 square feet for larger two bedrooms. Services include three meals a day, housekeeping, laundering, private bus transportation, and various activities. FINDINGS: 1. The request is consistent with all applicable goals, objectives and policies of the City's adopted Comprehensive Plan. 2. The request is in conformance with the purpose and intent of the City Code and with all applicable requirements. 3. Considering the type and location of uses involved and the general character of the area, the change of the FLUM designation will not result in any incompatible land uses, including such factors as height, bulk, scale, intensity, traffic, noise, drainage, dust, lighting, appearance, and other factors deemed important. 4. The request is consistent with Florida Statute Chapter 163, Part II, of the Florida Statutes. FISCAL IMPACT: The proposed Small-Scale future land use amendment, which re-designates the property from Seminole County "Industrial" to City of Winter Springs "Town Center", will increase the possibility of additional taxable value to the City and potentially spur the increase of future residential, commercial and/or office development activity within this particular area. The request is based upon the applicants desire to add the voluntary annexed property with eight (8) adj acent acres, within the City, for a proposed senior housing development. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. Pursuant to Florida Statutes 171.044 (6), the Seminole County Board of County Commissioners was sent via Certified Mail the notice of annexation for the subject property on February 6, 2015 (see Attachment G, Seminole County Commissioners Notification Letter). Adjacent property owners have been notified by US mail noting the date and time of the public hearing has been erected on the subject property. Lastly, the proposed Ordinances were advertised in the Orlando Sentinel on March 12, 2015 and March 19, 2015 (see Attachment H, Orlando Sentinel Advertisement). RECOMMENDATION: The Community Development Department — Planning Division requests that the City Commission approve second reading of both the Small-Scale Future Land Use Map Amendment and Rezoning for approximately 1.871 acres located southeast of the intersection of State Road 434 and Tuskawilla Road as described within Ordinances 2015- 10 and 2015-11. WHEREAS, the future land use map amendment embodied in this Ordinance is a small scale amendment to the City of Winter Springs Comprehensive Plan in accordance with Section 163.3187(1), Florida Statutes; and WHEREAS, the Local Planning Agency of the City of Winter Springs held a duly noticed public hearing on March 4, 2015, in accordance with the procedures established in Chapter 163, Part II, Florida Statutes, on the proposed comprehensive plan amendment; and WHEREAS,the City Commission of the City of Winter Springs held a duly noticed public hearing on the proposed amendment set forth hereunder and considered findings and advice of staff, citizens, and all interested parties submitting written and oral comments and supporting data and analysis, and after complete deliberation, hereby approves and adopts the Comprehensive Plan Amendment set forth hereunder; and WHEREAS, the City Commission of the City of Winter Springs hereby finds that this Ordinance is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. City of Winter Springs Ordinance No. 2015-10 Page 1 of 3 NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS,AS FOLLOWS: Section 1. Recitals. The foregoing recitals are true and correct and are fully incorporated herein by this reference. Section 2. Authority. This Ordinance is adopted in compliance with, and pursuant to, the Community Planning Act, formerly known as the Local Government Comprehensive Planning and Land Development Regulations Act. Section 3. Purpose and Intent. It is hereby declared to be the purpose and intent of this Ordinance to clarify, expand, correct, update, modify and otherwise further the provisions of the City of Winter Springs Comprehensive Plan. Section 4. Adoption of Amendment to the Future Land Use Map. The City of Winter Springs Comprehensive Plan, Future Land Use Map, is hereby amended by changing the designation of the real property legally described and depicted on Exhibit "A" from Seminole County "Industrial" to City of Winter Springs "Town Center". Exhibit "A" is attached hereto and fully incorporated herein by this reference. Section 5. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 6. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction,whether for substantive,procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance. Upon the effective date of the Comprehensive Plan Amendment adopted by this Ordinance, said Amendment shall be incorporated into the City of Winter Springs Comprehensive Plan and any section or paragraph number or letter and any heading may be changed or modified as necessary to effectuate the foregoing. Section 8. Effective Date and Legal Status of the Plan Amendment. The effective date of this Ordinance shall take effect thirty-one (31) days after adoption, in accordance with Section 163.3187(5)(c), Florida Statutes, unless challenged within thirty (30) days after adoption of this Ordinance, in which case this Ordinance shall become effective at such time as the state land planning agency or the Administrative Commission issues a final order determining that the adopted small scale development amendment is in compliance. No development orders, development permits, or land use dependent on this Amendment may be issued or commenced before it has become effective. After and from the effective date of this Amendment, the Comprehensive Plan Amendment set forth herein shall amend the City of Winter Springs Comprehensive Plan and become a part of that plan and the Amendments shall have the legal status of the City of Winter Springs Comprehensive Plan, as amended. City staff is hereby directed to promptly amend the City's Official Zoning Map upon the effective date of this Ordinance. In addition, upon adoption and full execution of this Ordinance by the City Commission, the City Clerk is hereby directed to record this Ordinance in the Official Records of Seminole County, Florida. This Ordinance shall run with the land. Section 4. Repeal of Prior Inconsistent Ordinances and Resolutions.
