SYNOPSIS: The agenda item is needed for the City Commission to review the current construction cost estimate for the Magnolia Park Amphitheater and provide direction on whether to propose increased funding options in the forth coming budget or direct staff to bring back for reconsideration aspects of the project which could bring the project within current budget. CONSIDERATIONS: The final engineering and aesthetic review for Magnolia Park was originally approved by the City Commission on March 22, 2010 and subsequently extended twice for one year periods on March 14, 2011 and April 9, 2012. A copy of the approved 2010 agenda item is attached. The current projected bid date for the Amphitheater is November 2015 assuming the Governor and Cabinet approve the project around September 2015. An updated timeline of the Magnolia Park and Cross Seminole Trail projects is also attached. In anticipation of the project potentially moving forward, staff requested that the architect update the estimated construction cost estimate and the current estimate came back at $1.46M (million) plus the $106K land acquisition cost for a total of $1.57M. The Regular 602 PAGE 1 OF 3 - March 23, 2015 previous estimate in 2010 was $1.112M with no anticipated land acquisition costs. Copies of both estimates are attached. The largest increase was in the building construction costs ($200K +) due to construction costs increasing in the last 18 months. No changes to the building amenities or site plans were made between the two estimates. Both estimates include an extensive sound system and theatrical lighting which obviously could be revisited if cost cutting options were desired. The current FY15 budget is $1.219M which consists of $300K from 2nd Gen One Cent Sales Tax and the remaining funds from a previously issued construction bond plus interest. The construction of the Magnolia Park Amphitheater is dependent on the City receiving a warranty deed from the State conveying to the City approximately 0.44 acres of adjacent trail right of way to the City. This adjacent trail right of way is needed because the amphitheater building encroaches into the State's trail right of way. This encroachment will allow maximum utilization of this facility given the constraints of the site. The City appraised the 0.44 acres in 2014 at $106K and adopted Resolution 2014 -03 as requested by the State agreeing to tentatively purchase the property at the appraised value. The purchase is still bundled with the land swap between Bart Phillips and the State for the completion of the Cross Seminole Trail. The State should be completing appraisals for those parcels within 90 days which will then allow the preparation of the land exchange agreements that ultimately go to the Governor and Cabinet, optimistically in September 2015. FISCAL IMPACT: This project is budgeted at $1.219M in FY15. The construction cost estimate as of January 2015 is $1.46M plus the $106K for the land acquisition. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends the City Commission review the information provided regarding the Regular 602 PAGE 2 OF 3 - March 23, 2015 Magnolia Park Amphitheater final engineering and aesthetic review and the current estimated costs, and give staff direction on whether to investigate options to increase the funding in the upcoming budget or bring back for reconsideration aspects of the project which could bring the project within current budget. Attachment No. 1 CONSENT INFORMATIONAL PUBLIC HEARING REGULAR X MGR k /DEPT Authorization REQUEST: The Public Works Department requesting the City Commission review the Final Engineering and Landscape Plans for the proposed Magnolia Park Amphitheater located at the intersection of Tuskawilla Road and Blumberg Boulevard in the Winter Springs Town Center. SYNOPSIS: The Final Engineering and Landscape Plans for the proposed Magnolia Park Amphithea4er have been reviewed and approved by all applicable City Departments and by the Seminole County Fire Marshal, and the plans are now being submitted to the City Commission for review and approval. CONSIDERATIONS: • The City Commission approved the Concept Plan for the proposed Magnolia Park Amphitheater at the January 26, 2009 City Commission Meeting. • At the April 13, 2009 City Commission meeting, the Commission reviewed the preliminary design development plans and provided feedback on a number of design issues, including (see attached meeting minutes): o Seating: ■ The fixed seating area will have individual seats with arm rests. ■ The open seating area will be grassed with concrete paver walkways as shown on the site plan. o Sound system: speakers o Lighting system: walkways to be lit with acorn lights similar to those on Blumberg Boulevard o Bike Rack: a large bike rack has been added adjacent to the trail. o Trailhead amenities: restrooms and drinking fountains will be available to trail users (no concession sales) o Other park amenities: the project does not include a skate park or splash pad. Regular Agenda Item #600 March 22, 2010 Page 2 of 3 SITE ACCESS: The site is located on the east side of Tuskawilla Road at the eastern terminus of Blumberg Boulevard in the Winter Springs Town Center. The site can be accessed by vehicle from either Tuskawilla Road or Blumberg Boulevard. The site is also accessible to bicyclists and pedestrians from the Cross - Seminole Trail, which is immediately adjacent to the back of the amphitheater building. Pedestrian access is also available from the existing sidewalk network within the Winter Springs Town Center. • PARKING: Parking for events at the amphitheater is available at the following locations: o On- street parking: ■ Tuskawilla Road (69 spaces) ■ Blumberg Boulevard (55 spaces) ■ Doran Drive (19 spaces) o Town Center Phase I Development (approx. 547 onsite spaces) o Temporary Parking east of Tuskawilla Road (approx. 50 spaces) o Winter Springs High School (up to 600 spaces) The amphitheater contains approximately 238 fixed seats plus lawn seating which can comfortably accommodate an additional 250 patrons. A major performance would be expected to have approximately 75 stage performers and support workers. Including all patrons, stage performers, and support workers, a major performance could have a total attendance of 550 -600 people. According to Walker Parking Consultants, special events can be expected to have an average of 2.2 persons per vehicle. Based on this average, a major event would need up to approximately 275 parking spaces. A total of 740 parking spaces are located within % mile of the amphitheater. The availability of these parking spaces depends on the date /time of the event, other ongoing activities at the Town Center, and in some cases the willingness of businesses to allow special event parking at their facilities. Overflow parking of up to approximately 600 spaces is available at Winter Springs High School. The availability of this overflow parking also depends on the ongoing activities at the school. Future development on the east side of Tuskawilla Road is expected to provide additional public and private parking facilities that could be used for special events. A total of four (4) handicapped parking spaces will be provided on Tuskawilla Road, immediately to the south of the amphitheater. There are two (2) existing handicapped parking spaces at this location, and three (3) standard spaces will be converted to handicapped spaces as part of the amphitheater project. Additional handicapped parking could be added at a later date if necessary by converting additional standard spaces to handicapped along Tuskawilla Road. • WATER, SEWER, & FIRE PROTECTION: The amphitheater building will connect to City water and sewer facilities, which are available in Tuskawilla Road adjacent to the site. The restrooms at the amphitheater building will be available to amphitheater patrons and trail users. A fire hydrant will be installed just to the north of the building and will be Regular Agenda Item #600 March 22, 2010 Page 3 of 3 accessible from the Cross - Seminole Trail. An unpaved fire -truck turn- around area is provided off the trail immediately south of the building. • STORMWATER: Stormwater will be collected onsite and discharged into a proposed dry detention pond located north of the site and along the west side of the Cross - Seminole Trail. Overflow from the proposed dry pond discharges across the trail to the existing wetlands on the east side of the trail through an existing culvert pipe. FISCAL IMPACT: No funding is requested with this agenda item. After the trail swap progresses, the project will be advertised for bidding and a future agenda item will be submitted for the City Commission's approval to award the construction contract. COMMUNICATION EFFORTS: No extra communication efforts are necessary at this time. RECOMMENDATION: Staff recommends the City Commission approve the Final Engineering and Landscape Plans for the proposed Magnolia Park Amphitheater. ATTACHMENTS: 1. Commissioner McGinnis noted, "Good" Commissioner Brown added, "Individual seats." Mayor Bush asked, "Individual seats Commissioners ?" Commissioner Hovey remarked, "Yes." Deputy Mayor Krebs said, "Yes." Commissioner Bonner was asking whether seats should be numbered. Mr. Starmer explained, "They come with those tags at no additional cost." Mayor Bush added, "I think we have Consensus on the chair seats." The bermed area was then discussed for other open seating and Mr. Starmer noted, "Our recommendation at this point will also be to have just berm seating, not to introduce these individual walkways." Deputy Mayor Krebs stated, "Good idea." Commissioner McGinnis remarked, "Good." No objections were voiced. A sound system for City use was then addressed, to which Commissioner McGinnis noted, "We are accommodating in the back of this for people to sit and enjoy a venue, but there would be no speakers ?" Mr. Starmer stated, "Not at this point." Commissioner McGinnis then recommended, "If we could build that in, in the beginning to accommodate that, it just seems to make sense" Mr. Starmer noted, "That's good input and we can pursue that. That is not a problem." Deputy Mayor Krebs stated, "I definitely agree that we should have it. This is Magnolia Square - I think we should have it. If you could build that in." Mr. Starmer explained, "We're talking about seating out in this area that's in the berm area, that doesn't really have speaker systems because the speakers here are really limited maybe to this front fixed seating area; and I think the suggestion was could we put some speakers back here that would support people sitting out in that larger open berm seating area." I think you lease those —just to have that continuity so it comes down into the park." Mr. Starmer added, "That would be our recommendation." Commissioner Bonner asked Mr. Lockcuff, "I assume you support that recommendation ?" Mr. Lockcuff stated, "Yes — they typically want to stay in the right - of -ways, so once we get on private property you have got to grant Easements and whether we want to do all that is another issue. But, either way, even if we owned the lights we would match them is what you are saying, right ?" Mr. Starmer noted, "We will bring up with Staff and play with those pros and cons." In discussing materials for a roof, Mr. Starmer suggested either a plastic or Tencel® product - "We will probably wind up with a hard glass lens over that." Further brief comments. Mr. Starmer explained, "We have talked about Magnolia Park — we have talked about a lot of things. We've talked about interactive fountains; we've talked about the skate park. I want it clear that what we are designing is the amphitheatre and this particular project doesn't include that skate pond or the interactive fountain — we pulled that out." With further comments, Commissioner McGinnis suggested that "family" restrooms be considered. Discussion. Commissioner Bonner asked, "Does the design take into consideration the potential for a large number of bicycles to be at the location at one time ?" Mr. Starmer stated, "We don't really have a bike rack included. We could do that." Mayor Bush stated, "Good idea." Deputy Mayor Krebs added, "We have to have that." With comments on the budget for this project, Mr. Starmer noted, "When we give you a Budget, we're giving you your Permit Fees, we're putting your design costs in there." Commissioner McGinnis stated, "Good job."
