HomeMy WebLinkAbout2015 03 09 Consent 301 Specimen Tree Removal 1130 ODay DriveCOMMISSION AGENDA ITEM 301 REQUEST: Informational Consent X Public Hearings Regular March 09, 2015 KS BF Regular Meeting City Manager Department The Public Works Department, Urban Beautification Division, requesting that the City Commission deny the request of Ms. Judy Alonso - Slusarz to remove one (1) specimen oak tree from her property at 1130 O 'Day Drive. SYNOPSIS: Ms. Judy Alonso - Slusarz has applied for a permit to remove one 31 -inch diameter specimen oak tree from her property at 1130 O' Day Drive. Based on Staff s review, the specimen tree is healthy and does not meet the Arbor Ordinance criteria warranting removal of a specimen tree. CONSIDERATIONS: Ms. Judy Alonso - Slusarz recently applied for an Arbor Permit to remove one (1) 31 -inch diameter oak tree from her property at 1130 O'Day Drive (see Attachment A for photos). Ms. Alonso - Slusarz has expressed concerns about the proximity of the tree to her house and driveway. She has replaced her driveway in the past and currently has a driveway consisting of brick pavers. The specimen oak tree was assessed by the Urban Beautification Coordinator on February 13th, 2015. The tree is within 10 -feet of the applicant's house and driveway. The tree roots have slightly uplifted a small section of the brick paver driveway; however, the driveway is not damaged and the tree is in good health. There are no signs of structural damage or decay of the tree, as well as the tree appears to have been properly trimmed over the years giving the tree increased light flow and air penetration. In addition, there is no evidence that the tree roots are causing any damage to the house. Consent 301 PAGE 1 OF 2 - March 09, 2015 Section 5 -8 (b) of the Arbor Ordinance provides that a specimen tree shall not be removed except for extraordinary circumstances, hardships, and only by approval of the City Commission. Based on Staff s review, the 31 -inch diameter oak tree at 1130 O'Day Drive does not meet the criteria warranting removal of the specimen tree. The slight uplift of the driveway due to a tree root is a common situation that does not qualify as an extraordinary circumstance warranting removal of the specimen tree. FISCAL IMPACT: If the City Commission decides to approve the removal of the specimen tree, the applicant will pay a $25 arbor permit fee to the Arbor Fund (I 10) and be required to install (4) replacement credits worth of trees. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission deny the request of Ms. Judy Alonso- Slusarz to remove a specimen oak tree from her property at 1130 O'Day Drive.
