HomeMy WebLinkAbout2015 03 09 Consent 300 Specimen Tree Removal 910 Antelope TrailCOMMISSION AGENDA ITEM 300 REQUEST: Informational Consent X Public Hearings Regular March 09, 2015 KS BF Regular Meeting City Manager Department The Public Works Department, Urban Beautification Division, requesting the City Commission approve the request of Ms. Laura Lyons to remove two (2) specimen sycamore trees from her property at 910 Antelope Trail. SYNOPSIS: Ms. Laura Lyons of 910 Antelope Trail has applied for a permit to remove two specimen sycamore trees from her property. Staff supports the request due to the likelihood that the tree roots could cause damage to the nearby house and /or fence in the future. CONSIDERATIONS: Ms. Laura Lyons of 910 Antelope Trail recently applied for an Arbor Permit to remove one (1) 26 -inch and one (1) 28 -inch sycamore tree located on her property. Ms. Lyons has expressed concerns about the two specimen sycamore trees causing damage to her property due to the size and proximity of the trees to Ms. Lyons' house. Section 5 -8(b) of the Arbor Ordinance provides that a specimen tree shall not be removed except for extraordinary circumstances, hardships, and only by approval of the City Commission. On February 11, 2015, the Public Works / Utility Director and the Urban Beautification Coordinator performed an onsite assessment of the trees. Based on Staffs onsite review and additional review of pictures and other pertinent information, Staff determined that both sycamore trees have the potential of causing damage to Ms. Lyons' home foundation. Staff is therefore recommending approval to remove both Consent 300 PAGE 1 OF 2 - March 09, 2015 specimen trees as an extraordinary circumstance or hardship as referenced in Section 5 -8(b) of the Arbor Ordinance. FISCAL IMPACT: If this request is approved, the applicant will pay a $35 arbor permit fee to the Arbor Fund (110) and be required to install (8) replacement credits worth of trees. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission approve the request of Ms. Laura Lyons to remove two (2) specimen sycamore trees from her property at 910 Antelope Trail.
