SYNOPSIS: On October 1, 2014, the owner of property located at 725 Bear Creek Circle submitted a building permit application for the extension of an existing screen enclosure for a swimming pool. Upon review of the building permit application, it was determined by the Public Works Department that the extension of the screen enclosure would be over a portion of a platted greenbelt, drainage and utility easement. Per Section 6-86 (d) of the Code of Ordinances, screen enclosures cannot be permitted within an easement area unless the easement expressly allows said construction. It was conveyed to the applicant that they could petition the City Commission to vacate a portion of the easement to permit the construction of the screen closure over the easement if they still wanted to extend the screen enclosure as proposed. Resolution 2015-07 proposes vacation of a 3,071 square foot portion of the platted greenbelt, drainage, and utility easement in order to permit construction of the extension of the existing screen enclosure. City Liens (if any): No known liens The plat for Bear Creek Estates was approved by the City Commission in 1982. Along the rear portions of lots 13-36 there is a platted greenbelt, drainage and utility easement. The applicant is the owner of lot 17. Located on the rear of this lot is the platted portion of this easement. According to a survey of the property provided by the applicant that is dated 2006, there are several structures and improvements that have been constructed in the easement area. These include a brick bar-b-que, a three-foot (3') and six-foot (6') high metal fence, three brick pads measuring 15.2-feet by 17.7-feet, 13.9-feet by 18.2-feet, and 36.3-feet by 11.1-feet respectively and a concrete slab. The applicant purchased the home in 2012 and was not responsible for the construction of these improvements. The proposed extension of the screen enclosure is for construction over a portion of the concrete slab and the entire brick pad that measures 36.3-feet by 11.1-feet. There will be no additional impacts to the easement area as a result of the vacation of this portion of the easement. The applicant has obtained letters of approval from applicable utility providers including the City of Winter Springs, Bright House Networks, and Duke Energy. Vacation of the 3,071 square foot portion of the easement to permit construction of the extension of the screen enclosure does not impact any necessary facilities or require the removal of any trees. FISCAL IMPACT: There is no fiscal impact associated with this agenda item.
