SYNOPSIS: Seven Oaks is a 138 -unit single- family residential subdivision by Meritage Homes located on the south side of Shepard Road, north of Florida Avenue, and east of Boat Lake. A plat for the subdivision was approved by the City Commission in November 2013 and the subdivision is under construction. This item is for a replat of five lots adjacent to Boat Lake. CONSIDERATIONS: LAND USE & ZONING Zoning: Planned Unit Development (PUD) Future Land Use: Medium Density Residential APPLICABLE REGULATIONS Chapter 177, Florida Statutes Chapter 197, Florida Statutes Chapter 9, City Code Seven Oaks is a 138 -unit all single - family subdivision currently under construction by Meritage Homes located south of Shepard Road, north of Florida Avenue, and east of Boat Lake. Final Engineering for Seven Oaks was approved by the City Commission at the August 26, 2013 Commission meeting and a plat for the subdivision was approved at the November 18, 2013 City Commission meeting. Sitework construction commenced in September 2013 and new home construction has been in progress since May 2014. Consent 309 PAGE 1 OF 3 - January 26, 2015 This agenda item is for the replat of lots 8, 9, 12, 13, and 14 located along the western side of the subdivision adjacent to Boat Lake. Meritage Homes owns a parcel of land west of these lots and is seeking with this replat to extend the lot sizes for lots 8, 9, 12, 13, and 14 and provide direct access to Boat Lake. The lands being added to increase the lot sizes has limitations on the buildable area due to the presence of a recorded conservation easement due to wetlands along the Boat Lake shoreline, plus the 100 -year floodplain limits surrounding Boat Lake. The area immediately behind lots 10 and 11 are not included in this replat because these two lots have already been sold. Meritage Homes intends to pursue a replat of lots 10 and 11 at a future date that would extend the lot sizes for lots 10 and 11 in a similar manner as shown for lots 8, 9, 12, 13, and 14. Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various sections) and Chapter 177, Florida Statutes. Chapter 177, Florida Statutes require that the plat be fully executed by the owner(s) of record, by all mortgagees having an interest in the land to be subdivided, by the professional surveyor and mapper of record, and by the independent professional surveyor and mapper who reviews the plat for consistency with Chapter 177, Florida Statutes. City Staff including the City's independent surveyor, Southeastern Surveying and Mapping Corporation, have reviewed the plat and have no outstanding review comments, except that the legal description in the title opinion letter must be revised to match verbatim the legal description on the face of the replat. FISCAL IMPACT: There is no fiscal impact associated with this agenda item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends the City Commission approve the Seven Oaks Two replat, subject to the provision of the revised title opinion letter, and authorize the City Manager and City Consent 309 PAGE 2 OF 3 - January 26, 2015 Attorney to prepare and execute any and all applicable documents.
