HomeMy WebLinkAbout2014 12 08 Consent 302 Specimen Tree Removal Lido RoadCOMMISSION AGENDA ITEM 302 Informational Consent X Public Hearings Regular December 08, 2014 KS KL Regular Meeting City Manager Department REQUEST: The Public Works Department, Arbor Division, asks that the City Commission approve the request of Jessica Samaroo to remove (1) specimen sweet gum tree from her property at 110 Lido Road. The resident has expressed concern due to damage the tree roots have caused to her house. SYNOPSIS: Jessica Samaroo of 110 Lido Road has applied for a permit to remove (1) 28" sweetgum tree that has caused significant damage to the screened porch of her house. The roots of the tree are visible above ground and are growing against the slab of the screen porch. The walkway entering the screen porch has been lifted by the roots, preventing the screen door from opening. Section 5 -8 (b) of the Arbor Ordinance provides that a specimen tree shall not be removed except for extraordinary circumstances, hardships, and only by approval of the City Commission. CONSIDERATIONS: The tree was assessed by the City Arborist and Urban Beautification Coordinator on November 5th, 2014. The tree is within 10' of the house and has caused damage to the foundation of the screen porch and the walkway entering the screen porch. The walkway has been lifted so that the door to the screen porch can't be opened. FISCAL IMPACT: If this request is approved, the applicant will pay a $25 arbor permit fee to the Arbor Fund (110) and be required to install (4) replacement credits worth of trees. Consent 302 PAGE 1 OF 2 - December 08, 2014 COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission approve the request of Jessica Samaroo to remove (1) specimen sweet gum tree from her property at 110 Lido Road. The resident is concerned with the proximity of tree roots to the home and the damage to the screen porch. Staff finds the existing damage to the screen porch as an extraordinary circumstance or hardship as referenced in Section 5 -8(b) of the Arbor Ordinance.
