Retail Sale of Dogs and Cats. (a) Except as provided in sections 20-234, 20-254, 20-346.3, or 20-359 of this Code, no pet store shall display, sell, trade, deliver, barter, lease, rent, auction, give away, transfer, offer for sale or transfer, or otherwise dispose of dogs or cats in the City. This section shall not apply to the following: (1)A person or establishment that sells, delivers, offers for sale, trades, barters, leases, rents, auctions, gives away or otherwise transfers or disposes of dogs and/or cats that were bred and reared on the premises of the person or establishment. (2)An animal shelter. (3)An animal rescue organization. (4)An animal shelter or animal rescue organization that operates out of or in connection with a pet store. (5)Licensed veterinary doctors that have dogs or cats in his or her custody and control solely for the purpose of providing medical care and attention. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this Ordinance and the City Code may be freely made. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 6.Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter. Mr. Howell presented the Agenda Item and gave a brief history and description, and mentionedthat the goal was to encourage and provide an enhanced property development in the State Road 434 Corridor. Chairperson Henderson asked if five (5) stories were permitted in the Re-Write ofthe State Road 434 Corridor Vision Plan.Mr. Howell confirmed by stating, “Five (5) stories is consistent with most of the Town Center.” Furthermore, Mr. Howell also noted that five (5) stories add more flexibility when it comes to the design process.
