HomeMy WebLinkAbout2014 11 17 Consent 300 747 Sybilwood Circle Specimen Tree RemovalCOMMISSION AGENDA ITEM 300 Informational Consent X Public Hearings Regular November 17, 2014 KS RS Regular Meeting City Manager Department REQUEST: The Public Works Department, Arbor Division, asks that the City Commission approve the request of Rosemary Lombard to remove (1) specimen live oak from her property at 747 Sybilwood Circle. SYNOPSIS: Rosemary Lombard of 747 Sybilwood Circle has requested a permit to remove a 34" live oak from her property. She received a letter, dated 10/1/14, from Farm Bureau Insurance Companies stating that the tree must be removed to avoid cancellation of the homeowner's insurance policy. CONSIDERATIONS: The tree was assessed by Stephanie Monica, City Arborist, on October 10, 2014. The insurance company was also contacted by Ms. Monica, via telephone, on October 13, 2014 to discuss their mandate. The insurance company stated that due to the tree's proximity to the home and branches that overhang the roof, the tree is considered a hazard to the structure and must be removed in order to retain insurance coverage with Farm Bureau Insurance. Section 5 -8(b) of Chapter 5, Tree Protection and Preservation, states that "specimen or historic trees shall not be removed except for extraordinary circumstances and hardships and only by final permit approved by the City Commission ". City Staff feel that cancellation of an existing homeowner's insurance policy qualifies as a hardship. FISCAL IMPACT: If this request is approved, the applicant will pay a $25 arbor permit fee to the Arbor Fund and be required to install (4) replacement credits worth of trees. Consent 300 PAGE 1 OF 2 - November 17, 2014 COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommend that the City Commission approve the request of Ms. Lombard to remove the specimen live oak from her property at 747 Sybilwood Circle. Staff feel that cancellation of an existing homeowner's insurance policy qualifies as a hardship as outlined in Section 5 -8(b) of the arbor ordinance.
