HomeMy WebLinkAbout2014 07 28 Informational 201 Code Enforcement Board Agenda RevisionsCOMMISSION AGENDA ITEM 201 REQUEST: Informational X Consent Public Hearings Regular July 28, 2014 KS ALLL Regular Meeting City Manager Department The Office of the City Attorney and the Office of the City Clerk requests that the City Commission receive information related to the revised Code Enforcement Board Agenda format, which we hope to become effective in August 2014. SYNOPSIS: Recently, the Office of the City Attorney advised the Office of the City Clerk that the current Code Enforcement Board Agenda should be revised to follow State Statutes only, as opposed to City guidelines for Agendas; and the Mayor and City Commission are being informed of this, through this Informational Agenda Item. CONSIDERATIONS: As the Mayor and City Commission are aware, up until now, all of the City's Boards and Committees' Agendas follow the same format as City Commission Agendas to maintain consistency and to make it easy for all individuals to follow. The Office of the City Clerk was recently advised by the Office of the City Attorney that the Code Enforcement Board Agenda(s) needs to be revised going forward, as the Code Enforcement Board is different than the City Commission and our other Boards and Committees in that it needs to adhere just to Florida Statutes, as opposed to City rules and procedures. Therefore, the Office of the City Attorney noted that the following sections of current Code Enforcement Agenda should not be on future Code Enforcement Board Agendas and will be omitted going forward: Informational 201 PAGE 1 OF 3 - July 28, 2014 • AWARDS AND PRESENTATIONS • PUBLIC INPUT (first opportunity) • REPORTS • PUBLIC INPUT (Second opportunity) Please note that during Code Enforcement Board Meetings, there currently is a section when anyone who wishes to give testimony about a property or parcel on any of the Cases, is sworn in, and then when a Case is brought forward for discussion, anyone who has been sworn in, will be able to offer testimony, and this will still remain on Code Enforcement Agendas. Furthermore, to try to follow the basic numbering system currently used for all Agendas, we will just modify the Code Enforcement Board Agendas in the following manner: and beginning with the August Code Enforcement Agenda, the applicable Agenda Items will be renumbered as follows: CALL TO ORDER 100 - INFORMATIONAL AGENDA 200 - CONSENT AGENDA 300 - PUBLIC HEARINGS AGENDA - CONTINUED CASES 400 - PUBLIC HEARINGS - REPEAT CASES 500 - PUBLIC HEARINGS - NEW CASES 600 - NON - COMPLIANCE CASES 700 - REGULAR AGENDA ADJOURNMENT FISCAL IMPACT: There is no Fiscal Impact related to these administrative changes. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. The Code Enforcement Board will also be advised of these changes. RECOMMENDATION: The Office of the City Attorney and the Office of the City Clerk request that the City Informational 201 PAGE 2 OF 3 - July 28, 2014 Commission receive and review the information provided in this Agenda Item.
