HomeMy WebLinkAbout2014 05 12 Consent 303 Seven Oaks Site Acceptance COMMISSION AGENDA     Informational Consent X ITEM303 Public Hearings Regular       May 12, 2014KSKL Regular MeetingCity ManagerDepartment         REQUEST: The Public Works Department requesting the City Commission: 1) validate the Staff recommendation finding the Seven Oaks subdivision sitework to be built in substantial accordance with the Final Engineering plans, subject to satisfactory completion of the remaining open project closeout list items; and 2) accept the public infrastructure for ownership and maintenance.   SYNOPSIS: Sitework for Seven Oaks is substantially complete and has been conditionally approved by the applicable City Departments.  This agenda item provides the site acceptance necessary before any certificates of occupancy can be issued by the building official for any non- model units.  This agenda item also accepts the public infrastructure for ownership and maintenance. CONSIDERATIONS: APPLICABLE CODE:   Section 9-178.  Required Improvements to be completed prior to building on lots; exceptions.    (c)  Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished.   Consent 303 PAGE 1 OF 3 - May 12, 2014 (d)  … Certificates of occupancy will not be issued until all improvements are accepted by the city commission.   Seven Oaks is a 138-unit single family development by Meritage Homes on a 35-acre site located on the south side of Shepard Road, north of Florida Avenue, and east of Boat Lake.     The Final Engineering Plans were approved by the City Commission at the August 26, 2013 City Commission meeting.  Sitework commenced in September 2013 and building construction commenced in late 2013.  A plat was approved by the City Commission at the November 18, 2013 City Commission meeting and was recorded on December 6, 2013.   This agenda item is for the conditional acceptance of the site improvements.  The sitework has been constructed in substantial compliance with the Final Engineering plans approved by the City Commission, except as noted on the attached project closeout list, Exhibit A.  All items on the project closeout list must be complete subject to Staff approval prior to issuance of any certificates of occupancy for any non-model units.   The public infrastructure being conveyed to the City for ownership and maintenance includes: roadways, curb, gutter, sidewalks, signage, striping, stormwater improvements, water, sewer, and reclaimed water improvements.     FISCAL IMPACT: There is no fiscal impact associated with this site acceptance. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors.
