SYNOPSIS: The applicant, Meritage Homes, is requesting approval of the Final Engineering Plans for Seven Oaks, a 138 unit single-family development located on the south side of Shepard Road, north of Florida Avenue, east of Boat Lake (see Attachment A - Location Map). The Final Engineering Plans detail the construction of the infrastructure in the development (see Attachment B - Final Engineering Plans for Seven Oaks). CONSIDERATIONS: FUTURE LAND USE AND ZONING DESIGNATION FLU: Medium Density Residential Zoning: Planned Unit Development(PUD) APPLICABLE LAW &, PUBLIC POLICY Home Rule Powers Florida Statutes City of Winter Springs Comprehensive Plan City of Winter Springs Code of Ordinances Developer's Agreement between the City of Winter Springs and The Keewin Real Property Company Applicant Name and Address: Meritage Homes 5337 Millenia Lakes Boulevard, Suite 160 Orlando, Fl 32839 August 14,2013 Planning&Zoning Board,Item 501 Page 2 of 4 Property Owner: Dittmer Properties INC. 1006 Shepard Road Winter Springs, Fl 32708 Property Address: None Property Parcel ID'S: 28-20-30-5DL-0000-0001 33-20-30-503-0000-0240 33-20-30-503-0000-025A 26-20-30-5AR-0000-0210 28-20-30-5AS-01300-015A 28-20-30-5AS-01300-0170 33-20-30-503-0000-0150 33-20-503-OS00-0000 Future Land Use Designation: Medium Density Residential Zoning Designation: Planned Unit Development (PUD) Approved Development Permits: Revised PUD Master Plan; Preliminary Subdivision Plan Pending Code Enforcement Actions: None City Liens: None CHRONOLOGY The subject property has a lengthy development history which is defined below: • June 12, 2006 —City Commission adopted a change of Future Land Use from "Industrial" to "Medium Density Residential" on the Dittmer parcels. • June 14, 2006 —A Developer's Agreement between the City of Winter Springs and Keewin Real Property Company was made and executed in reference to a proposed townhome/condominium project at said location . • July 24, 2006 —Adoption of the change of Future Land Use from "Industrial" to Medium Density Residential" on the Elesa and Florida Avenue parcels. • June 23, 2007—City Commission approved the concept plan, subject to conditions. • December 10, 2007 — City Commission unanimously approved a PUD Master Plan, Preliminary Plan, and Preliminary Engineering/Subdivision Plan for a 338 unit development known as Winter Place. • May 13, 2013 — City Commission unanimously approved a newly proposed PUD Master Plan and the Preliminary Subdivision Plan for the Seven Oaks development. DISCUSSION: The proposed Final Engineering Plan is identical to both the Preliminary Subdivision Plan and PUD Master Plan that were approved by the City Commission on May 13, 2013 (see Attachment August 14,2013 Planning&Zoning Board,Item 501 Page 3 of 4 C — Preliminary Subdivision Plan and PUD Master Plan). The Plan proposes access to the development at one point on Shepard Drive and another on Florida Avenue. General data for the Final Engineering Plans include the following: Land Use: Medium Density Residential (3.6 du/ac—9 du/ac) Existing Zoning: Planned Unit Development (PUD) Total Number of Acres: 37.27 Gross Acres Commercial Acreage: 2.09 Acres Net Acreage: 35.18 Acres Total Number of Units: 138 Single-Family Units Density: 3.92 DU/Acre Open Space: 21.42 Acres Green Space/Park Area: 19.23 Acres Wetland/Conservation: 0.74 Acres Retention Pond: 1.45 Acres Building Setbacks: Front: 25' Rear: 10' Side: 5' Side Street: 10' Project Boundary: 20' Minimum Lot Width: 50' Minimum Lot Depth: 110' Maximum Building Height: 3 stories The proposed single-family units are one (1) and two (2) stories in height and vary in architectural patterns. In addition, the applicant has submitted an Aesthetic Review for the proposed single- family development. It is anticipated that both the Final Engineering and Aesthetic Review will be reviewed by City Commission on August 26, 2013. On August 1, 2013, City of Winter Springs Development Review Committee (DRC) issued `response comments' for the Final Engineering submittal (see Attachment D - DRC Response Letter). Staff recommends approval of the Final Engineering Plans for the Seven Oaks single- family development subject to the applicant addressing the specific conditions noted within the August 1, 2013 DRC Response Letter. Furthermore, the `comments' must be addressed before submission of the City Commission agenda item, tentatively scheduled for the August 26, 2013 meeting. FISCAL IMPACT: The proposed Final Engineering Plan for Seven Oaks lays the groundwork for the development of 138 single-family homes and 2.09 acres of future commercial property fronting Shepard Road. It is anticipated that the project will add both residential and non-residential taxable value to the City's tax roll. A detailed fiscal impact analysis will be performed for staff review and assessment. This analysis will be part of the agenda item for the City Commission's consideration of the final engineering and aesthetic review for the proposed project. COMMUNICATION EFFORTS: The Meeting Agenda and this Agenda Item have been August 14,2013 Planning&Zoning Board,Item 501 Page 4 of 4 forwarded to the Planning and Zoning Board members and are available on the City's Website, LaserFiche, and the City's Server. The Agenda has been forwarded to the Mayor and City Commission; City Manager; and City Attorney/Staff. Additionally, the Meeting Agenda has been sent to media/press representatives, all Homeowner's Associations on file with the City, all individuals who have requested Agenda information, Department Directors; and also posted outside City Hall;posted inside City Hall with additional copies available for the general public. A yellow sign noting the date and time of the public hearing has been erected on the property. RECOMMENDATION: Staff recommends that the Planning & Zoning Board forward a recommendation of approval to the City Commission for the Final Engineering Plans for Seven Oaks subject to specific comments issued by the City of Winter Springs Development Review Committee dated August 1, 2013. Please use 25-feet for low-speed residential streets, consistent with other City subdivisions, unless there are specific design considerations that warrant a larger radius at a particular location. 6. Please revise centerline curves C2, C7, C9, and C13 to be at least 180-feet, which is the minimum for a low-speed urban street having a design speed of 25 mph and no superelevation, per the Florida Greenbook. 7. Will this fence be owned and maintained in an easement, or will it be individually owned by each respective homeowner? Please show an easement if there will be one (recommended). 9. Sheet 7. At Tract E, consider extending the screen fence along the entire south and east boundaries to better screen the subdivision from the adjacent dilapidated buildings. 10. Sheet 7. Callout speed limit signs on Street A northbound near lot 137 and on Street B eastbound near lot 130. Given the geometry of these streets and the City's recently completed City-wide Speed Limit Study, a posted speed limit of 20 mph is recommended. 11. Sheet 8. Callout speed limit signs on Street A southbound approximately 100-feet south of Shepard Road, and on Street B eastbound opposite of lot 100. A posted speed limit of 20 mph is recommended. 12. Sheet 8. The location of the pool/clubhouse driveways and nearby crosswalk across Street B are less than ideal from a sight distance standpoint (from vehicle to vehicle and from vehicle to pedestrian). If the current layout is maintained, it is essential that this area remains as open as possible to minimize sight distance conflicts. Please take this into consideration when designing the landscaping, streetlights, and other facilities in this area. 13. Sheet 8. In the Offsite Improvement detail, delete the portion of the double yellow centerline extending beyond the stop bar. 14. Provide a detail showing the required striping modifications on Shepard Road westbound approaching 17-92 (per TPD's latest traffic analysis). At the left turn storage lane, relocate the existing yellow gore area east as far as possible while maintaining a minimum lane width of 9- feet. Provide additional left turn arrows as needed. 15. Sheet 10. At the pool, please move the sanitary sewer such that it is a minimum of 5-feet outside of the pool enclosure. 16. Sheets 9 and 10 and Road Profile Sheets. Overall, the sanitary sewer system appears to be unnecessarily deep in many places. Please review and adjust where possible. Drop manholes can be used where necessary to shallow the system. 17. Sheet 10.At the water connection in Wildwood Drive, callout the existing line and valve as 10". 18. Sheet 11. Previous comment #38. Please show on these plans the approximate location of the organic soils and provide a specific reference to the geotechnical report calling for their removal and replacement. Callout on the plans or in the general notes the requirement that at the completion of earthwork operations, the City will require a certification from the geotechnical engineer stating that the removal and replacement of the organic soils has been completed in accordance with the report. 19. Sheets 11 and 12. The City does not allow the use of roadway underdrains to be used to protect roadway base materials from groundwater impacts. The streets must be elevated such that the bottom of the roadway base is at least 12-inches above the SHGWT, as determined by the geotechnical engineer. The City has experienced failures of roadway underdrains, often due to causes beyond the City's control, and this has required streets to be resurfaced or in some cases Page 3 of 4 completely rebuilt well before their normal schedule. Please revise the grading plans and street profiles accordingly. 20. Sheet 11. At the Florida Avenue connection, the stormwater facilities should be brought up to current standards for a typical new intersection at a new subdivision. The existing 12" pipe running diagonally across the intersection should be removed and replaced with a new culvert, at least 15" in diameter, running perpendicular to the road. Where the new pipe is being installed, provide an inlet structure such as a mitered end section or headwall as appropriate. 21. Sheets 11 and 12. Check and revise the grading as needed in the central areas where lots 58-72 back up to lots 73-87 and where lots 45-57 back up to lots 88-98. There are many locations where there is a grade differential of up to one-foot is shown at adjacent grades in close proximity. For example, the grade at the back of lot 54 is listed as 59.6 immediately adjacent to a grade of 58.6 at the back of lot 91. 22. Sheet 11. Please explain the need for underdrains in the dry pond including why the invert is set at 44.0 (matching the wet pond control elevation). At these elevations there will be periods when the underdrains may not have a positive discharge. 23. Sheet 11. Provide cleanouts for the dry pond underdrains and a detail of a typical cleanout. Also, please move the underdrain outfall away from the spillway. 24. Sheet 12. Provide more detail of the proposed grading at the intersection of Shepard Road and Street A. Stormwater runoff in Shepard Road currently drains from west to east across the proposed intersection location. Street A drains towards Shepard Road. Show how the existing runoff in Shepard Road will be addressed, without using a valley gutter. A new stormwater inlet at the northwest corner of Shepard Road and Street A, piped to STS-23, could be one solution. 25. Sheet 12. Previous comment #60 requested an evaluation of the offsite drainage impacts along the western property line, including the impact of the proposed wall on the offsite drainage patterns. The comment response states a separate geotechnical report will be provided but this has not been submitted. 26. Sheet 13.At STA 12+89, match the inlet (currently 12+97)with the low point in the sag curve. 27. Sheet 18. Replace the "Potable water/fire service" detail with the City's standard single and double water service details. 28. Sheet 19.
