HomeMy WebLinkAboutSchool Zones and Crossings-1992 TO: RICHARD ROZANSEY, CITY MANAGER FROM: John Govoruhk, Chief of Police DATE: AUGUST 24, 1992 SUBS: SCHOOL ZONES/CROSSINGS In response to recent complaints and inquiries regarding the appearance of new school zones and crossings in the city, this Department researched and investigated this situation with the following results: With the approach of the 1992-93 School Year, and the planned discontinuance of "courtesy bussing" of students within a two mile radius of schools for budgetary reasons, representatives of the Seminole County School Board, Seminole County Traffic Engineers, and Seminole County Sheriffs Department met to resolve any problems this change might cause. As a result of this, the Traffic Engineers where given $94.000.00 to establish school zones and crossings were needed. The discontinuance of this "courtesy bussing" virtually stopped all bussing in the northern areas of the City for students of Winter Springs Elementary. It was thus decided at that meeting to establish school zones and crossings in the following areas: 1. Shepard Rd. at Sheoah Blvd. - manned by a guard. 2. Sheoah Blvd. at the bridge south of Tam Ct. - posted with flashing signs and manned by a guard. 3. SR 434 at Noss Rd. - manned by a guard. 4. Hayes Rd. near Pearl Rd. - posted with flashing signs and manned by a guard. Additionally, the speed limits in the areas of numbers 2 and 4 above would be lowered from 25 NPR, to 20 MPH. With the approval of the Seminole County Sheriff's Department, the County Traffic Engineers installed the markings Page 1 of 4 and signs in the listed areas. It should be pointed out that this action was taken by the agencies involved through their interpretation of what they were authorized to do by an Inter- local Agreement between the city and county dated in 1986. It is highly possible that this interpretation by the County agencies was in error. The agreement states that: "The County will maintain within the City all school zone signing and markings installed on City streets by the County where currently existing, or as indentified by the City, subject to the confirmation by the County." In this situation, the school zone signs and markings are "new", not "existing", and were not "identified by the City, subject to confirmation by the County", since the City was not a party to the decision to establish these zones and crossings. With regard to the change in speed limits, we have attempted on numerous occasions in the past to establish a lowered speed limit on SR 434 at Winter Springs Elementary, and on Tuscavilla Rd. at Reeth Elementary. Our previous attempts have all been thwarted by the State and County. The best we have been able to get is a cautionary, suggested speed of 25 MPH, but this "suggested" speed is not enforceable by the traffic officers. Now, then, is it possible, and what is the wisdom behind the County's decision to lover City side-street speed limits by five miles per hour, but leave the speed limit on major road- ways fronting on the schools at 45 MPH? It seems that the previously mentioned Inter-local Agreement was not the only error in interpretation made by the County agencies. Florida Statutes Chapter 316 governs STATE UNIFORM TRAFFIC CONTROL. Under the headings of ".JURISDICTION" F.S.S. 316.006(2) MUNICIPALITIES. - states: (a) Chartered municipalities shall have original jurisdiction over all streets and highways located within their boundaries, except state Page 2 of 4 roads, and may place and maintain such traffic control devices which conform to the manual and specifications of the Department of Trans- portation upon all streets and highways under their original jurisdic- tion as they shall deem necessary to indicate and to carry out the provisions of this chapter or to regulate, warn, or guide traffic. ... It should be noted that the City of Winter Springs, by City Ordinance Sec. 12-2 Adoption of State Law, has adopted all of F.S. 316 into the Traffic Code of the city. One more point that should be considered is Winter Springs City Ordinance Sec. 12-27, which says (in part): "The Chief of Police shall have the power and is hereby authorized to regulate the operation and parking of vehicles within the corporate boundaries of the city, by erection of official traffic control devices, and/or by utilization of police officers to direct motorists. ... This power shall include the functions listed below: (1) Regulating motor vehicles:... (2) Designating uses or prohibitions of streets:... (3) Establishing speed limits and regulating turning and passing:... (4) Creating parking and standing zones:... (5) Regulating non-motorized traffic:..." Obviously the County agencies involved in this matter were ignorant of, or totally ignored, this City Ordinance, as well as P.S. 316. This practice of establishing these zones and crossings within the City without the City's in- put is rather concerning. It also seems not to be in accord with the County's expectations of the City's maintenance of certain county roadways within the City. In the past, the County has not only liberally interpreted their own responsibilities in Inter-local Agreements to their own benefit, but they have dictated to the City how the City is supposed to interpret the agreements. Usually, it is also to the County's benefit. Apparently, in the County's opinion, its not a "two-way street". Page 3 of 4 Since the Inter-local Agreement regarding the school zones and crossings was entered into by the City Commission, I, as Chief of Police, have taken no more action in this matter, awaiting the directives of the City Manager and City Commission. Indian Trails Middle School is expected to open in November/December 1992. Obviously this will cause these County agencies to again meet to discuss this issue. WILKINS DATE : 08-19-92 REF : NEW SCHOOL CROSSINGS On above date at approximately 1015 hrs . this officer spoke with Loretta Allen from the Seminole County Sheriff 's Department . Ms . Allen is the supervisor of crossing guards . Ms . Allen advised that there was a meeting in Lake Mary with representatives of the school board , county engineering and the Sheriff 's Department . At this meeting , it was decided to limit courtesy busing in a lot of areas . Due to the fact that virtually all busing in the north end of Winter Springs has been discontinued , the group put four new crossings in our city . Also, due to the fact that this decision was made so close to the beginning of school , and time was short , it was decided , with the authority of the Sheriff , to have Seminole County Engineering install the signs and paint the crosswalks in the chosen area . Ms . Allen apologized for not notifying our agency sooner . She also advised that it was not their procedure to notify the cities involved prior to crossing installation . By authority of Sheriff Eslinger , Mr. Steve Decker (323-2500 ext .5678) implemented plan . The following locations will now be considered school crossings . 1 . Shepard Road @ Sheoah Blvd . manned with guard . S .R . 434 @ Moss Road manned with guard . 3 . Sheoah Blvd . @ the bridge manned with guard/ flashers . 4 . CHARLES SEXTON, BUREAU COMMANDER DATE: AUGUST 21, 1992 SUBS: SCHOOL ZONES/CROSSINGS This is in reply to questions asked by the MAYOR at the work shop on August 17, 1992, with regard to new School Zones/Crossings being placed on Sheoah Blvd. On August 18, 19, & 20, 1992, the Department researched this with the following results. The Seminole County Engineering Department was given $94,000.00 for School Crossings/Zones throughout Seminole County due to the Busing of Children being stopped within two (2) miles of the assigned school. A study for locations and need was completed by Semiole County Traffic Engineering then approved by Seminole County School Board and Seminole County Sheriff's Department, to purchase & install whatever was needed under what they interpreted THEY HAD AOTHORITY TO DO from a 1986 School Zone Maintenance INTER—LOCAL AGREEMENT. / Capt.
