HomeMy WebLinkAbout2014 12 08 Consent 301 Primrose School Site AcceptanceCOMMISSION AGENDA ITEM 301 December 08, 2014 Regular Meeting REQUEST: Informational Consent X Public Hearings Regular KS City Manager KL Department The Public Works Department requesting the City Commission: 1) validate the Staff recommendation finding the Primrose School sitework to be built in substantial accordance with the Final Engineering plans, subject to satisfactory completion of the remaining open project closeout list items; and 2) accept the public infrastructure for ownership and maintenance. SYNOPSIS: Sitework for the Primrose School is in progress and expected to be complete in early January 2015. This agenda item provides the site acceptance necessary before any certificates of occupancy can be issued by the building official, and also accepts the public infrastructure for ownership and maintenance, subject to completion of the remaining open project closeout items. CONSIDERATIONS: APPLICABLE CODE: Section 9 -178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. Consent 301 PAGE 1 OF 3 - December 08, 2014 (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city commission. The Primrose School is a 12,324 square foot daycare facility located on the southwest corner of S.R. 434 and Heritage Park Street. The Final Engineering Plans were approved by the City Commission on December 9, 2013. Project construction commenced in June 2014. This agenda item is for the conditional acceptance of the site improvements. The sitework is in progress and to date has been constructed in substantial compliance with the Final Engineering plans approved by the City Commission. Exhibit A is the project closeout list showing the open items as of December 1, 2014. All items on the project closeout list must be complete subject to Staff approval prior to issuance of any certificates of occupancy. The Primrose School sitework is expected to be complete by early January 2015, and the building may be ready for a certificate of occupancy before the next City Commission meeting on January 12, 2015. Staff is recommending this conditional site acceptance in order to allow the Primrose School to open prior to January 12, 2015 if all required conditions are met. The public infrastructure being conveyed to the City for ownership and maintenance consists of a water main and related valves and appurtenances. FISCAL IMPACT: There is no fiscal impact associated with this site acceptance. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission: 1) validate the Staff recommendation finding the Primrose School sitework to be built in substantial accordance with the Final Engineering plans, subject to satisfactory completion of the remaining open project closeout list items as noted on Exhibit A prior to issuance of any Certificates of Occupancy; and 2) accept the public infrastructure for ownership and maintenance.
