HomeMy WebLinkAbout2014 05 12 Consent 302 Hayes Road Plaza Site Acceptance COMMISSION AGENDA     Informational Consent X ITEM302 Public Hearings Regular       May 12, 2014KSKL Regular MeetingCity ManagerDepartment         REQUEST: The Public Works Department requesting the City Commission: 1) validate the Staff recommendation finding the Hayes Road Plaza sitework to be built in substantial accordance with the Final Engineering plans, subject to satisfactory completion of the remaining open punchlist items; and 2) accept the public infrastructure for ownership and maintenance.   SYNOPSIS: Sitework for the Hayes Road Plaza is substantially complete and has been conditionally approved by the applicable City Departments.  This agenda item provides the site acceptance necessary before any certificates of occupancy can be issued by the building official.  This agenda item also accepts the public infrastructure for ownership and maintenance. CONSIDERATIONS: APPLICABLE CODE:   Section 9-178.  Required Improvements to be completed prior to building on lots; exceptions.    (c)  Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished.   Consent 302 PAGE 1 OF 3 - May 12, 2014 (d)  … Certificates of occupancy will not be issued until all improvements are accepted by the city commission.   The Hayes Road Plaza is a 17,128 square foot retail building located on a 2.0 acre site at the southwest corner of SR 434 and Hayes Road.  The project includes a convenience store, restaurant, and retail space.   The Final Engineering Plans were approved by the City Commission at the January 22, 2007 City Commission meeting.  Sitework commenced in September 2012 and building construction commenced in 2013.  A conditional use application to allow a 24-hour convenience store without gas pumps was approved by the City Commission in January 2009 and re-approved by the Commission on April 23, 2012.   This agenda item is for the conditional acceptance of the site improvements.  The sitework has been constructed in substantial compliance with the Final Engineering plans approved by the City Commission, except as noted on the attached punchlist, Exhibit A.  All items on the punchlist, Exhibit A, must be complete subject to Staff approval prior to issuance of any certificates of occupancy or completion.  One item on the punchlist, Exhibit A, is the requirement for the wall along the back property line (abutting Hacienda Village) to have a painted stucco finish to match the new building, in accordance with the Commission- approved plans.  The wall must be completed with a painted stucco finish on both sides before any certificates of occupancy or completion will be issued by the building official.      The public infrastructure being conveyed to the City for ownership and maintenance consists of a new water main from the point of connection near SR 434 to the point of service onsite near the western end of the building.  Easements being conveyed with the completion of the project include a utility easement for the water main plus a cross- access easement along the front (SR 434 side) and eastern sides of the property. FISCAL IMPACT: There is no fiscal impact associated with this site acceptance.  All required City and County impact and permit fees have been paid. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors.
