HomeMy WebLinkAbout2014 05 12 Consent 308 FDOT LAP Supplemental AgreementCOMMISSION AGENDA ITEM 308 REQUEST: Informational Consent X Public Hearings Regular May 12, 2014 KS KL Regular Meeting City Manager Department The Public Works Department requests the City Commission's authorization to: 1) approve Resolution 2014-02; 2) enter into a Local Agency Program Supplemental Agreement with the Florida Department of Transportation to provide additional funding for resurfacing of the SR 434 / Tuskawilla Road intersection; and 3) approve Amendment 41 to the Engineering Services Agreement with AECOM in the amount of $18,393. SYNOPSIS: The Intersection Improvements at SR 434 at Tuskawilla Road (Market Square) is a federally funded City project currently in the early stages of design. This agenda item is for the approval of a Resolution and Local Agency Program (LAP) Supplemental Agreement with FDOT to provide an additional $18,393 in federal funds for the design of asphalt resurfacing of the entire intersection. The agenda item also includes authorization to amend the Engineering Services Agreement with AECOM in the amount of $18,393 to add the resurfacing design work to AECOM's scope. CONSIDERATIONS: At the January 28, 2013 City Commission meeting, the Commission approved Resolution 2013-05 and a Local Agency Program Agreement with FDOT for the design of Intersection Improvements at S.R. 434 and Tuskawilla Road. The design phase of the project was federally funded for up to $150,000, and the design is currently in progress. e FDOT is planning to resurface SR 434 from SR 419 to Tuskawilla Road in 2014/15. Consent 308 PAGE 1 OF 3 - May 12, 2014 FDOT's resurfacing project includes the resurfacing of the SR 434 / Tuskawilla Road intersection. The City's Market Square project, which is scheduled for construction in 2015, has significant impacts on the SR 434 / Tuskawilla Road intersection, including changes to the curb ramps, medians, and crosswalks. City and FDOT Staff recently met to coordinate the two projects and determined that it would be best to resurface the intersection as part of the City project. This will avoid any possible conflicts between the two projects and will provide the best appearance of the intersection at the completion of all construction. The FDOT SR 434 resurfacing project will proceed as scheduled from SR 419 but will stop just short of the Tuskawilla intersection. The City will then resurface the Tuskawilla intersection as part of the Market Square project. The FDOT project is expected to be complete prior to construction of the City project. e This agenda item is requesting City Commission approval of three items: 1. Resolution 42014-02, which authorizes the City Manager to enter into a Local Agency Program Supplemental Agreement with the Florida Department of Transportation (see Attachment 1). 2. A Local Agency Program (LAP) Supplemental Agreement between the City and the Florida Department of Transportation (FDOT) for funding in the amount of $18,393 for additional intersection resurfacing and related design services (see Attachment 2). 3. Amendment 41 to the Engineering Services Agreement with AECOM to add the resurfacing design work to the project scope and fund the additional work in the amount of $18,393 (see Attachment 3). The Local Agency Program (LAP) Supplemental Agreement is FDOT's standard form for amending LAP Agreements. . Resolution 2014-02 is required by FDOT for the adoption of the LAP Supplemental Agreement. . At the May 13, 2012 City Commission meeting, the Commission authorized entering into an Engineering Services Agreement with AECOM in the amount of $149,095 for the design of the Market Square project. Amendment 41 submitted for approval in this agenda item adds the intersection resurfacing to the design scope and increases the design fee by $18,393 for a new total of $167,488. FISCAL IMPACT: The project is entirely federally funded and has no fiscal impact to the City. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives Consent 308 PAGE 2 OF 3 - May 12, 2014 on file with the City, and all individuals who have requested such information. RECOMMENDATION: Staff recommends the Commission: 1) approve Resolution 2014-02; 2) provide authorization for the City Manager to enter into a Local Agency Program Supplemental Agreement with the Florida Department of Transportation, funded in the amount of $18,393; and 3) approve Amendment 41 to the Engineering Services Agreement with AECOM in the amount of $18,393, and authorize the City Manager and City Attorney to prepare and execute any and all applicable documents. WHEREAS, the State of Florida Department of Transportation and the City of Winter Springs desire to facilitate the design of intersection improvements at S.R. 434 and Tuskawilla Road and, WHEREAS, the State of Florida Department of Transportation has requested the City of Winter Springs to execute and deliver to the State of Florida Department of Transportation the Supplemental Local Agency Program Agreement for the aforementioned project, FPN #432642-2-38-01. All provisions in the original Agreement and supplements, if any, remain in effect except as expressly modified by this supplement. The changes to the Agreement and supplements, if any, are described as follows: PROJECT DESCRIPTION Name Intersection Improvements at SR 434 Length —0.02 miles Termini SR 434 at Tuskawilla Road Description of Work: Design and permit a series of safety and operational improvements of the intersection of S.R. 434 and Tuskawilla Road in Winter Springs. The project will include improvement to eliminate the southbound Tuskawilla Road right turn bypass lane; shifting the Tuskawilla Road lanes on the north branch to the east; provide a longer southbound Tuskawilla left turn storage lane. Eliminate the left turn overlap for southbound and northbound Tuskawilla left turning movements; increasing the southbound Tuskawilla Road to westbound S.R. 434 turning radius; improve sight lines for the intersection; add on -street parking along Tuskawilla Road; analyze and design a functional frontage road along the north side of S.R. 434 between Tuskawilla Road and Doran Drive. Improve pedestrian safety to meet ADA; and creating space for turning movements between S.R. 434 and the frontage road at the intersections. The project will include public meetings with the affected businesses, residents, and other interested parties. Reason for Supplement and supporting engineering and/or cost analysis: Add additional funding $18,393.00 to cover supplemental #1. Said revision is reflected on the ADJUSTED EXHIBIT "B" SCHEDULE OF FUNDING, attached hereto and incorporated herein, as page 2. Engineer shall incorporate the FDOT milling and resurfacing, signing and pavement markings, and signal modifications at the intersection of SR 434 and Tuskawilla Road to the Project. This will include the milling and resurfacing on SR 434 from the edge of pavement of the existing median on the west side of SR 434 to approximately 175 feet west. The major exceptions are the Highway Bridge Replacement and Rehabilitation Program, which provides assistance for bridges on and off the federal -aid highways, highway safety activities, bicycle and pedestrian projects, transportation enhancement activities, the recreational trails program, and planning, research, development, and technology transfer. Proposed projects meeting these and other planning, design, environmental, safety, etc., requirements can be approved on the basis of state and local priorities within the limit of the funds apportioned or allocated to each state. Allowable Costs: Eligible activities and allowable costs will be determined in accordance with Title 23 and Title 49 C.F.R. and the OMB cost principles applicable to the recipient/sub-recipient. Eligibility: By law, the federal -aid highway program is a federally assisted state program that requires each state to have a suitably equipped and organized transportation department. Therefore, most projects are administered by or through State Departments of Transportation (State DOTs). Projects to be funded under the federal -aid highway program are generally selected by state DOTs or Metropolitan Planning Organizations (MPOs), in cooperation with appropriate local officials, as specified in 23 U.S.C. and implementing regulations. Territorial highway projects are funded in the same manner as other federal -aid highway projects, with the territorial transportation agency functioning in a manner similar to a state DOT. Most Federal Land Highway Program (FLHP) projects are administered by the Federal Highway Administration (FHWA) Office of Federal Lands Highway and its Divisions or by the various Florida Land Management Agencies (FLMAs). Under the FLHP, projects in the Indian Reservation Road (IRR) Program are selected by Tribal Governments and are approved by the Bureau of Indian Affairs (BIA) and the FHWA. Due to recent legislation, Tribal Governments meeting certain requirements may now administer various IRR projects on behalf of the BIA and FHWA. The Fish and Wildlife Service (FWS) and the National Park Service (NPS) select projects in the Refuge Road and Park Roads and Parkways Programs, respectively. For the Forest Highway Program, the Forest Service, the States and the FHWA jointly select projects. PROJECT PURPOSE The Florida Department of Transportation (FDOT) has completed 60% plans for Financial Project ID: 430675-1-52-01. This project begins at approximately SR 419 and ends at approximately Tuskawilla Road. SCOPE OF SERVICES Brindley Piefers & Associates' (BPA) scope of additional services consists of incorporating the FDOT milling and resurfacing, signing and pavement markings, and signal modifications at the intersection of SR 434 and Tuskawilla Road info the City of Winter Springs project. The project will include the milling and resurfacing on SR 434 from the edge of pavement of the existing median on the west side of SR 434 to approximately 175 feet west.
