HomeMy WebLinkAbout2013 07 22 Consent 204 Winding Hollow Plat COMMISSION AGENDA     Informational Consent X ITEM204 Public Hearings Regular       July 22, 2013KSKL Regular MeetingCity ManagerDepartment         REQUEST: The Public Works Department requests the City Commission approve the Offices at Winding Hollow plat and authorize the plat to be recorded, subject to satisfaction of the recommended conditions of approval.   SYNOPSIS: The Offices at Winding Hollow is a commercial development consisting of six (6) single- story buildings having a total of approximately 19,000 square feet of professional office space on 2.9 acres of property located on the west side of Winding Hollow Boulevard just south of State Road 434.  This agenda item is for the approval of the plat which divides the property into six (6) lots. CONSIDERATIONS: LAND USE & ZONING Zoning:                       C-1 (Neighborhood Commercial) Future Land Use:        Commercial   APPLICABLE REGULATIONS Chapter 177, Florida Statutes Chapter 197, Florida Statutes Chapter 9, City Code   The Offices at Winding Hollow is a commercial development consisting of six (6) single- story buildings having a total of approximately 19,000 square feet of professional office space on 2.9 acres of property located on the west side of Winding Hollow Boulevard just south of State Road 434.  The developer is The Offices at Winding Hollow, LLC.  Consent 204 PAGE 1 OF 3 - July 22, 2013   CHRONOLOGY:            The development history of the project is summarized below:   December 10, 2012 – City Commission approved the Winding Hollow Lot Split  Resolution subject to conditions (Resolution 2012-43). January 10, 2013 - Planning & Zoning Board recommended approval of the  Administrative Rezoning from C-2 (General Commercial) to C-1 (Neighborhood Commercial) via Ord. 2013-01.  January 14, 2013 – City Commission approved The Offices at Winding Hollow, LLC  Developer’s Agreement (DA). February 11, 2013 – City Commission approved First Reading of Ordinance 2013-01,  which proposed to administratively rezone 2.9 acres of property from C-2 (General Commercial) to C-1 (Neighborhood Commercial). March 25, 2013 – City Commission approved Ordinance 2013-01, which  administratively rezoned the property from C-2 (General Commercial) to C-1 (Neighborhood Commercial).  The Administrative Rezoning complied with the conditions stipulated as part of the City Commission’s approval of the Winding Hollow Lot Split, Resolution 2012-43, on December 10, 2012.  April 3, 2013 – Planning & Zoning Board recommended approval of both Final  Engineering Plans and Aesthetic Review, subject to conditions noted within the March 15, 2013 DRC  Response Letter, which have since been satisfied. April 22, 2013 - City Commission approved the Final Engineering and an Aesthetic  Review Package. Sitework construction commenced in June 2013 and is expected to be in progress for  the next several months.   The Offices at Winding Hollow plat divides the property into six (6) lots corresponding to the six(6) proposed single-story office buildings.  The plat includes easements for utilities, drainage, cross-access, a landscape buffer, signage, a screen wall, pedestrian access, and emergency access.      Approval of a final plat is regulated by Chapter 9 of the City Code (various sections) and Chapter 177, Florida Statutes.  Chapter 177, Florida Statutes require that the plat be fully executed by the owner(s) of record, by all mortgagees having an interest in the land to be subdivided, by the professional surveyor and mapper of record, and by the independent professional surveyor and mapper who reviews the plat for consistency with Chapter 177, Florida Statutes.   Before the plat can be recorded, per Section 9-76 of the City Code the developer is required to provide a bond, letter of credit, or cash deposit in favor of the City in an amount equal to the construction cost of the publicly owned site improvements that have not been completed.  For The Offices at Winding Hollow, the developer intends to complete and obtain final City acceptance of all publicly owned improvements (water, sewer, and reclaimed water facilities) prior to recording the plat, which would eliminate the need to provide a bond, letter of credit, or cash deposit.      As of July 11, 2013, there is one open comment from the City's independent surveyor that had not been addressed, which was a request that all easements from the title opinion be listed on the plat.  This open comment is recommended to be a condition of approval of the Consent 204 PAGE 2 OF 3 - July 22, 2013 plat, meaning the plat cannot be recorded until the comment has been addressed and approved by the City's independent surveyor. FISCAL IMPACT: There is no fiscal impact associated with this agenda item.  COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals.   RECOMMENDATION: Staff recommends the City Commission approve the Offices at Winding Hollow plat, and authorize the City Manager and City Attorney to prepare and execute any and all applicable documents, subject to the following conditions: 1.Provision of the required bond, letter of credit, or cash deposit, as applicable. 2.Address the City survey consultant's comment requesting that all easements from the title opinion be listed on the plat.
