WITNESSETH: WHEREAS, COUNTY has received Connmunity Services Block Grant funding in the amount af ONE HUNDRED FIFTY-N1NE THOUSAND ONE I�UNDRED THIRTY-SIX NO/lOp DOLLAT�'.S ($159,136.00), hereina$er referred to as the Grant, from the State of Florida Department of Economic Clpportunity for day camp schalarships for eligible indivzduals residing in Seminole County,Florida; and WHEREAS, in response to the needs of these individuals, COUNTY may issue vouchers for day camp scholarships,hereinafter refened to as"Day Camp Schalarship Vouchers", for income eligible individuals residin� in Seminale Gounty, Florida, hereinafter referred to as "Camper", participating in a COUNTY program for payrnent af day camp tuition and ather specified expenses for shart-terrn day camp services provided by DAY CAMP PROVIDER; and WHEREAS,the purpase af this Agreernent is ta identify the COtINTY approved day camp programs ta be delivered by the DAY CAMP PRt:}VIDER; establisla the costs associated with the appraved day carnp prag-ams; describe the processes and pracedures that wili be fo]lowed if an eligible Camper receives a Day Camp Schalarship Voucher from CUUNTY for enrallrrtent in one Seminole County/City of Winter Springs Day Camp Provider Agreement Page 1 of 12 t�f the �AY C,AMP FRCIVIDER's approve.d day camp pmgrams; and identify the operating prac:edures goveming payment for the day eamp programs�and W�IEREAS,C�LTI'�'T�has statut�ry authority�t3isburse t�i�Cranfi under this Agr�ement, NC?W, T`�IEREFO�, in con�ideration of the mutnal �derstandings and covenants set ft�rt�i herein, thte r+eceipt�nd sufficiency of which are hereby acknc�wledged, C�L7N'�I' and DAY CAMP PROVIDER agree as follows: Sectic�x� 1. Responsibilities. All tecros and c�nditions of this Agreement are subject to contiaued Grant iiund availability. (b) COLTNTY shall not guarantee any referral�, set aside any day camp scholarships, or budget any funds whatsoever for any day camp programs off�erecl by the DAY CAMP PRC}VIDER All decisions regarding the issuance of a Day Camp Scholarship Voucher shall be znade on a case by case basis by COLTNTY, taking into cansideration the inforrna�tian available, including, but nat lizr�ited to the assess� neec�s af the Cam� and any additional costs to the Camper. ' (�� DAY GAMP PROVIDER agrees to accegt the Day Camp Scholarship Voucher�and bill COCTNTY for the agreed upan day camp oosts at no more than the tatal of the Day Camp Schalarship Voucher or the total pubiished cost of the specific day catt�� setvi�es for municipai residents,whichever is less. The arnount of tl�e Day Camp Scholarship Voucher shall be determined by COLTI�TTY up to a u�znum amaunt of EIGHT HUI�TDRED TEN AI�ID N0/100 DOLLARS ($81(}.OQ)c►f the cost c►f day camp tuition per Cam�er to DAY CAMP PROVIDER. C011NTY shall pay no other casts or fees that are anot specifieci in this Agreem+�a:t and included on the]Jay Camp Scholarship Vaucher. Payments for tuition andJor other appraveci cflsts wi11 be made only for thase Campers r+�ceiving a valid signed GOUIVTY Day�Camp Scl�olarahip�auch�r. Th�Gamper must be enrollecl in and receiving day c�tnp se�rvices designated on the Day Camp Schalarship Voucher before the C{)UNTY Day Camp Scholarshig Voucher is cansiderecl valid. If'the Camper does not begin day camp, DAY CAMP PROjIIDER shall immediat�ly return tiie Day Camp SchoIarship Voucher ta C�tINTY. (h) I�AY CAMP PRt]VIDER shal� provide COLJN'FY a record of comp�etion of the day camp program by ths Ca�nnnper within ten (1Q� business days of said completion. This ' infarmaticrn shall be released to CQUNTY based on Camper's authorization as outlined or�the Day Camp Sclaolarsship Vaucher. DAY CAMP PRO�JIDER, shall provide COUNTY a completed Monihly Report within ten (10} days of the end'af the month. A eapy of the lvionthly Report is , attached hereto and incorporated herein as E�tibit C. (i) DAY GAMP 1'ROVIDER shall ref�r CC�Ll1tiTTY Catnpers back to CCIUNTY in the e�vent that the Camper or DAY CAMP PR(�VTDER is unable to cantinue the da�+ camp services specified in the Day Camp Schalarship Vaucher. DAY CAMP P�OVIDER shall alsa notify COtTNTY in writing af this occurr�ce. (j} L7�AY CAMP PRfJVIDER agrees that each Gamp�r receiving a Day Camp Schcrlarshi�Voucher fo�r day camp services sha11 be evaluated by the C►AY CA.MP PRQVIDER far ' all financial aid eligibility narniaity available to DAY CAMP PR.OVITaER's Casnp�ers. A Camper eligibte for assistance shail not be discriminated against in receipt of su.ch financial aid salely due to hisllier rec�ipt of a COi.TNTY Day Carnp Scholarship Voucher. (a) The DAY CAMP PROVIT7ER sha11, in confoatmity with its establish�d refvnd ' policies, refiznd such monies far day camp tuition and fees paid by COUNTY for Campers who enroll in and begin a day camp program,but dr+ap out of day camp. DAY CAMP PI�.OVIDER sh:all comply with Fexieral and State law to et�sure the aanf r�entiality of pers4nal infarmation including name, Sacial Security Number, Social Security benefit data, date of birth, official Stat� ar government issued driver's license or identificai�iion n�unber, aiien registratian nurnber, govemment passport number, emplayer or ta�cp�tyer identifica�ion num'�er, hame address, phone nurnber and medicai infarrnation of each Catnper receivin,g a COtTNTY Day Camp Scholarship Voucher. {b) DAY CAMP PRQ�TIDER �hall have in place an official pz�c:►cess far investigating and reporting lost or stolen confid�ztiai informatio�a. Any infraction or pote�tia� infraction of State and/or Federal laws related ta the lass ar theft of confidential iz�formation shall immediately be reported to the C4UNTY in writing. In the event of such terminatian, there shall be no interru�tion in services for C�UNTY sponsored Campers already enroiled in day camp thmugh the pe�iod paid f�r by the Day Camp Sc�c�la3ship Voucher iss�ed and paid. L3AY CAMP PROVIDER has thirty(34� days after the effective date af the terminatian for cc�nvenience to bill far any paymenis c�ue. CAMP PROVIDER shall be entitied to receive just and equitable compensation for any services per�'ormed hereunder thmugh the date of termination. (b) Either party may terminate this Agreeinent in writing when it has been detennined that the o�er party has failed to comply with any of the teims specified herein or has violated any stipulations of this Agreement. The abligation of COUNTY to make all paymen�s due under this Agrcement for all enrollments prior to the effecrive date af tennination of this Agre.�ment shall survive tern�ination unIess DAY CAM�'PROVIDER fails ta perform. If DAY CANff' PROVIllER fails to perForm,in whole or in part, COUNTY may serve a tertnination notice that shall be effective as provided in Section 6 herein. In the event of such termination, COUNTY shall be lial�le for payment anly for s�rvices rendered prior to the effective date of termination. Indemuification. {a) Each party to this Agreement is responsible for all �ersonal injury and property damitge attributdble to the negtigent acts of omissions arising out of this Agreement of that party and the afficers, emplayees and agents thereof. (b) The parties further agree that nothing contained herein shal� be construed or interpreted as denying to any party aciy remedy or defense available to such parties under the laws of the State of Florida, nor as a waiver of sovereign irnrnunity of CQIINTY and DAY CAMP PROVIDER beyond the waiver provided for in Section 768.28, Florida Statutes. M�da#ed Condftions. {a) Governing Law. This Agreement shall ba governed by�zd co�strued in accordance with the laws of the State of Florida and the p�a�ties consent to venue in the Circuifi Cgurt in and for Seminale County, Floricla, as ta St,ate ac:tic�n� and the United Stat.�s District Court for the Middle Dist�rict af Florida as tc�Federal acbons. (b} Accuracy af Submittals. The validity of this Agreement is s�bject to the truth and ac�curacy nf all the information,representatians, and ma#erials submitted or pravid+ed by the DAY CAMP PROVIDER in this Agreement, in any Iater submission or response tr� a COLTNTY request, or in any submissian or response ta fulfill the requir�ernents of this Agareement. A.11 of said infarmatian, representat�ons, and materials are incorpcyrated by refer�nce. The inaccuracy of th� submzssions or any materiai changes shail, at the option of COUNT�i'` and with thirty {3dj days vvritten natice ta T?A'Y CAMP PROVIDER, cause the termination of this Agreement and the release of Ci�UNTY from a11 its o�bligatians to I�AY CAMI� PRCMVIDER. (c) Connte��arts. This Agreement may be executed in any nwnber of counterparts, any one af which may be taken as an original, (d) Clther ,Regulations. DAY CAMP' PRCIVIDER agrees to cc�mply with the Americans Vijith Disabilities Act (Public Law lq1-336, 42 U.S.C. Section �2101 et sec�.) and the Florida �ivil Rights and Fair Housing Acts {Sections 7b0.01-760.37, Floz�ida Statutes}, which prohihit discrimination by public anr� private entities on the basis of disability in emplayment, Seminale Gpunty 1 City crfV+�'in#er Springs Day Camp Provider Agreement Page9ofl2 publ'rc accornmodations, transportatian, S�ate and local government services, and telecammunications. (e) Unauthorizec� Workers. COUNTY will not intentionally award publicly-funded contracts to any contractor who knowingly employs unauthorized alien work+e�, constituting a violation of the einployment pravisians wntained in 8 U.S.C. Secrion 1324a(e) [Sec#ion 274A(e) of the Immigration and Nationality Act {"iNA")]. C4LTNTY shall consider the employr�ent by any contractor of unauthorized aliens a violat�an of Section 274A(e} af the INA. Such violat�on by DAY CAMP PROVIDEit.of the employment provisions contained in 5ection 274A(e) of the INA shall be grounds for unilateral cancellation of this Agreement by COUNTY. (� Lobbvine Prah�.`bition. Of this funding $159,136 has been approved for a Day Camp Scholarship Program. The purpose of the Day Camp Scholarship Program is to provide a safe environment for youth to enable working parents to maintain employment during the summer months. Additionally, this program will enable youth to avoid risk-taking behavior for a defined period of time. The funds under the program are intended to target families that meet the following criteria: • Household must reside in Seminole County; • Household's income must be at or below 125% of the Federal Poverty Limit (see chart below); and • At least one adult household member is employed. SUBRECIPIENT shall reserve at a minimum the amount of spaces for eligible campers as specified in the Inter-Agency Day Camp Agreement, Exhibit B — Day Camp Provider Matrix. 2. The SUBRECIPIENT will provide services listed by their agency as outlined in the Inter- Agency Day Camp Agreement, Exhibit B - Day Camp Provider Matrix, for the equivalent of a Day Camp Scholarship. 3. Parents will be required to sign in and sign out their child each and every day. If for any reason you will be late in dropping your child off or you will be picking them up early, please let the Camp Director know one day in advance. If someone else will be picking up your child,please let the Camp Director know in advance. Identification will be required for everyone picking up a child. Registration: We will begin accepting registrations on April 13`h, 2013 from 8:00 a.m. 11 am. at the Civic Center as part of our Winter Springs Resident Only Registration. Open registration will begin on Monday April 15�' at the Central Winds Park Admin Office, from 8:OOam-S:OOpm, Monday through Friday. Weekly Flyer: You will be given an outline of activities on Friday for the following week. Some activities require campers to bring items from home, such as a bathing suit, towel, etc. Please make note of these days so campers can participate in all activities. Please arrive on time for all day trips to board the bus. All Campers must be at camp by 9am on Wednesday's for the Weekly Field Trip. Field Trips: Signed permission slips must be on file. Campers will participate in many games and activities both inside and outside. Camp staff will notify parents on days that swimming attire is needed. 3. Parents are strongly encouraged to apply sun block before sending your child to camp each day. 4. Lunches must be provided by the parent for each day. Morning and afternoon snacks should be planned for by the parent. Do not send food items that need to be refrigerated or micro-waved. Please put your child's name on any personal items. 5. Some field trips allow campers to bring additional money. If you wish to provide your child with additional spending money please send it with them on the day of the trip.
