REQUEST: The Public Works Department requests the City Commission approve the
Tuscawilla Greens Plat and authorize the plat to be recorded, subject to
receipt of a letter of credit for the remaining site infrastructure work to be
completed.
SYNOPSIS:
Tuscawilla Greens is a 60-unit townhome development located on the south side
of Winter Springs Boulevard, east of the Tuscawilla Country Club. This agenda
item is for the approval of plat including the dedication of easements to the City
for utilities, drainage, emergency access, and conservation areas.

Tuscawilla Greens is a 60-unit all-townhome subdivision located on an 11.45-acre parcel
on the south side of Winter Springs Boulevard, east of the Tuscawilla Country Club.
Tuscawilla Greens was originally proposed as a 60-unit condominium project. Following
City Commission approval in 2008, construction of the site infrastructure commenced
and was substantially completed in 2009. The construction of condominium units never
materialized, and the project has a new owner/developer, Morgran Greens, LLC. The site
currently has built infrastructure consisting of paved streets, curb and gutter, stormwater
management facilities, water and sewer services, and retaining walls.
Final Engineering and a Developer’s Agreement for the 60-unit townhome development
were conditionally approved by the City Commission at the October 10, 2011 City

Commission meeting. The overall layout of the townhome project is very similar to the
original layout for the condominium project.
The streets and stormwater system in Tuscawilla Greens will be privately owned and
maintained by the Homeowner’s Association. The plat includes easement dedications to
the City for utilities, drainage (for emergency purposes only), emergency access, and an
onsite conservation area over the eastern side of the site over Howell Creek and the
surrounding wetlands.
Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various
sections) and Chapter 177, Florida Statutes. A title certification has been submitted and
reviewed by Staff and City Attorney’s office. Chapter 177, Florida Statutes require that
the plat be fully executed by the owner(s) of record, by all mortgagees having an interest
in the land to be subdivided, by the professional surveyor and mapper of record, and by
the independent professional surveyor and mapper who reviews the plat for consistency
with Chapter 177, Florida Statutes.
In accordance with Section 9-76.a of the City Code, the developer is required to provide a
letter of credit to the City covering the cost of all site improvements that have not been
installed at the time the plat is recorded. The engineer’s estimated cost of the incomplete
site improvements is $104,670. As such, this agenda item is requested for City
Commission approval conditioned upon Morgran Greens, LLC providing a letter of credit
in the amount of $104,670 in a form approved by the City Attorney.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item. The applicant is responsible
for payment of all review and recording fees.

Individual Requestors. City Staff Is Always Willing To Discuss This Agenda Item Or Any

RECOMMENDATION:
Staff recommends the City Commission approve the Tuscawilla Greens Plat, subject to
Morgran Greens, LLC providing a letter of credit in the amount of $104,670 in a form approved
by the City Attorney, and authorize the City Manager and City Attorney to prepare and execute
any and all applicable documents.
