HomeMy WebLinkAbout2011 10 10 Regular 601 Resolution 2011-47 Tax Abatement Program COMMISSION AGENDA Consent Informational ITEM 601 Public Hearing Regular X October 10, 2011 Mgr. / REQUEST: The City Manager and the Community Development Department request that the Resolution 2011-47 City Commission review and adopt approving the operational procedures for administering the Ad Valorem Tax Exemption program, which was approved by the City’s electorate by referendum on November 2, 2010. SYNOPSIS: The City Commission has expressed interest in creating programs that incentivize businesses that create qualifying jobs in the City. Florida Statutes Section 196.1995 gives a local government the ability to use Ad Valorem Tax Exemptions as a means to stimulate economic development. This exemption must first be approved and authorized by the City’s electorate through the referendum process. The City Commission approved the referendum process for the tax exemption program on March 23, 2009. On November 2, 2010, by a majority of approximately 53%, the City’s electorate approved the economic development tax exemption program to allow the City to give relocating or expanding businesses that meet specific program criteria an exemption of ad valorem taxes. In the City’s 2010-2012 Strategic Plan Goal 2, Strategy 12 identifies the development of a business incentive program to recruit qualified businesses to the City and create quality jobs. The Ad Valorem Tax Exemption program is structured similar to the Jobs Growth Incentive (JGI) Program. Both economic development tools are only available to targeted industry businesses that create qualified jobs. Program awards are at the discretion of the Commission and are administered on a case-by-case basis. CONSIDERATIONS: AD VALOREM TAX EXEMPTION PROGRAM CONSIDERATIONS: 1.The Ad Valorem Tax Exemption program is an exemption of ad valorem taxes (up to ten years) due to the City for an approved/qualified company. 2.Targeted industries must satisfy specific criteria, including minimum job creation amounts, salary levels and a job retention period, in order to apply for consideration. 3.The Winter Springs City Commission, after due diligence and evaluation of the potential economic impact of the project may, at its discretion and authority, approve and authorize October 10, 2011 Regular Item 601 Page 2 the City to enter into an Agreement with the applicant to facilitate the exemption. No exemptions may be applied prior to the satisfactory execution of an Ad Valorem Tax Exemption program Performance Agreement between the applicant and the City. 4.The applicant will submit annual reports to the City of Winter Springs documenting and attesting to the satisfaction of the terms and conditions of the executed Ad Valorem Tax Exemption program Performance Agreement. 5.Upon review by the City, if the applicant has not satisfied the terms and conditions of the Ad Valorem Tax Exemption program Performance Agreement, the City may terminate the Agreement or modify (Pro-rate) the amount of the subsequent years’ tax abatement amount to be commensurate with any partial satisfaction of the terms of the Performance Agreement. APPLICANT ELIGIBILITY: 1.Applicant must be a Winter Springs Targeted Industry: Targeted business sectors identified by the City of Winter Springs eligible to participate in this program include: Research Development and Testing Space Technology, Aviation and Aerospace Simulation, Modeling and Training Laser Technology Photonics Computer Software and Hardware Medical Labs and Technology Communications Corporate Headquarters / Professional Services 2.Non-Targeted Industries: Non-target industries may be eligible for consideration if the proposed expansion or relocation is proposed to occur: (1) within the City of Winter Springs; and (2) within or adjacent to targeted areas [i.e., Community Redevelopment Area, Seminole Economic Enhancement District (SEED), SeminoleWAY or other areas identified by the Winter Springs City Commission] pursuant to an adopted Resolution. 3.Minimum Job Creation Criteria: Relocating Companies - 25 Jobs Expanding Companies – 10% increase over present employment New or Start-up Companies - 3 New Jobs 4.Minimum Salary Criteria: a.Relocating Companies: 115% of Seminole County Average Annual Wage (SC Avg. Wage= $37,925) (115% of Avg. Wage=$43,614 as of 5/9/11) b.New or Expanding Companies: 80% of Seminole County Average Wage (SC Avg. Wage= $37,925) (80% of Avg. Wage=$30,340 as of 5/9/2011) October 10, 2011 Regular Item 601 Page 3 c.Relocating or Expanding Companies proposing to locate in a ‘targeted area:’ 80% of Seminole County Average Wage (SC Avg. Wage= $37,925) (80% of Avg. Wage=$30,340 as of 5/9/2011) (Average Wage Data Source: Enterprise Florida, Inc.) 5.Capital Investment: Consideration will be given to applications that propose the construction of new facilities or additions to existing facilities that provide an addition to the non-residential tax base. APPLICATION: 1.Applicants for consideration for participation in the Winter Springs Ad Valorem Tax Exemption program will complete an application form requiring the following development program information for submittal: Business Name and Federal ID Number (FEIN); Business description and NAICS classification; Primary Contact Information / Address; Proposed Physical Development Program / Expansion / Relocation Estimated Capital Investment Value of Proposed Expansion or Relocation (includes building value, long term lease and equipment); Timing, type and distribution of new jobs to be created, including position classification, annual wage and other benefits; Type and distribution of existing jobs to be retained, classification, annual wage and other benefits; Statement that “but for” the consideration of potential availability of incentives to offset development costs of the proposed expansion or relocation the Winter Springs site or facility would not be viable or under consideration; Requested period of tax abatement; (The Ad Valorem Tax Exemption Program was enacted in 2010 and will remain in effect until 2020) Anticipated Spin-Off impacts (Employee housing purchases, purchases associated with operations, etc.); and Anticipated use of local suppliers or contractors. 2.Applications and discussions between the City and applicants may be maintained confidential in accordance with the provisions of Section 288.075 of the Florida Statutes. October 10, 2011 Regular Item 601 Page 4 EVALUATION: 1.Completed Applications for consideration would be submitted to the City of Winter Springs City Manager, or the Manager’s designee, for a review of Application completeness and sufficiency; 2.A Staff level review would be completed by the City Manager and the City Attorney. 3.Upon a preliminary determination by the City Manager that the Application satisfies the requirements of this Resolution, the Application will be forwarded to the Winter Springs City Commission for preliminary consideration. The City Manager will forward the Application along with a recommendation as to whether or not the Application should be approved or denied, the amount of the award, and if approved, if any conditions are to be placed upon the award. APPROVAL: 1.The City Manager, or the Manager’s designee, shall prepare an Agenda item for consideration by the Winter Springs City Commission at a regularly scheduled City Commission meeting. 2.Said Agenda Item shall include: A complete and satisfactory Application; The findings and recommendations of the staff level review; A Ad Valorem Tax Exemption program Performance Agreement that details the proposed performance criteria of the applicant and City; The Summary Report of the staff level recommendations; and The anticipated ad-valorem taxes (or fiscal impact) to be generated by the Project and the anticipated time period for said ad-valorem taxes to equal and exceed the award amount (Return on Investment period). 3.Tax exemptions are approved at the discretion of the City of Winter Springs City Commission through the adoption of an Ordinance authorizing the tax exemptions to the qualified applicant. No exemption may exceed ten (10) years past the referendum approval date of November 2, 2010, unless the tax exemption program is authorized for another ten (10) year period by the electors of the City of Winter Springs. 4.No City-based taxes shall be abated, even if the application has been approved (Adopted Ordinance) by the City Commission until a complete and executed Tax Exemption Performance Agreement has been filed with the City Manager. October 10, 2011 Regular Item 601 Page 5 PERFORMANCE AGREEMENTS AND MONITORING: 1.Performance Agreements Tax Abatement Applicants that are approved (Adopted Ordinance) by the Winter Springs City Commission to receive a Winter Springs Tax Exemption shall be required to enter into a Tax Exemption Performance Agreement. This Performance Agreement will detail the Applicant’s responsibilities regarding specific job creation criteria, capital investment criteria, wage and salary criteria, timing, reporting requirements and other terms and conditions to satisfy agreed upon conditions and performance objectives. The Performance Agreement will also detail the City’s responsibilities regarding the amount or proportion of ad-valorem or personal property tax to be exempted and the term or duration of the exemption (abatement). No City of Winter Springs taxes may be exempted (abated) until the approved applicant has filed with the City Manager a fully executed Tax Abatement Performance Agreement. 2.Monitoring The satisfaction of the terms of the Performance Agreement shall be monitored by the City through an Annual Report to be submitted by the Applicant. Upon review by the City, if the applicant has not satisfied the terms and conditions of the Performance Agreement, the City may terminate the Agreement or Modify (Pro- rate) the amount of the subsequent years’ tax exemption (abatement) amount to be commensurate with any partial satisfaction of the terms of the Performance Agreement. The termination or modification of any Tax Exemption incentive proffered by the City shall be at the discretion of the Winter Springs City Commission. FISCAL IMPACT: There is no immediate fiscal impact associated with this agenda item. The way this program is structured no money is exchanged. As part of the evaluation of the Application, the City Manager, or the Manager’s designee, will prepare an economic impact report that will identify the economic impact associated with the operation of the Applicant’s facility and the potential cost to the City (reduced ad valorem revenue) regarding the proposed exemption. This economic impact report will be performed on a case-by-case basis and will assess, among other factors, the secondary economic benefits of the company’s relocation to or expansion in Winter Springs. Exemptions from ad valorem taxes will forego a portion of the City’s overall general fund revenue for a specified period of time when there are companies utilizing the program. RECOMMENDATION: The City Manager and Community Development Department are requesting that the City Resolution 2011-47 Commission to adopt approving the operational procedures for the City of Winter Springs Ad Valorem Tax Exemption program which will allow the City to utilize this economic development program as a business recruitment and retention tool.
