HomeMy WebLinkAbout2011 09 26 Public Hearing 503 Ordinance 2011-08 Home Occupations And Home OfficeCITY COMMISSION AGENDA ITEM 503 September 26, 2011 Meeting Consent Information Public Hearing X Regular REQUEST: The Community Development Department — Planning Division requests that the City Commission hold a public hearing for first reading of Ordinance 2011 -08, which revises the regulatory language for home occupations and home offices, in the City's Code of Ordinances. (First reading of this Ordinance was previously continued from the July 25, 2011 City Commission Meeting due to concerns of several citizens.) SYNOPSIS: At the July 25, 2011 City Commission meeting, several residents voiced concerns about the proposed changes represented in the subj ect ordinance as related to home -based businesses. At that meeting, the City Commission postponed the item to a date certain in order to give staff time to meet those concerned and consider their requests. Following the meeting, staff meet with those citizens to understand their concerns and ultimately incorporate them into the proposed ordinance. This ordinance incorporates changes made as a result of meetings with those concerned citizens. Currently, the only regulating language related to home occupations is located in the definition section of the zoning chapter (Section 20 -1). This ordinance simplifies the definition in section 20 -1 and adds a new section of regulatory text (Section 20 -452) as well as specifically allowing home occupations as a permitted use in all residential zoning districts. Changes are primarily proposed to Chapter 20, with one minor change, in Chapter 9. The ordinance is not to be construed as reclassifying any business, profession or occupation or as revising the rate structure for business taxes as established under Ordinance 674, adopted August 25, 1997. CONSIDERATIONS: APPLICABLE LAW, PUBLIC POLICY, AND EVENTS Florida Statute 163.2511- 163.3246 : (Provides that land development regulations for municipal planning be consistent with the Comprehensive Plan). S. 365 (1926) (upholding the constitutionality of the principles of zoning). The proposed change to the definition of "home occupation or home office" is followed by a new section of text in the Supplemental District Regulations of the chapter. Even though the language in the new section of text is entirely new, it draws upon the existing language found in the definition section The new regulations revise and expand the existing language currently included within the definition section (section 20 -1), as follows: Broader Language 1) Location- allowed not only in the home but also may be allowed in a permitted accessory building. Home occupations are not permitted in accessory dwelling units (ADU's). 2) Area- an increase of allowable area from 20% to 30% of the conditioned area of the residence for home occupation use provided the use is incidental and subordinate to the use of the dwelling for residential purposes. 3) Product & Type- restriction removed requiring goods to be made on site. 4) Employees- Does not restrict the number of immediate family members participating, as long as they reside on site. 5) Approval process- Location no longer subject to Planning & Zoning Board approval. Research indicates that the last Planning & Zoning Board action regarding a home occupations was in 1995. A home occupation or home office will be required to obtain a business tax receipt prior to approval. More Restrictive Lanyya e 1) Product & Type- The specific list of non - allowable uses has been expanded. 2) Signage- No exterior signage advertising the home occupation is permitted on the outside of the building. 3) Equipment- No equipment or process used in the home occupation shall create noise, vibration, glare, fumes, odors or air pollution off the building site. 4) Hazardous Materials- not previously mentioned, now specifically prohibited except for those that are commonly used for domestic or household purposes. 5) Objectionable noise, fumes, odor, dust, or electronic interference- not previously mentioned, now specifically prohibited. 6) City business tax receipts - reiterated for clarity that the home occupation is subject to these requirements. FISCAL IMPACT: While there is no immediately measurable fiscal impact associated with this ordinance, the intent is to create a more predictable and defined framework within which home -based businesses can be fostered and become viable within the residential portions of the City without becoming a potential nuisance to the neighborhood. WHEREAS, the City is granted the authority, under § 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission desires to amend the City Code related to home occupations and home offices, and; WHEREAS, the City Commission desires to permit home occupations and home offices in all residential zoning districts subject to certain conditions; and WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this ordinance to be in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by reference as legislative findings of the City Commission of Winter Springs. Section 2. Code Amendment. The City of Winter Springs Code of Ordinances, Chapter 9, Land Development and Chapter 20, Zoning, is hereby amended as follows (underlined type indicates additions and str-ikeett type indicates deletions, while asterisks (* * *) indicate a deletion from the Ordinance of text existing in Chapters 9 or 20. It is intended that the text in Chapters 9 and 20 denoted by the asterisks and set forth in this Ordinance shall remain unchanged from the language existing prior to adoption of this ordinance): CHAPTER 20. ARTICLE III. ESTABLISHMENT OF DISTRICTS DIVISION 2. R -IAAA SINGLE - FAMILY DWELLING DISTRICTS Sec. 20 -122. Uses permitted. Within any R -IAAA Single - Family Dwelling District no building, structure, land or water shall be used except for the following use: (1) Single- family dwellings and their customary accessory uses. (2) Home occupations. City of Winter Springs Ordinance No. 2011 -08 Page 2 of 7 DIVISION 3. R -CI SINGLE - FAMILY DWELLING DISTRICT Sec. 20 -142. Uses permitted. Within any R -C1 Single - Family Dwelling Districts, no building, structure, land or water shall be used except for the following use: (1) Single - family dwellings and their customary accessory uses. (2) Horses and ponies, allowing three - fourths of an acre per animal not to exceed ten (10) animals per lot; provided however, horses and ponies can be permitted on less than three - fourths of an acre upon recommendation by the board of adjustment. (3) Home occupations. DIVISION 4. R -1AA AND R -IA ONE - FAMILY DWELLING DISTRICTS Sec. 20 -162. Uses permitted. Within any R -lAA and R -lA Single- Family Dwelling District, no building, structure, land or water shall be used except for the following use: (1) Single - family dwellings and their customary accessory uses. (2) Home occupations. ARTICLE IV. PLANNED UNIT DEVELOPMENTS Sec. 20 -353. Permitted Uses. Permissible Uses, Density, & Intensity. Permissible uses within the PUD shall be established within the development agreement consistent with the underlying future land use designation(s) identified on the future land use map of the comprehensive plan. There shall be at least two (2) different uses within a new PUD, and at least one of the City of Winter Springs Ordinance No. 2011 -08 Page 3 of 7 uses shall be a non - residential use. Nothing herein shall be construed to abrogate specific use restrictions set forth in this Code including the restrictions set forth in Chapter 20, Article V, Supplemental District Regulations. Home occupations shall be permitted within the PUD subject to the provisions of Chapter 20 and are not required to be established within the development agreement. ARTICLE V. SUPPLEMENTAL DISTRICT REGULATIONS DIVISON 4. REGULATION OF HOME OCCUPATIONS OR HOME OFFICES. Section 20 -452. Home occupations or home offices. (a) A home occupation or home office is permitted in all residential zoning categories provided that: 1. The use as a home occupation or home office shall be incidental and subordinate to the use of the dwelling for residential purposes, with not over thirty percent (30 %) of the air - conditioned area used for the home occupation, 2. The use as a home occupation or home office shall not impact the residential character of the neighborhood in which it is located. 3. The occupation is conducted entirely within the residence or within a permitted accessory building. A home occupation is not permitted within an accessory dwelling unit. 4. There shall be no exterior advertising of the home occupation on the outside of the building. 5. There shall be no exterior storage or display on the premises of material or equipment used as a part of the home occupation. 6. The following shall not be considered home occupations: a. Adult entertainment establishments, b. Antique shops, c. Art studio for group instruction, d. Auto service and repair, e. Mechanical service and repair, f Barber and cosmetology services, g. Band or music instruction for groups, h. Bed and breakfast facilities, City of Winter Springs Ordinance No. 2011 -08 Page 4 of 7 i. Clubs, private, j. Drive -in facilities, k. Eating and drinking establishments, 1. Escort services, m. Food processing and handling, commercial, n. Fortune tellers, o. Funeral homes, p. Group instruction for more than two people, q. Health spas, r. Hospitals and clinics, S. Hotels /motels, t. Kennels or overnight boarding of animals, U. Massage therapy, v. Photographic studios involving chemicals or client visitors, w. Retail commercial operations, x. Sexually oriented businesses, y. Vehicle sales or rental, z. Tattoo parlors, aa. Health care providers, or bb. Any other use or activity similar in nature or purpose to those listed herein and anv other use or activitv inconsistent with the reauirements of this Code. 7. No person other than inhabitants residing on the premises shall be engaged in the home occupation or home office, 8. No traffic /parking shall be generated by the home occupation or home office in greater volumes than would normally be expected in a residential neighborhood, and 9. No hazardous material shall be used or stored on the premises in connection with the home occupation or office, except such that is normally used for purely domestic or household purposes. 10. No equipment or process used in the home occupation shall create noise, vibration, glare, fumes, odors or air pollution off the building site. (b) A home occupation or home office is permitted in the Town Center subject to the provisions of section 20 -324 (7). (c) All home occupations and home offices as defined in section 20 -1 shall be required to obtain a business tax receipt as required by section 10 -26, prior to the start of such use. In addition to anv other submittals reauired for a business tax receipt_ the abblicant shall also submit the following: 1. The exact nature of the home occupation_ City of Winter Springs Ordinance No. 2011 -08 Page 5 of 7 2. Total air - conditioned floor area (square feet) of the residence, and 3. Amount of area, measured in square feet, to be utilized in conducting the home occupation or home office. CHAPTER 9. LAND DEVELOPMENT Sec. 9- 291.2. Definitions. (c) Nonresidential: Includes all land uses not otherwise specified as residential or exempted as set forth in this division. This shall include, but is not limited to, day care facilities, residential care facilities, nursing homes, boarding houses heffie e eett. 'is educational facilities, libraries, cultural facilities, churches, all commercial uses, all transient lodging and entertainment facilities except those which are temporary in nature, all automotive facilities and /or structures, all miscellaneous business uses and services and all industrial uses. Section 3 . Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4 . Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this Ordinance and the City Code may be freely made. Section 5 . Severability. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 6 . Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter. Ms. Eloise Sahlstrom, AICP, ASLA, Senior Planner, Community Development Department presented this Agenda Item and stated, "Item `500' is a new portion of the Code (of Ordinances) that — we are proposing as well as a rewrite of the definition. Currently, home occupations are listed in the definition Section of 20 -1. This Ordinance which is 2011 -08 will revise that definition and make it more of a definition than a regulatory description with the regulatory language added to a different Section of Chapter 20."
