REQUEST: The Community Development Department requests the City Commission hold a Public Hearing and consider a re- approval of the Aesthetic Review of the proposed wall, located generally along the north and much of the east perimeter of property owned by Bart and Cynthia Phillips, north of SR 419 and west of Layer Elementary School. SYNOPSIS: The purpose of this agenda item is for the Commission to consider re- approving the aesthetic review for the proposed 10' high wall proposed along the north side of SR 419 and the western property line of Layer Elementary School in conjunction with the 30 -foot wide Cross Seminole Trail right -of -way. The City Commission approved the aesthetic review of this wall on January 26, 2009. Pursuant to Section 9- 604 of the City's Code of Ordinances, the aesthetic review expires eighteen (18) months after approval by the City Commission unless a building permit is issued for the work. While a building permit was issued in April, 2009, the permit has since expired and, therefore, so has the aesthetic review approval. Various concerns and delays in securing approval for a trail crossing of the CSX Railroad tracks have contributed to the delay in constructing the wall. The applicant has submitted a new application for a permit to construct the subject wall and this application is currently under review by the building department. The permit cannot be issued unless and until the City Commission re- approves the aesthetic review. The aesthetics of the proposed wall are the same as approved by the City Commission in 2009. The purpose of the Aesthetic Review process is to encourage creative, effective, and flexible architectural standards and cohesive community development consistent with the intent and purpose of Article XI — Minimum Community Appearance and Aesthetic Review Standards. No. 2008 -13) Ordinance No. 2008 -11 "Consent to Zoning Restrictions" document Florida Power & Light easement agreement CONSIDERATIONS: The applicant proposes to (1) construct a 10 foot tall masonry wall along the eastern boundary of their properties, abutting the Layer Elementary School site and (2) to construct a 10 foot masonry wall along the SR 419 frontage, adjacent to the portion of the site that is proposed for inclusion in the Cross Seminole Trail. The applicant proposes to plant creeping fig vines along the outside of an unpainted wall (the creeping fig vine is to cover a large expanse of the exterior of the wall) and maintain responsibility for the wall and plantings. A gate is proposed across a portion of the FPL easement. Staff believes, at a minimum, that (1) the wall exterior side needs to have a concrete stain and that (2) drip irrigation must be provided and maintained for the vines, to ensure their survival, growth, and viability. Staff also believes that provisions need to be made for the timely removal of any graffiti or other damage or vandalism that occurs on the wall as well as the care and possible replacement of the vines. The submittal requirements for aesthetic review are set forth in Section 9 -605 and include the following: (a) a site plan; (b) elevations illustrating all sides of structures facing public streets or spaces; (c) illustrations of all walls, fences, and other accessory structures and the indication of height and their associated materials; (d) elevation of proposed exterior permanent signs or other constructed elements other than habitable space, if any; (e) illustrations of materials, texture, and colors to be used on all buildings, accessory structures, exterior signs; and (f) other architectural and engineering data as may be required. The procedures for review and approval are set forth in Section 9 -603. Staff has requested the applicant provide a written statement describing how the wall will meet the criteria set forth in sections 20 -603 and 20 -605. The City Commission may approve, approve with conditions, or disapprove the application only after consideration of whether the following criteria have been satisfied: (1) The plans and specifications of the proposed project indicate that the setting, landscaping, proportions, materials, colors, textures, scale, unity, balance, rhythm, contrast, and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. The applicant's proposal is to provide an unpainted 10 foot -tall cast concrete wall upon which creeping fig vines are to grow and adhere. (2) The plans for the proposed project are in harmony with any future development which has been formally approved by the City within the surrounding area. The proposed wall is in harmony with the existing industrial character and uses north of that segment of SR 419, as well as with the prescribed uses in the restricted rezoning. (3) The plans for the proposed project are not excessively similar or dissimilar to any other building, structure or sign which is either fully constructed, permitted but not fully constructed, 2 September 12, 2011 Public Hearing Item 505 Page 3 of 4 or included on the same permit application, and facing upon the same or intersecting street within five hundred (500) feet of the proposed site, with respect to one or more of the following features of exterior design and appearance: (A) Front or side elevations, (B) Size and arrangement of elevation facing the street, including reverse arrangement, (C) Other significant features of design such as, but not limited to: materials, roof line, hardscape improvements, and height or design elements. The proposed wall design is envisioned to buffer /screen vehicles, machinery, and materials of up to a 13.5 foot tall height on the commercial properties and the recycle /salvage operations on the industrial properties. (4) The plans for the proposed project are in harmony with, or significantly enhance, the established character of other buildings, structures or signs in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community. The proposed wall design is in harmony with the existing character of the industrial uses in the area and will set a new standard for the City. (5) The proposed project is consistent and compatible with the intent and purpose of this Article, the Comprehensive Plan for Winter Springs, design criteria adopted by the city (e.g. Town Center guidelines) and other applicable federal state or local laws. Staff believes that the aesthetic package meets the requirements of this Article for this area, provided a reasonable color stain is applied to the "outside" of the wall, drip irrigation is provided to the creeping fig vines, provisions are made for care and replacement of the irrigation system or plants, and provisions are made for the removal of graffiti from or repair of damage to the wall or its elements (e.g. gates, plantings). (6) The proposed project has incorporated significant architectural enhancements such as concrete masonry units with stucco, marble, termite - resistant wood, wrought iron, brick, columns and piers, porches, arches, fountains, planting areas, display windows, and other distinctive design detailing and promoting the character of the community. (Not Applicable) FINDINGS: 1. The proposed 10 foot tall concrete wall is located within the City of Winter Springs Industrial and Commercial FLU designations (I -1 and C -2 zoning, respectively). 2. The applicant proposes to locate the wall along the easternmost portion of their property (west of Layer Elementary) and adjacent to property that is proposed to become a part of the Cross Seminole Trail along the northern side of SR 419. 3. Staff believes that provision of an acceptable concrete stain to the `exterior" side of the wall, a drip irrigation system for the creeping fig, and adequate /timely maintenance of the irrigation, plantings, gates, and wall (including graffiti removal) are key elements to this approval. 3 September 12, 2011 Public Hearing Item 505 Page 4 of 4 FISCAL IMPACT: There is no direct fiscal impact to the City associated with this agenda item COMMUNICATION EFFORTS: This Agenda Item Has Been Electronically Forwarded To The Mayor And City Commission, City Manager, City Attorney /Staff, And Is Available On The City's Website, LaserFiche, And The City's Server. RECOMMENDATION: Staff recommends that the City Commission re- approve the aesthetic review for the proposed wall along SR 419 and the common property line between Layer Elementary and the 419 Metals site, again, subject to the findings as listed above. Community Development Department Requests The City Commission Hold A Public Hearing For The Aesthetic Review Of The Proposed Wall, Located Generally Along The North And Much Of The East Perimeter Of Property Owned By Bart And Cynthia Phillips, North Of SR (State Road) 419 And West Of Layer Elementary School. Commissioner Bonner noted, "I am going to remove myself and recuse myself from this particular situation at this time; again under the learned advice of our Attorney, and I am actually going to depart the dais at this time and go in the back." Commissioner Bonner left the dais at S: 49 p.m. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION REGULAR MEETING - JANUARY 26, 2009 PAGE 4 OF 30 Mr. Randy Stevenson, ASLA, AICP, Director, Community Development Department introduced this Agenda Item for discussion, and stated, "We would request that at least a stain be applied to the exterior of this wall, some type of concrete stain. That's the only condition I think where we differ with the Applicant. And we are concerned about vandalism out there and I think the Police Department can address that issue." Mr. Stevenson added, "I believe the Applicant - can certainly speak to this - has agreed not only to plant the Creeping Fig though; but to maintain the irrigation system and to take care of any graffiti that comes on out there." Discussion. Mr. Bart Phillips, 212 Morton Lane, Winter Springs, Florida: spoke of his concern that the stain might slow the growth of the plants. Brief discussion. Mr. Bob Goff, 419 Metal and Auto Recycling Center, 600 Old Sanford - Oviedo Road, Winter Springs, Florida: spoke on the time it would take for the plantings to grow in. Further discussion. Commissioner Jean Hovey remarked, "Once it is up and growing, who is maintaining it to make sure the bushes and things look nice ?" Mr. Stevenson responded, "I believe that is going to be the responsibility of the Applicant." Mr. Phillips stated, "Correct." Mayor Bush opened the "Public Input" portion of the Agenda Item. Ms. Maureen Landgraff, 704 Silver Creek Drive, Winter Springs, Florida: asked if color could be mixed in with the concrete mix. Mayor Bush closed the "Public Input" portion of the Agenda Item.
