HomeMy WebLinkAbout2011 09 12 Consent 207 Resolution 2011-46 Employee Break Time 1 Page | COMMISSION AGENDA CONSENT X INFORMATIONAL ITEM 207 PUBLIC HEARING REGULAR MGR /DEPT September 12, 2011 Meeting Authorization REQUEST: The City Manager and Finance and Administrative Services Department are requesting the Commission consider adoption of Resolution 2011-46, amending Policy 17.4 of the Winter Springs Personnel Manual related to Meals and Breaks. SYSNOPSIS: This agenda item is needed to seek Commission approval of a change to the Winter Springs Personnel Manual Policy 17.4 “Meals and Breaks.” The changes incorporated in this agenda item are focused on the two (2) 15- minute breaks currently provided to each employee by the City’s Personnel Manual. The recommendation is to revise the language of the policy to provide employees breaks when business/operational conditions permit. As currently worded, the Personnel Manual does not leave any discretion to management as to when or if an employee will receive a break. CONSIDERATIONS: Currently the Winter Springs Personnel Manual requires managers to give all hourly workers two (2) 15- minute breaks without consideration of the work-load or unanticipated peaks in demand for services by our customers. The current Personnel Manual Policy 17.4 reads as follows: All employees will receive a lunch period of thirty (30) minute or sixty (60) (as established in the work schedule by Department Heads to accommodate operating requirements) and two fifteen (15) minute break periods during the course of the normal work day.. . . . [bold emphasis added]. The U.S. Department of Labor does not have any regulations regarding mandatory breaks, as they are not considered to be working time. Additionally, an employer is not required by law to provide for breaks in the state of Florida. RECOMMENDATION: City Manager and Director of Finance and Administrative Services recommend the Commission adopt Resolution 2011-46 amending Policy 17.4 of the Winter Springs Personnel Manual to allow operational discretion to determine the length and timing of employee breaks. WHEREAS, the City is granted the authority under Section 2(b), Article VIII, of the State Constitution to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City's Personnel Manual, which governs the conduct and employment of all Winter Springs employees, except those expressly excluded therein, is required to be amended by Resolution of the City Commission; and WHEREAS, the City desires to revise Policy 17.4 of the Personnel Manual as set forth herein to provide increased flexibility and discretion for City management related to employee breaks; and WHEREAS, the City Commission believes adoption of this Resolution is in the best interests of the citizens and employees of the City of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by this reference and are deemed a material part of this Resolution. Section 2. Amendment to Policy 17.4 of the City Personnel Manual. Policy 17.4 of the Winter Springs Personnel Manual is hereby amended as follows (underlined type indicates additions to, and stri�:e�hra�tgi� type indicates deletions from the existing language of Policy 17.4. Those portions of Policy 17.4 not modified by this Resolution shall remain as is): 17.4 Meals and Breaks All employees will receive a lunch period of thirty (30) minutes or sixty (60) minutes and mav receive two (21 breaks not to exceed 15-minutes each durin� the course of the normal work dav (as established in the wark scheduled by Department Heads to accommodate operating requirements) . Employees will be relieved of all active responsibilities and restrictions (with the exception of shift employees) during meal periods and will not be compensated for that time. Employees must utilize their lunch period during the designated hours established for the department. The lunch hour shall not be accumulated and cannot be saved for the purposes of leaving work early. Employees are not permitted to work before or past their regularly scheduled hours or during their lunch period unless specifically authorized by the Department head. Section 3. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 4. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
