Krebs - Seat Five CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION ATTORNEY -CLIENT SESSION — MAY 9, 2011 PAGE 2 OF 2 I. Call to Order (Open to Public) The Attorney -Client Session of Monday, May 9, 2011 of the City Commission was called to Order by Mayor Charles Lacey at 4:01 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). II. Attorney -Client Session (Closed to Public) Pursuant To Section 286.011(8), Florida Statutes, the City Attorney will be seeking the advice of the City Commission regarding settlement negotiations and strategy and litigation expenditures related to the pending litigation titled Esterson Construction Company, Inc. v. City of Winter Springs, Case Number 07- CA-756-15-G, in the 181h Judicial Circuit in and for Seminole County, Florida. The persons scheduled to be in attendance are Mayor Charles Lacey, Deputy Mayor Jean Hovey, Commissioner Rick Brown, Commissioner Gary Bonner, Commissioner Cade Resnick, Commissioner Joanne M. Krebs, City Manager Kevin L. Smith,and from the City Attorney's Office (Anthony A. Garganese and Vivian Cocotas) and a court reporter. City Attorney Anthony A. Garganese briefly spoke on this Attorney -Client Session. Mayor Lacey stated, "The persons scheduled to be in attendance are Mayor Charles Lacey, Deputy Mayor Jean Hovey, Commissioner Rick Brown, Commissioner Gary Bonner, Commissioner Cade Resnick, Commissioner Joanne M. Krebs, City Manager Kevin L. Smith, and from the City Attorney's Office, Anthony Garganese and Vivian Cocotas and a Court Reporter." This portion of the Attorney -Client Session was then closed. Those attending this Attorney -Client Session left the Commission Chambers at 4:04 p.m. At 4: 20 p.m., those who left for the Attorney -Client Session returned to the Commission Chambers. Mayor Lacey then called the Attorney -Client Session back to Order. III.
