Meeting REQUEST: The Community Development Department requests the City Commission approve a 6 month extension for a Conditional Use approval and Setback Waiver which permitted the expansion of a 530 square foot detached garage on a 1.14 acre property located at 115 West Tradewinds Road. These requests were approved by the City Commission on June 8, 2009 as Items 502 and 503. ______________________________________________________________________________ SYNOPSIS: Section 20-36 of the Code of Ordinances states Conditional Uses and Waivers that have been approved by the City Commission will expire 2 years after the effective date of said approval. This Section of the Code requires property owners who need extensions of these approvals to submit a request in writing to the City Commission. The City Commission has the discretion to extend the approval period for an additional 6 months provided the property owner demonstrates good cause for the extension. CONSIDERATIONS: APPLICABLE LAW AND PUBLIC POLICY Section 20-36, City of Winter Springs Code of Ordinances BACKGROUND On June 8, 2009, Mr. Todd Fante petitioned the City Commission to approve a Conditional Use and Setback Waiver to permit the enlargement an existing detached garage on his property from a size of 530 square feet to 1,060 square feet. The Conditional Use was requested due to the requirement of Section 6-84 of the Code of Ordinances not permitting detached accessory buildings to exceed one- third (1/3) the area of the air-conditioned square footage of the principle structure. The proposed addition to the garage would have increased the size of the accessory building to 1,060 square feet, or one-half (1/2) the size of the primary structure, which is 2,121 square feet. Additionally, Mr. Fante petitioned the City Commission to permit a waiver request to allow a reduction to the 20-foot side and 35-foot rear setbacks in the RC-1 (Single-family dwelling) zoning district to a 15-foot side setback and a 14-foot setback from the rear property line. Both of these April 25, 2011 Commission Consent Agenda Item 201 Page 2 of 2 requests were approved as Items 502 and 503 on the June 8, 2009 City Commission agenda. Due to current economic conditions, Mr. Fante has been unable to construct the addition and is requesting the 6-month extension for the Conditional Use approval and Setback Waiver. FISCAL IMPACT: No funding required. COMMUNICATION EFFORTS: This Agenda Item Has Been Electronically Forwarded To The Mayor And City Commission, City Manager, City Attorney/Staff, And All eAlert/eCitizen Recipients; And Is Available On The City’s Website, LaserFiche, And The City’s Server. Additionally, Portions Of This Agenda Item Are Typed Verbatim On The Respective Meeting Agenda Which Has Also Been Electronically Forwarded To The Individuals Noted Above; And Which Is Also Available On The City’s Website, LaserFiche, And The City’s Server; Has Been Sent To City Staff, Media/Press Representatives Who Have Requested Agendas/Agenda Item Information, Homeowner’s Associations/Representatives On File With The City, And All Individuals Who Have Requested Such Information; And Has Been Posted Outside City Hall; Posted Inside City Hall With Additional Copies Available For The General Public; And Posted At Five (5) Different Locations Around The City. This Agenda Item Is Also Available To Any New Individual Requestors. City Staff Is Always Willing To Discuss This Or Any Agenda Item With Any Interested Individuals. RECOMMENDATIONS: Staff recommends the City Commission approve a six month extension for the Conditional Use and Setback Waiver for 115 West Tradewinds Road. ATTACHMENTS : A.
