A concept plan for Sonesta Pointe was conditionally approved by the City Commission on June 14, 2010. This concept plan shows Sonesta Pointe consisting of 255 residential units made up of 60 detached single-family estate homes, 133 detached single-family bungalow units, and 60 townhomes. The Sonesta Pointe site was previously owned by Tousa Homes. A development plan for a 408-unit all-townhome Tousa Homes project was approved by the City Commission in December 2006; however, Tousa Homes did not proceed with the project and the property was eventually acquired by Meritage Homes in February 2010. At the August 9, 2010 City Commission meeting, the Commission conditionally approved a Site Development Permit Agreement that permits Meritage Homes to clear and mass grade the site to prepare it for the proposed 255-unit residential development. In reviewing the proposed Site Development Permit Agreement, the City expressed concerns to Meritage Homes about the possibility that the site would be cleared and then not followed-up with the timely completion of the development. In response to this concern, the Site Development Permit Agreement was approved with the following conditions: • Meritage Homes shall maintain 50-foot wid� undisturbed natural buffers along the eastern (Tuskawilla Road) and northern (St. Johns Landing) property boundaries until the Final Engineering plans are approved by the City Commission. The 50-foot buffer alo��_the rorthern property is in ad�ina.-to the existing undisturbed - strip of land between St. lohns Landing and the Sonesta Pointe property. T his 40-foot wide st rip 3 � '� consists of a 35-foot wide strip owned by the �tate of Florida Office of Greenways and Trai s an a 5-foot wide strip owned by the Scrimsher Land Fund. _ • Meritage Homes shall provide security to the City in the form of a cash deposit or letter of credit in the amount of $140,000 that would be used to implement a site restoration program in the event that Meritage defaulted under the terms of the Agreement. The site restoration program includes re-grading the site to eliminate high stockpiles of dirt, grassing and/or mulching all disturbed areas, and implementing a supplemental planting plan to minimize the direct view of disturbed portions of the property from Tuskawilla Road and St. Johns Landing. • Construction vehicles shall primarily utilize a temporary access route across the vacant property located between the site and S.R. 434, in order to minimize construction traffic on Tuskawilla Road. • In addition to the City's standard Arbor Permit Fee, Meritage shall make a contribution to the City's tree bank in the amount of $39,000 to partially offset the loss of tree canopy value to the City caused by the removal of existing trees on the Sonesta Pointe site. This contribution shall be used to purchase and install trees and landscape materials within the Town Center. Next Steps for Sonesta Pointe: The Sonesta Pointe project is currently in the Final Engineering phase. Meritage Homes submitted Final Engineering plans (first submittal) to the City in July 2010 and City Staff returned review comments in August 2010. After the Final Engineering plans are submitted and determined to be acceptable to City Staff, which may take one or more submittals, the plans will then be submitted to the City Commission for approval as part of a regular Commission agenda item. Meritage Homes is also currently preparing the aesthetic review plans for the project. The aesthetic review plans consist of the architectural details and color renderings for the various residential unit types. M�ke Cannell 221 Torcaso Court Winter Springs, FL 32708 Dear Mr. Cannell: Thank you for your letter to the City Clerk expressing interest and requesting information about the Town Center District Code and District Boundary. After numerous public meetings and advertised public hearings, the formal adoption of the code was finalized by the City Commission on June 12, 2000. Enclosed is a copy of the agenda item which documents the approval process and lists the various meeting dates. A copy of the Town Center District Code which specifies allowable uses and design criteria is available for $21.95. The maximum building height is four (4) stories or 55 feet. The realignment of the Cross Seminole Trail was part of the planning process. The equestrian trail segment was designed to keep horses out of the congested downtown area. The formal application to relocate the trail segments was submitted to the Florida Department of Environmental Protecrion by Seminole County on August 6, 1999. The trail segment that runs behind St. Johns Landing is an unpaved thirty five (35') foot nature trail and equestrian right of way which eventually connects to the multi-use paved trail before crossing State Road 434 on a pedestrian bridge. The owner of the property adjacent to St. 3ohns Landing has agreed, in a formal document, to construct�, six� foot concrete block or brick wall between any commercial or multi-family development that may occur adjacent to the St. Johns Landing subdivision. The wall will commence at the Tuskawilla Road right-of-way and terminate at the southeastern corner of the eastern-most developable lot contiguous to the common boundary between St. Johns Landing and the Schrimsher property. The property owner also agreed to provide a buffer not less than fifly (� eet in width along the northern boundary adjacent to St. Johns Landing. The unpaved trail right-of-way may count towazd meeting the buffer requirement. , i/ The retention ponds depicted on the Town Center Plan are conceptual and do not necessarily indicate the actual size or location of retention ponds that may be required as part of the development program. A master stormwater plan will he engineered according to local, state, and federal laws. There is the expecta.tion that a trailhead will be established at Magnolia Square, which is centrally located in the Town Center. The final design for the trailhead may include res�raom facilities, a water feature and an amphitheater.
