Authorization REQUEST: The Community Development Department- Planning Division requests that the City Commission approve the proposed 4 parcel plat and authorize the City Attorney to finalize all required documents. SYNOPSIS: The City and Meritage Homes of Florida need to approve the proposed 4 parcel plat concurrently with any final engineering plans for the 40 acre Meritage development site known as the Winter Springs Village. The 4 parcel plat would convey Wetland Park and a portion of Michael Blake Boulevard to the City. CONSIDERATIONS: LAND USE & ZONING Zoning: Town Center Future Land Use: Town Center APPLICABLE REGULATIONS Chapter 177, Florida Statutes. Chapter 197, Florida Statutes Chapter 9, City Code of Ordinances Schrimsher Development Agreement Discussion Approval of a final subdivision plat is regulated by Chapter 9 of the City Code of Ordinances (e.g. sections 9-3, 9-4, 9-75, 9-77; recording and distribution addressed in Section 9-78) and Chapter 177, Florida Statutes. The 2010 property taxes have been paid for the subject properties that encompass the plat. A title certification has been prepared by Merimark Title LLC, as of March 28, 2011 AGENDA ITEM 603 PAGE 2 OF 2 February 9, 2011. Chapter 177, Florida Statutes require that the plat be fully executed by the owner(s) or record, by all mortgagees having a record interest in the lands subdivided, by the professional surveyor and mapper, and by the independent professional surveyor and mapper who reviews the plat for consistency with Chapter 177, Florida Statutes. FISCAL IMPACT: There is no fiscal impact associated with this agenda item. COMMUNICATION EFFORTS: This Agenda Item has been forwarded to the Mayor and City Commission; City Manager; City Attorney/Staff; placed in Press Packets; placed in the City Hall (Lobby) City Commission Meeting binder; and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, information related to this Agenda Item has been sent to media/press representatives who have requested Agendas/Agenda Item information, all Homeowner’s Associations on file with the City, all individuals who have requested Agendas/Agenda Item information, Department Directors; and also posted outside City Hall; posted inside City Hall with additional copies available for the general public; and posted at five (5) different locations around the City. RECOMMENDATION: Staff recommends that the City Commission approve the 4 parcel plat and authorize the City Attorney to finalize all required documents. ATTACHMENTS: A.4 Parcel Plat
